Professor Katherine Darmer specializes in criminal procedure. Before joining the full-time faculty at Chapman in 2000, she served as an Assistant United States Attorney in the Southern District of New York, where she prosecuted public corruption, violent gang and narcotics cases. In 1998, she served as lead counsel in a three-month criminal RICO trial that resulted in the conviction of numerous Bronx-based gang members of crimes ranging from murder to narcotics distribution. During her tenure as an AUSA, she also argued seven cases in the Second Circuit Court of Appeals.

Professor Darmer received her A.B. from Princeton University, with high honors, and her Juris Doctor from Columbia University, where she was a Harlan Fiske Stone Scholar for two years and served as Articles Editor of the Columbia Journal of Environmental Law. She then clerked for the Honorable Kimba M. Wood in the Southern District of New York and the Honorable William H. Timbers on the Second Circuit Court of Appeals. Following her clerkships and before joining the U.S. Attorney’s Office, she worked for three years as a litigation associate at the Manhattan law firm Davis Polk & Wardwell. While at Davis Polk, she was a member of the trial team that successfully defended Delta Air Lines in a $2.5 billion lawsuit brought by the Pan Am Corporation and the Pan Am Creditor’s Committee.

In 2004, Professor Darmer was co-editor of the book Civil Liberties vs. National Security in a Post-9/11 World, which is the text used in her Advanced Criminal Procedure seminar. Her co-edited book, Morality and the Law, was published in 2007. Professor Darmer’s other scholarship has focused primarily on Fifth Amendment and national security issues as well as marriage equality, Proposition 8 and equal protection. She is a founding board member and Chair of the Legal Team of the Orange County Equality Coalition and a frequent speaker and media commentator on issues including Proposition 8 and marriage equality, the War on Terror, and federal prosecutions and the use of cooperating witnesses (including in the recent indictment of  baseball player Roger Clemens).

Documents will be filed on Wednesday that will show that a lack of security contributed to the attack on Bryan Stow, according to Stow’s attorney, Thomas Girardi of Girardi & Keese.

Stow was beaten nearly to death outside Dodger Stadium after the team’s opening day game on March 31. He and his family have filed a lawsuit in California for negligence, but that case was put on hold the by team’s bankruptcy filing in Delaware in June.

Gleick insists he did not alter any of the documents he got from the Chicago institute, but he could nevertheless be in legal jeopardy, according to Rory Little, professor of law at UC Hastings College of the Law and a former federal prosecutor.

“Most states have offenses for deceit if you can show there was intent to defraud,” Little said. “At the very least, it’s civil unlawfulness, and in many states it could be a criminal offense, depending on the elements of their common law.”

Heartland released a statement saying it is “consulting with legal counsel to determine our next steps.”

“Gleick’s crime was a serious one,” Bast said in a statement. “The documents he admits stealing contained personal information about Heartland staff members, donors and allies, the release of which has violated their privacy and endangered their personal safety.”

SAN BENITO — A resident has filed an ethics complaint’s criminal allegations against Mayor Joe Hernandez with the Cameron County District Attorney’s Office, according to the office of former City Attorney Jan Cassidy, his lawyer.
Alfonso Benavides filed his original complaint last month and followed San Benito city commissioners’ recommendation that he file the complaint’s criminal allegations with the district attorney’s office.

Law dean Erwin Chemerinsky of the University of California at Irvine calls the case “potentially momentous.” He counts four likely votes to overturn the U.S. Supreme Court decision in Grutter v. Bollinger, which upheld a law school admissions policy that used race as just one factor in the admissions decision. The outcome will probably depend on Justice Anthony M. Kennedy.

The case is Fisher v. University of Texas. Justice Elena Kagan has recused herself from the case, the New York Times reports.

The court’s membership has changed since 2003, most notably for these purposes with the appointment of Justice Samuel A. Alito Jr., who replaced Justice O’Connor in 2006. Justice Alito has voted with the court’s more conservative justices in decisions hostile to the use of racial classifications by the government.

“There thus seem five votes — Roberts, Scalia, Kennedy, Thomas and Alito — to overrule Grutter and hold that affirmative action programs are unconstitutional,” Erwin Chemerinsky, dean of the law school at the University of California, Irvine, wrote in a recent book, “The Conservative Assault on the Constitution.”

“When they were negotiating the settlement, it was just hypothetical, what these claims might be worth,” she said. “Nobody really knew. But now we really know. So there are a number of people that have objected.”

Others agreed with Peters that the class action lawsuit was not enough. Five states including California are considering objecting to the proposed class-action settlement, and today a San Diego County Superior Court judge gave them more time to make their decision.

Judge Timothy Taylor agreed to give the state attorneys general from California, Iowa, Massachusetts, Texas and Washington until Feb. 29 to object to the settlement. California Deputy Attorney General Albert Shelden said it is not clear if California will intervene.

“You can’t expect him to do whistle-stops in California and ignore the states that will make him president,” state Democratic Party Chairman John Burton said. “If everybody here went to sleep, he will carry California.”

Burton is almost certainly right. California is so heavily Democratic no Republican is likely to campaign seriously against Obama in the general election. But enthusiasm for Obama has waned in the Golden State since he was elected in 2008.

WABC-TV news anchor Liz Cho is embroiled in a nasty legal battle over renovation work recently done to her Westchester mansion.

Cathal Maguire, a Yonkers contractor, claimed in legal papers last month that the “Eyewitness News” anchor and her husband, Evan Gottlieb, racked up a $430,875 bill for upgrades made to their home between April and October — and then stiffed him for $100,875 of the work.

A mob of some 50 Palestinian Muslims stoned a group of Christian tourists atop Jerusalem’s Temple Mount on Sunday morning. Three of the Israeli police officers who acted to protect the Christian group were wounded by the stone-throwers.
