The president’s trip to the Bay Area last week made it painfully clear that the Barack Obama re-election campaign has lost its mojo.
There was no life, no personality, no memorable line or moment and no real enthusiasm in the entire fundraising foray. In short, there was no buzz.
It was like a summer rerun of a show that wasn’t very interesting to begin with.
Worse yet, Obama sounded like he was playing catch-up to Mitt Romney. I can’t think of anything that should have him in that role, but he’s acting like the underdog.
CPUC Employees Seek Investigation of Commissioner Timothy Simon (TLR Note: Isn’t Simon Married to Lateefah Simon ? Or, like Willie Brown / Sonya Molodetskaya in sinful concubinage ?)
Employees of the California Public Utilities Commission (CPUC) have submitted a complaint to the Office of the Governor and the Fair Political Practices Commission, complaining of the “illegal and unethical” behavior of CPUC Commissioner Timothy Alan Simon.
The complaint attaches five news articles — my Reader columns of April 4 and April 24, Miriam Raftery’s East County Magazine article of April 8, and two news articles from the San Francisco Chronicle.
The complaint states that Simon’s longtime (10 years) fiance, Kimberly Brandon, is chair of the Museum of African Diaspora. At a San Francisco dinner, while Simon was away from the table, Brandon hit up a senior executive of San Diego Gas & Electric (SDGE) for a $25,000 donation to the museum — and in return, she said Simon would vote in favor of SDGE’s attempt to get San Diego customers to pay the uninsured costs of the 2007 fires, for which the utility was found negligent. San Diego attorney Mike Aguirre has mentioned this incident in his fight against the utility’s blatant attempt to have ratepayers, instead of shareholders of parent Sempra Energy, pay for the utility’s negligence — both for 2007 and for future fires. Simon is in fact the commissioner in charge of that case.
The complaint states that a California state auditor is investigating Simon allegedly billing the state for expenses of trips on behalf of third parties which had already paid for his expenses.Through this maneuver, Simon has been able to pocket significant sums, says the complaint, which notes that “Simon is addicted to travel — and to being entertained — as long as someone else is paying for it.”
Those filing the complaint said they could not use their names for fear of retaliation.

The seeming perfection of the couple’s life in their modest split-level house high in the Hayward hills had masked addiction and deceit. Nadia Lockyer, a beautiful, ambitious woman who had hitched her star to an old political warhorse, apparently was anything but happy. In a text message sent the day after Christmas to the “other man” — a fellow substance abuser from San Jose with whom she had her affair — she came across as bitter and angry, all in uppercase.

Unlike super PACs, which are required to identify their donors, social-welfare nonprofits such as Crossroads GPS and Priorities USA—also referred to as “dark money” groups—don’t have to disclose contributions to the FEC, although they are supposed to report spending on political ads within a day or two. The nonprofits have to disclose their annual revenue and expenses to the IRS, but often delay such filings. A few have not yet filed their taxes for 2010.

Campaign finance watchdogs had worried that 501(c)4s, or “c4s” as insiders call them, would filter money from unidentified donors through super PACs, but, if the recent filings are any guide, they may spend funds directly. This means c4s could have a more muscular, proactive role than previously anticipated.

recent journalistic and judicial reports of governmental corruption at the
federal, state and local level. There are other items of disclosure that would cast a greater
spotlight on the issues you raise. I decline to raise them in a public
forum, however, suffice it to say that they exist and are well documented. My preliminary opinion is that you have shown there is a smoldering amount
of smoke. Where there smoke there is often fire. There are probably
significant volumes of notes that should be compared, and other things that
could be discussed. I am particularly concerned about the threat of
litigation made to you, as a result of your investigative reporting. This
threat is clearly improper and could possibly be unlawful in and of itself. Apparently, State Attorney General Kamala D. Harris — who bears a very
close affiliation with the California State Bar — is under current
scrutiny by other prosecutors and trustees. Indeed, General Harris has
recently been sued in her official capacity for interfering with money
earmarked to be paid to the victims of disgraced financier Bernie Madoff.
I have attached certain pleadings related thereto, for your convenience. In short, you may recite that my preliminary opinion is “something does not
smell right” and “it appears Leslie Brodie has caught certain fiduciaries
speeding.” In the end, the public always wins battles against governmental corruption
and you are certainly on the right track. Sometimes, the battle may appear
on “tough days” to be “a losing battle,” but the truth should always be
your beacon. You apparently are well aware of that. If we are somehow unable to speak “real time”, I wish you the best of luck
in your quest to expose and cast light on the truth.

SAN FRANCISCO, September 21, 2006 – The California Public Utilities Commission (PUC) will hold its Fourth Annual Diversity Hearing, “Keeping California First in Diversity: Raising the Bar,” on Tuesday, October 3, 2006, featuring a keynote address from the Honorable Willie L. Brown, Jr.
The event will focus on ways to increase contracting opportunities between utilities and women, minority, and disabled veteran-owned businesses, specifically in the areas of financial, legal, architectural, and engineering services. The hearing will assess the status of diversity in procurement practices and identify areas for improvement. The Commission will frame the issues and seek feedback from participants to describe challenges and propose solutions. The event is free and a session for public comment will be included.

Willie Brown: Only Two Black Men Defended Obama Last Week
I truly found myself in the minority of minorities last week. I was a black man defending President Obama on national TV.
It appears that there are only two black cats in the country defending him – me and the mayor of Atlanta.

The aftermath of Ticketgate, however, has far out-stunk the crime itself. Villaraigosa was majorly let off the hook when the Ethics Commission only charged him $42,000 for gifts that had exceeded $50,000 and probably neared $100,000, by our calculations.
Then, as if a cityful of voters wasn’t watching, Villaraigosa had the audacity to ask for donations to help him cover the fines…
… because apparently the $232,000 salary we pay him, and the gorgeous Windsor Square mansion we bestowed upon him (albeit, without fence spikes to keep the riff-raff out), doesn’t allow for such ethical exorbitance.
Today, Villaraigosa’s scandal hurdles itself into a whole new realm of ridiculousness, with a full list of Ticketgate contributors — who, altogether, raised $123,500 to pay the mayor’s fines and legal fees. Cleverly, our leading man-about-town set up three separate funds for the donations, thereby allowing him to collect three times the $1,000 cap from each donor.

Things that can be assumed of the persons and entities on this list: Either they vehemently support a politician’s right to accept conflict-of-interest freebies from those looking to cuddle up with the city, or they’re looking for a little love themselves.
Most notable on the list is former Assembly speaker Fabian Nuñez, whose murder-convict son received an infamous sentence commute from former Governor Arnold Schwarzenegger on his last day in office. Nuñez and Schwarzenegger were close friends; now, it looks like L.A. City Hall might be nearer to that circle than we thought.
The Los Angeles Times raises an eyebrow halfway to the ceiling:
So did state Sen. Kevin De Leon (D-Los Angeles), who donated $3,000 by tapping a fund-raising committee devoted to an Assembly campaign that won’t occur until 2018.Even one Republican got into the act. Former state Sen. Jim Brulte, who used to represent a portion of the Inland Empire, contributed $1,000 to each of Villaraigosa’s three legal defense funds. …
“I contributed because Antonio is my friend and he asked for my help,” said Brulte, now a principal with the firm California Strategies, in an email. …
Others with Sacramento ties who helped out with the defense funds were former Assembly Speaker Willie Brown, who stepped up with $3,000; former Assemblyman Dario Frommer, who also gave $3,000; and Villaraigosa transit advisor Richard Katz, a former state lawmaker who contributed $2,000.
Next thing you know, they’ll be paying off each other’s pesky ethics fines via text message. LOL; thx Fbn <3

Burkle was particularly close to Speaker Willie Brown, regularly helping him with hefty campaign donations and even hiring Brown for legal advice.

Ronald Wayne Burkle (born November 12, 1952) is an American business magnate and investor. A major political fundraiser, he is listed on the Forbes 400, with an estimated net worth of $3.2 billion in 2011.[1]

Burkle was born in Pomona, California. He got his start in the supermarket business as a bag boy at his father’s grocery store. He later dropped out of college and founded Yucaipa Companies, a private equity firm[2] which invests in retail, manufacturing, and distribution. He also founded the Ronald W. Burkle Foundation[3]
Burkle has served as Chairman of the Board and controlling shareholder of numerous companies, including Alliance Entertainment,[4] Golden State Foods, Dominick’s, Fred Meyer, Ralphs, and Food4Less. He is currently a member of the board of Occidental Petroleum Corporation,[5] KB Home,[6] and Yahoo![7]
Burkle is a well-known Democratic supporter and fundraiser who has raised more than $1,000,000 for the Hillary Clinton presidential campaign. Bill Clinton is employed by The Yucaipa Companies to help identify possible investment opportunities.[8] He has supported California State Treasurer Phil Angelides and employed former San Francisco Mayor Willie Brown, both of whom are former California Public Employees’ Retirement System (CalPERS) board members, but has also made contributions to California Governor Arnold Schwarzenegger.[9] Robert Novak reported in June 2007 that 98 percent of Burkle’s $1.5 million political contributions to date have gone to Democrats.[10] Burkle helped finance Al Gore‘s cable Current TV network.[11]
Burkle is also known for a tussle with the New York Post which tagged him the “Billionaire Party Boy”.

He is part owner of the Pittsburgh Penguins[12] National Hockey League team, although his current share is unknown. He co-owns the franchise with Penguins legend Mario Lemieux. The Penguins won the Stanley Cup in 2009.

Wild Oats Markets was an operator of natural foods stores and farmers’ markets in North America. Burkle started buying Wild Oats stock in February 2005. By the time Whole Foods Market, a natural-foods grocer, agreed to pay $565 million for Wild Oats, Burkle was the largest shareholder of Wild Oats.[13]

Burkle sold his majority stake in supplier Golden State Foods to St. Louis-based Wetterau Associates for about $110 million. Golden State, one of McDonald’s biggest suppliers, operates 11 distribution centers in the United States and abroad and two U.S. processing plants.[14]
[edit] Follieri and the Vati-Con scandal
On April 30, 2008, a Delaware judge dismissed Burkle’s lawsuit against Raffaello Follieri, ex-boyfriend of actress Anne Hathaway, after he agreed to repay Burkle more than $1.3 million Burkle loaned him, a small amount of the money Burkle lost in the Vati-Con Scandal.[15]

- Sold Dominick’s chain to Safeway in 1998 for over $200 million in profits;
- Owns 20.7% stake in Americold Realty Trust;
- Leveraged buyouts of Jurgensen’s, Fred Meyer, Food 4 Less, and Ralphs supermarket chains, and sold to Kroger for $13.5 billion;
- Signed Fleming as sole food supplier to Kmart;
- Majority stake in Pathmark grocery stores;
- Cyrk, the former Beanie Baby promotion agency;
- Merged Alliance Entertainment with Source Interlink;
- Invested $100 million in Sean Combs‘s (P. Diddy) Sean John clothing line;
- Purchased Enthusiast Media publications and assets of Primedia for $1.2 billion;
- Burkle’s investment firm, Yucaipa Cos., owns 18.7% of the common stock of Barnes & Noble.[16] In early 2010 he sought to raise his stake to 37% without triggering the shareholders’ rights plan;[17][18][19] Chairman Len Riggio, with 27.8% ownership of the bookseller’s common stock, is Barnes & Noble‘s largest shareholder;[20]
- Donated $750 million to the Renner Burkle Fund;
- Owns 6% stake in American Apparel, Inc.[21]
[edit] Payola scandal
In April 2006, Burkle accused New York Post columnist Jared Paul Stern of attempting to extort money from him in exchange for stopping the publication of stories in Page Six, the paper’s gossip column, about his private life.[22] Burkle secretly videotaped two private meetings between himself and Stern, with the second meeting orchestrated and monitored by the FBI. Stern allegedly asked Burkle for a $220,000 investment in his clothing business in exchange for better coverage. Stern was subsequently fired by the Post.[23]

Ron has received numerous honors and awards from labor including the AFL-CIO Murray Green Meany Kirkland Community Service Award [24] and The Los Angeles County Federation of Labor Man of the Year.[25]

David Cameron Carr Assails The Leslie Brodie Report; SBI: Carr Motivated by Own Self Interest

Even though—independent of one another other – we are in agreement as to the appearance of shenanigans and improprieties in matters relating to the State Bar/Girardi & Keese/Howard Rice (See http://tinyurl.com/kinglehr ), David Cameron Carr, the former president of the Association of Discipline Defense Counsel, recently assailed the Leslie Brodie Report. This is the second occasion on which Carr has lashed out at TLR.
Previously, in response to our story entitled “Bribing Pat” – which addressed the fact that records prove beyond any doubt misconduct by Judge McElroy by her failure to disclose an overseas trip she accepted from Golden Gate University School of Law’s Dean Peter Keane – Mr. Carr shockingly and unprofessional, referred to the allegations against McElroy as “Garbage.” (See http://tinyurl.com/articlepatmcelroy )
To understand the source of Carr’s unexplained hostility, TLR turned to our trusted adviser, State Bar Insider (“SBI”).
According to SBI, recent revelations made by Yoloan Rabbi (“YR”) concerning the role of State Bar Executive Director Judy Johnson made many members of the Association of Discipline Defense Counsel uncomfortable and fearful of being sued for malpractice by their clients, largely solo practitioners who were disciplined for misconduct committed against the same large law firms that were secretly also directing millions of dollars in cy pres funds to CCPF, headed by Judy Johnson.
As a reminder, Judy Johnson concurrently (and secretly) serves as State Bar Executive Director and chairperson of the sham entity known as “CCPF.”
CCPF has obtained close to $30 million, primarily from various cy pres awards from large law firms settling class actions; CCPF then primarily funnels these funds to minority organizations in Los Angeles (for example, there have been unexplained, repeated, and vexatious payments from CCPF to a specific YMCA in Long Beach , California).

According to SBI, the Association of Discipline Defense Counsel was established by Jerome Fishkin – an attorney with a history of bitter disputes with the State Bar of California, as well as connections to Willie Brown.
Fishkin, a former prosecutor at the State Bar, was very unpopular during his tenure there. In addition to being perceived as a troublemaker, he was also regarded as generally not being able to properly present cases, and instead believing that he could “wing” such matters, or “schmooze” his way around.
This attitude did not sit well with Starr Babcock and Robert Hawley who wanted, as soon as the opportunity presented itself, to fire Fishkin. Not so fast – Judy Johnson decided to take Fishkin under her wing due to Fishkin’s “Ghetto Pass” on the account of his daughter-in-law.

Fishkin thereafter organized an all-out employment strike at the State Bar, during which period tensions ran extremely high. Judy Johnson summoned Willie Brown to Fishkin’s aid. Hence, even to this day, a photo of Willie Brown hangs on the wall in Fishkin’s office.
Later, after Babcock and Hawley made it clear, in no uncertain terms, that Fishkin would not be promoted to any supervisory role, Fishkin left in disgrace and entered private practice as a solo practitioner.
Remaining loyal to Judy Johnson and Willie Brown, Fishkin kept the secret about Judy Johnson from his clients. Even while serving as President of the Association of Discipline Defense Counsel, Fishkin never bothered to inform the public that Judy Johnson is one and the same as CCPF – an entity receiving cy pres awards arranged by the same law firms which she was supposed to supervise and discipline.
According to SBI, the latest discovery by Yoloan also caused great embarrassment to Mr. Carr, the former president of the Association of Discipline Defense Counsel. Hence, his zeal to discredit TLR.
In addition, the dual role Judy Johnson played made it profitable for certain minority communities to see as many solo practitioners disbarred and disciplined as possible, which allowed the cash to keep flowing to them.
Conversely, it would not be in the best interest of these minority communities for the State Bar to discipline an attorney from a large firm, such as Munger Tolles & Olson for example. Such actions would cause friction and a probable reduction in the amount of money available to these communities and the recipients of these funds such as Eric Moore ‘s EducateCA, Little Tokyo Service Center, YMCA Long Beach, Philipinos for Affirmative Action, and many other questionable outfits.

Burton continue to be unraveled by TLR, speculations over the potential
past harassment of Remke by Burton continue to percolate within the
State Bar establishment.
In connection with the above, TLR continues with the investigation of
the “60 Days Suspension” scandal involving the pogrom in San
Francisco and a subsequent cover-up by the State Bar of California.
The investigation focuses on the former crack/cocaine addict Mike
Nisperos, Jeff Dal Cerro, former PJ Stovitz, as well as Judge JoAnn
Remke and the former cocaine addict John Burton.
John Burton, a former cocaine-addict and a sordid-sexual-harasser
boasted about engaging in “platonic sex with friends, lesbians and
straight, whatever”
Previously, Burton was accused by a staff member, KATHLEEN DRISCOLL, of
sexually harassing her.
Kathleen alleged that beginning in 2006 Burton begun to call for
immediate meeting during the weekend to go over routine matters, and
insisted that they go to the movies first.
Kathleen also alleged that during her employment Burton communicated the
following to her:
Telling KATHLEEN you are “probably wild sexually like all
Catholic girls”
Informing KATHLEEN on approximately three occasions that he often had
“platonic sex with friends, lesbians and straight,
whatever”
Making hand gestures mimicking masturbation on approximately 10
occasions;
“When you drop stuff off, stop in will ya? I mean I’m not getting laid under the fuckin’ table.”
Informing KATHLEEN on approximately 20 occasions throughout her
employment, “Oh, I had a dream about you last night,”
while raising his eyebrows in a sexually suggestive manner;
Making comments regarding KATHLEEN wearing a thong on
approximately 20 occasions during her employment;
Commenting on KATHLEEN ’S body, particularly her breasts and her
buttocks. On one occasion BURTON commented, “Your nipples aren’t showing
and its cold outside.”
Handing KATHLEEN an insurance form with a prescription for a male
performance enhancing drug similar to Viagra and saying, “This
stuff really works;”
On one occasion, as KATHLEEN walked past him, BURTON raised both his
hands and made a gesture as though he were squeezing KATHLEEN ’S
breasts;
Hitting KATHLEEN on the buttocks with a newspaper and saying, “You do
work out, you have a tight ass”
Telling KATHLEEN that her t-shirt turned him on because it was made
from silk and silk turned him on;
Judge JoAnn Remke, Presiding Judge of the State Bar Court who was
appointed to the position of State Bar Court judge by John Burton.
As was previously reported here, JoAnn Remke was appointed to the
position of State Bar Court judge by John Burton after he introduced
special legislation which granted him the power to do so, transferring
the appointing authority from the Supreme Court to himself and
eliminating the position of one non-lawyer judge.
At the time, Remke was working for the California legislature, and for
Burton himself. Additionally, John Burton was a political ally and
friend of the father of the attorney who committed the pogrom in San
Francisco. As also previously reported here, JoAnn Remke was the
State Bar Court judge who imposed, while committing grave misconduct,
the mere 60 day suspension on the attorney/son of John Burton’s friend.
Asked to comment on this matter, a State Bar Insider and a legal counsel
to TLR, speaking on condition of anonymity, stated “Obviously, we are
talking about a very sick and filthy man who knows no boundaries, a
sexual predator,” The Insider Stated. “I would not rule out the
possibility that in the past he also sexually harassed Judge Remke–
either verbally, physically or in the form of a quid pro-quo, or at
least he tried,” the Insider speculated.
“Burton’s M.O. very much reminds me of the M.O. of various Hollywood
executives or operatives in the Democratic Party, such as Bill Clinton.
They operate under the assumption that the females on the staff are
there to provide sexual favors–a quick blow-job here and a quickie
there–they see nothing wrong with it; in fact they expect it.
Especially from females who are recent arrivals from the Midwest, who
desperately try to make a name for themselves,” the insider stated.
“Seeing Willie Brown with his Russian girlfriend also makes one wonders
