I don’t want my name linked to this information, at this point in time.

Geoffrey Brown and Michael Peevey were involved in a CPUC Fundraiser, asking for donations from the Utilities they regulate, at a cost of $20,000 per table. This was in January 2011, which was a few months after the PG&E fire in San Bruno.

Geoffrey Brown was one of the Officers of the Fundraiser I can’t find the link, but I recall that Geoffrey Brown was the number 2 officer of the Fundraiser, and Peevey was the number 1 Officer of the Fundraiser. It was because of this fundraiser, that I learned of Geoffrey Brown’s relationship to Peevey’s Chief of Staff.

Assemblyman Jerry Hill gave another verbal lashing to the CPUC today for an event held in the commission’s honor that solicited money from the utilities it regulates.

PG&E was among several utilities, along with other organizations, that bought $20,000 tables for a dinner in San Francisco that celebrated the California Public Utilities Commission’s 100th anniversary.

Hill, D-San Mateo, blasted the utility’s involvement in the fundraiser because, he said, the money raised by the foundation—which is a separate entity from the commission but has former regulators on its board—could be used to potentially influence the CPUC’s decisions with financial support coming from companies such as Pacific Gas & Electric Co.

“One hundred years of the California Public Utilities Commission is a tremendous accomplishment and they’ve done great work over the years,” Hill said as he stood in front of the steps of the CPUC’s headquarters. “But this dinner has been hijacked into a fundraising event for this foundation, and that’s the problem I have with it.”

Hill has become increasingly critical of the CPUC since numerous problems have been revealed about PG&E’s pipeline safety practices following the Sept. 9 gas explosion and fire, which left eight people dead and 38 homes destroyed.

The CPUC foundation was established to educate the public about the work the commission performs, and the money raised at today’s fundraiser would be used to award staff members, pay for training and put on public forums.

Hill said today’s event sends the message that the CPUC’s focus isn’t where it should be: investigating the cause of the explosion and properly auditing utility inspection records.

“If you’re going on a trip to a conference some place, staying in a hotel and going to the classes, and that is paid for directly by the utilities that you regulate,” Hill said, “how can you have an arm’s length relationship with that utility?”

Thomas MacBride, a lawyer who sits on the foundation’s board, disagreed with Hill’s take on the event and said the foundation was established with the intent of promoting the history of the CPUC, not influencing legislation. Most of the events the foundation is expecting to organize, he added, won’t even be related to issues over which the CPUC has jurisdiction.

In defense of PG&E’s involvement in the fundraiser, MacBride said PG&E was among more than 30 organizations that donated money to the event—all of which have been involved with the CPUC in some capacity, including consumer advocacy group The Utility Reform Network.

“It’s a big deal because it’s the agency’s founding,” he said.

San Bruno residents John and Joanne McGlothlin, whose Claremont Avenue home was damaged in the Crestmoor fire, were the only members of the public besides reporters who showed up at Hill’s press conference.

John McGlothlin said they showed up to support Hill’s comments toward the CPUC, adding that he has now lost faith in the commission since the explosion.

“My issue is that I’ve been hearing about how they regulate since the fire, and it has changed my perception,” McGlothlin said. “I think there was an attitude of ‘Go easy, don’t clamp down and don’t fine them,’ because (the utilities) won’t report things.”

Also on today, CPUC President Michael Peevey announced that he would make the commission’s investigation of the Crestmoor explosion more open to the public, according to media reports.

The National Transportation Safety Board is leading the main investigation into the pipeline explosion, which could take more than a year. Shortly after the disaster, the CPUC also decided to set up its own independent panel to look into the explosion, but the decision to make the investigation’s proceedings more available to the public only came after the commission began hearing complaints that the investigation was being conducting behind closed doors.

CSUS / inquire about the current employment status of Barbara O’Connor

Dear Madam/Sir:

This will serve to verify and inquire about the current employment status of Barbara O’Connor with respect to California State University, Sacramento.

Specifically, is she presently a professor with the university? My initial research leads me to believe that she is no longer affiliated with CSUS, even though she is listed elsewhere as a current professor (ie, CETF website. See: http://www.cetfund.org/aboutus/board/OConnor-Barbara ).

Life Perspectives

“I grew up in West Texas, raised by a single mother. I was a first-generation college graduate. So I’ve lived through lots of what our members are living through.

“Communications and politics have really been my longstanding interests, including technology access and equity, disabled rights, communication strategies and social movement building. I have a political background, and I started a public radio station in Sacramento and ran it for a while. We now have six radio stations there, the Capital Public Radio Network.

“I have taught mostly technology policy and technology evolution — the hardware stuff. I also teach political communications and the impact of messaging on social movement formation.

“I was fortunate enough to go to the Annenberg School at the University of Southern California, which is very geeky, so I was able to keep up with technology as it evolved. I chaired the California Public Broadcasting Commission, and I’m now an officer and director of the California Emerging Technology Fund.

“AARP provides me an opportunity to do tele-health, to deal with issues of getting the 50-plus generation online. I get to help people who are unemployed at 50, using the Web. So being part of the AARP board is really a wonderful synergy of my interests and the organization’s interests….”

“It’s getting more and more difficult to find a center in American politics. Part of it is the media’s fault. The news hole, in both broadcast and in print, has really been reduced. The downsizing and the mergers and acquisitions that have gone on in the media world have really done a disservice to public policy discussion. It’s made the media more event- and scandal-chasing — the lowest common denominator.

“In political campaigns, it’s 30-second spots. So it’s no surprise that the public has fatigue about dealing with politicians. Every poll in America shows that they are held in very low esteem.

“We can’t return to retail politics because we have the technology and everyone is used to using it. But longer formats, discussions, call-ins, coherent talk would be welcome. Certainly, AARP’s members would welcome that to address their concerns about big things such as Social Security.

“AARP is nonpartisan, and ours is a trusted voice. We have to provide the voice of reason in these debates, so that it’s not a partisan political discussion, but really a rational, practical discussion.

“People really do care about the issues that we work on. They’re central to their lives. We have to find a coherent solution to intractable problems.

“We need to be very heavily data-driven. I think we do that, by the way. I think staff and our board are the best. And our volunteers are terrific. So I’m optimistic, actually.

“A big part of our job as board members is to listen. You don’t let your own biases govern what you do. I have to listen to what the data says and to what members are telling me.

“So if you’re data-driven and you really do listen to the members tell you what their issues are — and we have very good organs of information that help us with that, by the way, in the organization — then you can find consensus.”

BACKGROUND AND EXISTING LAW
The California Coastal Sanctuary Act of 1994 generally prohibits
new leases for oil and gas development in all state waters that
are designated as a coastal sanctuary. The act defines those
waters as those subject to tidal influence but not including
parts of San Francisco Bay, and it also excludes state waters
subject to an existing oil or gas lease that is in effect on
January 1, 1995, unless that lease is deeded or otherwise
reverts to the state after that date.

Under the terms of the Act, new leases may be approved only upon
a presidential finding that the nation faces a severe energy
supply interruption, that the governor finds the energy
resources in the sanctuary will help alleviate the crisis, and
the Legislature acts to amend the Act.

The Act authorizes the State Lands Commission to enter into a
lease if it determines that oil and gas beneath state-owned
tidal and submerged lands is being drained by wells upon
adjacent federal lands and if it determines that such a lease is
in the best interests of the state. A second provision in the
Public Resources Code, Section 6872.5, authorizes the commission
to adjust the boundaries of existing leases to encompass all of
an oil or gas field that is partially contained within an
existing lease under specified conditions.

Existing law also contains specific provisions for oil and gas
drilling in the Santa Barbara Channel.

PROPOSED LAW

This bill would prohibit the commission from issuing a new lease
or lease extension from coastal tidelands or submerged lands in
state waters within the Santa Barbara Channel if such lease or
lease extension would be developed from an existing or new
offshore oil platform.

ARGUMENTS IN SUPPORT
According to the author, this bill would diminish the risk of
oil spills in coastal waters and forestall other environmental
effects from offshore oil development. The author contends the
bill is consistent with the current position of the state which
is to oppose new leases in federal waters off the California
coast.

The author acknowledges that this bill would affect one current
project. Venoco, Inc. has applied for an extension of lease
boundaries from the State Lands Commission. The author relates
that the project calls for up to 30 new and redrilled wells from
the existing Platform Holly. Venoco received a state lease in
1949. In 1993 it relinquished half the lease in Santa Barbara
County to take a lease in Orange County. According to the
author, the company is now interested in regaining the entirety
of its former Santa Barbara lease. The commission is expected to
release its EIR later this year. In its Notice of Preparation,
it stated that the proposed project has a reasonable possibility
of an oil spill during the lifetime of the project that could
have a significant effect on the environment and that other
aspects of the project also could have a significant effect on
the environment.

No formal positions on the bill were received by the City of
Goleta or the county of Santa Barbara. Background materials
provided by the author indicate that Goleta’s formal policy is
to oppose new leases in the western Santa Barbara Channel. The
county is uncertain if the project will meet its odor abatement
requirements.

ARGUMENTS IN OPPOSITION
None were received. However, the author’s background materials
indicate that Venoco considers its application to be authorized
as a vested right since it has had operations in this lease
since 1968. That issue would likely be resolved by the
commission unless this bill first becomes effective and preempts
the approval of the requested lease boundary extension.

COMMENTS

It should be noted that the Notice of Preparation cited by the
author represents the beginning of the CEQA process.

The Governor and the California Ocean Protection Council have
strongly opposed federal legislation that would have expanded
oil and gas drilling in the Outer Continental Shelf and lift the
25-year ban on off-shore oil drilling in California and other
coastal states, despite any revenue consequences to the state.

Kip Lipper, who is as renowned inside the Capitol as he is anonymous outside, is responsible for some of the nation’s most groundbreaking environmental laws over the last 30 years.

Reporting from Sacramento — If he were a basketball star instead of a statehouse staffer, he’d be Kobe Bryant or Magic Johnson — a veteran playmaker, feared by foes, his best moves unleashed just before the buzzer.

But like so many Sacramento insiders, Kip Lipper plays out of the limelight, in the back corridors of the Capitol, unknown to the public whose air and water and ecological ethos he has made his specialty over the last three decades.

As the environmental expert for the state Senate’s ruling Democrats, Lipper has helped craft many of California’s groundbreaking laws in that realm — and become a foil for Republicans irked by what they view as regulatory excess, and by the economic fallout.

His fingerprints are on the California Clean Air Act, the state Safe Drinking Water Act and the landmark 2006 curbs on greenhouse gas emissions. Legislation that boosted recycling, reduced landfill dumping, saved redwoods and cleaned up power plants are also part of his highlight reel.

Kip Lipper is Chief Policy Advisor, Energy, Natural Resources, and Environment, Office of the CA Senate Pro Tempore Darrell Steinberg. Mr. Lipper has worked in the California Legislature for over 34 years. He began his career in the mid-1970’s as Administrative Assistant for Assembly Member Dennis Mangers (D-Huntington Beach). From 1980-2004, he was Chief of Staff for Assembly Member and later Senator Byron Sher (D-Stanford). During that same time period, Lipper also served as Senior Consultant to the Assembly Criminal Law Committee, Chief Consultant to the Assembly Natural Resources Committee, and Staff Director to the Senate Committee on Environmental Quality. Mr. Lipper has drafted legislation on a broad array of environmental policies, including the California Clean Air Act, the California Safe Drinking Water Act, the California Beverage Container Recycling Act, and the California Integrated Waste Management Act. He has drafted and analyzed legislation on energy regulation, renewable energy, energy conservation, public interest energy research, energy agency reorganization and reform, and numerous other subjects. He also has worked on state budget issues affecting energy, environmental, and resources agencies of California state government. Lipper was the lead Senate staffer on the drafting of AB 32, the Global Warming Solutions Act of 2006, as well as on companion legislation establishing the nation’s first greenhouse gas emission performance standard for energy generation (SB 1368–Perata). He has been deeply involved in the implementation of GHG laws passed and enacted by the CA Legislature. Mr. Lipper has published papers on a range of environmental issues. Clinton and in 2001 and 2005 for President George W. Bush.” (emphasis added)

As was mentioned earlier, LINK AMERICAS and Directors Dave Leveille, Elva Lima Of Verizon Communication, Richard Methia, Cheryl  Meils, David Saedi, AARP’s Barbara O’Connor of Lucas Public Affairs, Dan Throgmorton, and Brenda Kempster represented to the IRS that an expense of  $167,145.00 was utilized for “The 2009 Link Technology Serving Humanity Global Literacy Gala was held in Washington, DC to promote the advancement of Information and communication technology literacy in the areas of Life, Information, Nature, and Knowledge (Link) throughout The Americas.” (emphasis added)

In actuality, however, the sole reason behind the aforementioned “gala” was “celebrating the Inauguration of The Honorable Barack Obama Forty-fourth President of the United States of America and  The Honorable Joseph R. Biden, Jr. Vice President of the United States of America and the 111th Congress of the United States.”

TIMELINE May 2012:Feds Sign $20M PR Contract to Promote Obamacare(TLR Note:Highly relevant to events exposed on TLR in re AARP,Bill Novelli,operative Donna Lucas, fraudster CETF’s Barbara O’Connor of AARP/Lucas)

The federal government has signed a contract with a public relations firm to spend $20 million to promote Obamacare, a law that made be defunct in a month.
The advertising campaign will educate the public on staying healthy and preventing illness, a Health and Human Services official told The Hill.
The controversial Affordable Care Act includes provisions for the advertising blitz in the law. The contract was won by the public relations firm Porter Novelli in a competitive bidding process, according to the Hill.
The Supreme Court is expected to rule on the constitutionality of the law before its recess in June.

The Department of Health and Human Services has inked a $20 million contract with a top public-relations firm to sell aspects of the Obamacare law to the American public.

According to a report in PR Week, HHS’s Center for Medicare and Medicaid Services has awarded the contract to PR firm Porter Novelli. The firm has offices worldwide, and boasts PepsiCo, Hewlett Packard, and the Centers for Disease Control and Prevention as existing clients.

According to The Hill, the Porter Novelli campaign is “designed to educate the public about how to stay healthy and prevent illnesses.” It will do so by highlighting provisions of Obamacare.

The PR push is part of a sustained effort to try to sell the unpopular Obamacare law to the American public. Last year, HHS asked Congress to quadruple the budget for its public affairs office – to nearly $20 million – and nearly double the size of the office’s staff. The department insisted the changes were necessary to “help Americans understand and access their benefits and information under the law.”

A Freedom of Information Act request filed by the group Judicial Watch last year revealed the lengths to which HHS has gone to attempt to sell Obamacare to a skeptical public:

  • The Obama HHS launched a campaign to track Internet searches and to use online search engines such as Google and Yahoo to drive traffic to a government website promoting Obama’s health care overhaul. Using “pay-per-click” advertising tools, such as Google Adwords, HHS purposely targeted people searching the term “Obamacare,” a word that has been described as “disparaging” by political agents of the president.
  • According to a budget summary prepared by Ogilvy, from October 2010 through February 2011, the Obama administration spent $1,435,009 on these online advertisements alone, including advertising campaigns with Google and Yahoo, almost $300,000 per month.
  • A number of documents address the need to target the Obamacare propaganda campaign to Hispanics, blacks, and women. For example, according to an email from Chris Beakey, vice president of Ogilvy PR Worldwide, to HHS officials on Dec. 16, 2010, summarizing a conference call, “You want to utilize the bulk of their paid media efforts (which would include expenditures for Radio One and Univision) on media that reaches African Americans and Hispanics. The money will go farther and these audiences continue to be a top priority.”

The Leslie Brodie Report has learned San Francisco-based controversial entity California Emerging Technology Fund (“CETF”) has recently awarded tens of thousands of dollars to Los Angeles-based controversial entity Little Tokyo Service Center (“LTSC”).

CETF has been established as a non-profit corporation pursuant to orders from the California Public Utilities Commission (CPUC) in approving the mergers of SBC-AT&T and Verizon-MCI in 2005.  As a condition of approval of the mergers, AT&T and Verizon are required to contribute to CETF a total of $60 million over 5 years for the purpose of achieving ubiquitous access to broadband and advanced services in California, particularly in underserved communities, through the use of emerging technologies by 2010. AT&T will contribute $9 million per year and Verizon will contribute $3 million per year. The CPUC also directed that at least $5 million should be used for telemedicine projects, according to its website www.cetfund.org

On November 15, 2012 Amid conflicting reports and unanswered questions, a journalistic inquiry was launched by TLR into events surrounding San Diego-based Scripps Institution of Oceanography (“SIO”), and directors Tony Haymet, Donna Lucas, and Marty Africa.

According to the East Bay Express, “On September 3, legendary Bay Area DJ Matthew Africa was tragically killed in a car accident while returning from Yosemite with his wife. The death sent shockwaves through the Bay Area DJ community, where Africa had been a mainstay for decades, and reverberated through the blogosphere. Local and national outlets covered his passing. Clearly, Africa was a man who touched a lot of people on a lot of different levels.”

Accoding to Patterson Irrigator “Africa was heading northbound in his 2001 Volkswagen Beetle on Highway 33 just north of West Stanislaus Road at about 2:45 p.m. Sunday when he veered off the road for unknown reasons, according to a CHP report. His Beetle hit shoulder gravel, steered back onto the highway and spun in a clockwise direction and into the southbound lane before striking a 2000 Peterbilt driven by Hector Alvarez, 23, of Newman, according to the CHP. Africa was pronounced dead at the scene from injuries while his passenger, Ha Le Cow, 38, of Berkeley was taken by air ambulance to Doctors Medical Center for treatment of what was described as major injuries.”

Obamacare cuts $716 billion from Medicare in order to pay for its $1.9 trillion expansion of coverage to low-income Americans. It’s one of the reasons why seniors are more opposed to the new health law than any other age group. So why is it that the group that purports to speak for seniors, the American Association of Retired Persons, so strongly supports a law that most seniors oppose? According to an explosive new report from Sen. Jim DeMint (R., S.C.), it’s because those very same Medicare cuts will give the AARP a windfall of $1 billion in insurance profits, and preserve another $1.8 billion that AARP already generates from its business interests.

Here’s how it works. AARP isn’t your every-day citizens’ advocacy group. The AARP is also one of the largest private health insurers in America. In 2011, the AARP generated $458 million in royalty fees from so-called “Medigap” plans, nearly twice the $266 million the lobby receives in membership dues.

Medigap plans are private insurance plans that seniors buy to cover the things that traditional, government-run Medicare doesn’t, like catastrophic coverage. Medigap plans also help seniors eliminate the co-pays and deductibles that are designed to restrain wasteful Medicare spending.

AARP blocked Medigap reforms, saving the group $1.8 billion

Adding catastrophic coverage to Medicare, while restraining the ability of Medigap plans to waste money, is a key to Medicare reform, one that has been a big part of bipartisan plans in the past. According to the Kaiser Family Foundation, the Medigap reforms that AARP blocked would have saved the average senior as much as $415 in premiums per year.

But the AARP aggressively, and successfully, lobbied to keep Medigap reforms out of Obamacare, because AARP receives a 4.95 percent royalty on every dollar that seniors spend on its Medigap plans. Reform, DeMint estimates, would have cost AARP $1.8 billion over ten years.

Cuts to Medicare Advantage could earn AARP over $1 billion

Not only did AARP succeed in getting Democrats to balk at Medigap reform. Obamacare’s cuts to Medicare Advantage will drive many seniors out of that program, and into traditional government-run Medicare, which will increase the number of people who need Medigap insurance.

That means more royalty profits for the AARP. Reps. Wally Herger (R., Calif.) and Dave Reichert (R., Wash.) estimated that the change “could result in a windfall for AARP that exceeds over $1 billion during the next ten years.”

AARP Medigap plans exempted from Obamacare’s insurance mandates

It gets worse. AARP Medigap plans are exempted from most of Obamacare’s best-known insurance mandates. AARP Medigap plans are exempted from the ban that requires insurers to take all comers, regardless of pre-existing conditions. The plans are exempted from the $500,000 cap on insurance industry executive compensation; top AARP executives currently make more than $1 million. AARP plans are exempt from the premium tax levied on other private insurers. IPAB, Medicare’s rationing board, is explicitly barred from altering Medicare’s cost-sharing provisions, provisions that govern the existence of Medigap plans.

Misleading Profile of University of California Regent Bonnie Reiss of Pegasus Capital (TLR Note: Arnold – Lucas- Haymet – UC Connection)

Bonnie Reiss is the Chief Executive Officer of BMR Consulting, specializing in strategic advice in the areas of education, the environment and issues impacting women. She served as the California Secretary of Education from 2006-07. She was a member of the California State Board of Education from 2003-06.

She served as senior advisor to Governor Arnold Schwarzenegger from 2003 to 2007, where she advised the Governor on all major policy initiatives, including education, the environment and children’s issues. From 1994 to 2003, Secretary Reiss served as founding president of the Inner-City Games Foundation, later renamed After School All-Stars. In 1988, she founded the Earth Communications Office where she led the effort to use media for public awareness campaigns of environmental issues until 1993. Her experience includes careers as an entertainment lawyer, accountant, producer and writer from 1981 to 1988.

Ms. Reiss serves on the board of directors for After School All-Stars and Maria Shriver’s Women’s Nation FOundaton. In 2007, Ms. Reiss received the William S. White Lifetime Achievement Award from the U.S. Department of Education for her advocacy in the area of public education and, in 2006; she received the Advocate of the Year Award from the University of California Student Association. 

Ms. Reiss was appointed as a Regent in March 2008 by Governor Schwarzenegger to a term ending in 2020.

In TLR previously published comment stating that University of California’s Regent Richard Blum and wife — Senator Dianne Feinstein —  are under scrutiny in connection with:UCI Foundation’s Joe Dunn and Erwin Chemerinsky (both of Voice of OC — initially housed at home of Kinde Durkee; entity which the IRS apparently exempted from full compliance of its rules and regulations );UC Berkeley Foundation’s Gibor Basri and Freada Klein Kapor  (both of sham entity CaliforniaALL -used to launder money from utility companies to OBAMA FOR AMERICA, allegedly); Carry Zellerbach of CaliforniaALL; University of California Scripps’ operative Donna Lucas and Martha Fay Africa  (alleged paramour of Morrison & Foerster’s James Brosnahan — mastermind behind and legal counsel of CaliforniaALL),  we were remiss in not mentioning husband and wife —  Howard Dickstein and Jeannine English.

Both Dickstein and English are named defendants in two separate RICO suits advanced by The Spire Law Group and Dan Dydzak.

The allegations contained in the Spire complaint allude to money laundering by Howard Dickstein and Jeremy Ben Ami of J Street PAC — an anti-Israel entity recently embraced by Dianne Feinstein, subsequent to  financial  contributions from J Street PAC to Feinstein’s political campaign.

On January 20, 1980, in San Francisco, California, finance capitalist Richard C. Blum (born in 1936) and the ambitious Democratic Party politician Dianne Feinstein (born 1933) were married in a wedding ceremony at San Francisco City Hall. This marriage created a family economic and political alliance that in a little over a decade would allow them to become the top power couple in the state of California with a place on the national and world stages. They remain at the pinnacle of power today, he as a billionaire financier, speculator, real estate executive and deal maker; she as the senior Senator (California’s highest federal official), from the largest and most powerful state in the United States. They exemplify power as it is now wielded in the higher circles of the class system of the U.S. today, and illustrate well the dismal results of this system. This system is best characterized as a plutocratic kleptocracy, completely lacking in authentic democracy, operated by and for corporate racketeers, in short, a dictatorship of big capital, the top 1% of wealth holders, which makes up a ruling class.

Blum is finance capital personified, and Feinstein precisely illustrates the corrupt, war-mongering, pro-corporate politicians who inhabit the upper reaches of the U.S. ruling class. To fully comprehend their rise to power, vast wealth and socio-political stance, one needs to understand the key developmental trends in the U.S. and world political economy during Blum-Feinstein’s rise during the last few decades. Also necessary is a comprehension of how Blum-Feinstein have both adapted to and helped quicken these developmental trends.

The Financialization of Capital Accumulation

The financial capitalist now plays the leading role in capitalist development, this type of capitalist has taken over from the formerly dominant industrial capitalist. This process also has financialized class and class relations; these are more and more characterized by extreme differences in wealth and income from the top to the bottom of the class system. The top 1% of U.S. wealth holders, Blum and Feinstein among them, currently hold about 35% of the total wealth of the nation (43% of the financial wealth), and the top 20% have 85% of the total wealth. Conversely, the bottom 80% of the population owns only 15% of the wealth, the bottom 40% of the population owns only 0.3% of the nation’s wealth (basically nothing), and about one in six Americans (almost 50 million people) live in poverty, with no wealth and lacking even a minimal income.

In the case of Blum-Feinstein, we can see what being in the top 1% means. They currently own a private jet, a Gulfstream G650, worth $55 million in 2008. Blum-Feinstein also own an entire 161 room San Francisco hotel (The Carlton) and at least six other homes. At a low estimate, including their hotel, their personal real estate holdings, together with their private jet, are likely worth well over $100 million today.

Blum’s empire begins with his ownership of Blum Capital Partners, a firm he founded in 1975. In its 2005 edition, one standard industry source, Pratt’s Guide to Private Equity Sources, lists Blum Capital Partners as a firm “investing own capital” and having $1.589 billion under management. Two other, more recent sources, list the assets of Blum Capital at the higher levels of $2.8 billion and $4.5 billion. Blum’s firm’s clients reportedly include some of America’s wealthiest people and largest corporations, like oil heir Gordon Getty and Bank of American. Blum Capital Partners also has a joint venture with a much larger firm, The Texas Pacific Group (TPG) and Blum Capital Newbridge Capital to conduct this joint venture. Blum has been a Co-Chairman of both Newbridge and TPG.

Corporate Neoliberalism

Neoliberalism is a version of extreme free market thinking, putting forth the pure logic of capital. Neoliberalism’s critique and actions aim not only at ending the regulatory and welfare states, it wants to shrink government’s role in economic and political life down to the point where the wealthy corporate ruling class will totally control economy, society, and political life with no interference.

Long theorized by right wing thinkers, neoliberalism came into vogue during the 1980s as a way to open up more economic living space for capital, “opening new markets.” As these areas are opened up, one result is an increase in the commodification of various aspects of life. Neoliberalism also opposes the former Keynesian consensus that fostered aspects of the welfare state, that is, offering some government benefits to the working class to pump up effective economic demand. According to neoliberal ideology, government should be weak and market/commodity relations dominant, so the Keynesian approach should be scrapped.

Neoliberalism as an ideology is completely hypocritical however, because virtually all of the government welfare, sweetheart contracts, tax cuts, subsidies and bailouts given to major corporations continue under neoliberal governance, only the Keynesian type benefits to workers are really cut. In actual practice, therefore, it is a philosophy meant to make workers and their unions pay for the crisis tendencies of capitalism, making the capitalist crisis actually a working class crisis. Under corporate neoliberal thinking over the past thirty years, all aspects of the New Deal reforms of the 1930s have been under increasing attack.

Another aspect of neoliberal ideology is the ongoing attacks on unions, since union organizing and action to protect workers distorts the operations of the “free” market. Corporations are free to export jobs and income to low wage nations, but workers are often unjustly prevented from organizing unions both at home and in repressive nations abroad.

Blum and Feinstein’s policies and actions promote neoliberalism. Blum’s field of operation is worldwide, exporting jobs overseas to capture surplus value in areas of the world that are expanding rapidly at a time when there is stagnation in mature capitalist economies. Blum’s foreign investments have focused on Asia, including China, Australia, and Korea, often through the TPG and Newbridge Capital.

Feinstein and Blum are also major investors in two private educational corporations, the Career Educational Corporation, and ITT Educational Services. At the same time, Blum donated heavily to the political campaigns of California Governor Gray Davis, amounting to at least $75,000 in a two-year period beginning about 2000. As a result, Davis, following his “pay to play” politics, appointed Blum to be a member of the University of California Board of Regents. Within a few years, Blum became the Chairman of this Board while it raised tuition for the University’s students again and again, increases that amounted to 32% in only one year. Students have had to take out massive loans to attend school. One source indicates that the amount of debt loaded on all U.S. students has jumped from $90 billion in 1999 to $550 billion in 2011. As students were priced out of an increasingly expensive public university system, the inferior, privately operated correspondence type diploma mills where Blum had major investments became increasingly attractive. Not to be left out of the drive to weaken public education and teachers unions in order to open space for private capital accumulation, Feinstein had become a supporter of school vouchers by 2003, undermining public schools by allowing parents to use public money to pay for tuition at private or parochial schools in Washington, D.C. (San Francisco Chronicle July 23, 2003:A3).

A final aspect is cutting taxes on the wealthy, and, of course, Feinstein consistently favors such cuts. One example is Feinstein’s support for a phase-out of inheritance taxes on large estates. In July of 2000, she was one of a small group of Democratic Senators defending and voting for a Republican sponsored bill to repeal an estate tax law first passed in 1916, a law that applied to only the top 2% of taxable estates.

Imperialism, Militarism and War

The imperialist policies to be followed by the U.S. and NATO are discussed and developed by think tanks and policy forming organizations the leading U.S. private, (closely connected to official circles), such as the Council on Foreign Relations (CFR), and the Brookings Institute. A similar organization, only international in membership is the Trilateral Commission, which draws its members from many countries in Europe, North America and Asia. Blum-Feinstein are closely connected with all three of these private foreign planning organizations and their imperialist policies. Both Blum and Feinstein have been members of the CFR for a number of years (membership is by invitation only). Blum has been a trustee of and part of the power structure of the Brookings Institute for years (Brookings regularly hosts the “Brookings-Blum Roundtable” discussion series) and Feinstein currently serves on the North American branch of the Trilateral Commission, after having first become involved with this organization in 1988. One result of these close connections is the fact that Feinstein is an enthusiastic war hawk and strongly supports all the current wars and occupations of U.S. imperialism, from Iraq and Afghanistan to Libya.

Feinstein also chairs the Senate Intelligence Committee. She approved of the appointment of General David Petraeus to head the CIA, saying that she had “enormous respect” for him, and that the U.S. should “…put all of our eggs in the Petraeus basket…” This illustrates that Feinstein has embraced the dangerous and illegal new method of warfare now being waged by the CIA under Petraeus. This new way of war is to send robotic machines (drones) over borders to kill thousands of people, even American citizens who are viewed as enemies.

Managed “Democracy”: A Corporate Dominated Political System

In recent decades the level of corporate domination of American politics has clearly increased. The pathways to intensified corporate control have been through the candidate selection process, campaign finance, massive lobbying, favorable media coverage to corporate ruling class linked candidates, expert advisers from ruling class think tanks and vote rigging through exclusion of people and through computers. Corporations claiming to be human beings can now purchase unlimited “free speech”, while real citizens are often denied such rights by their relative poverty, lack of access to media, or by police repression. Collectively, this has resulted in making the U.S. political system mostly a managed “democracy.”

Blum and Feinstein are key players in what can best be called the San Francisco Democratic Party political machine. Feinstein conducted Jerry Brown’s wedding (to a former Vice President of the Gap) where the entire Bay Area political machine was present, and hosted a wedding shower for Gavin Newsom at her Pacific Heights mansion, illustrating her close personal, economic and political ties to key members of this group. The group obviously also has important national level connections as well, former Vice President Al Gore is a long time friend and business partner of Blum.

While pretending to represent the interests of the rank and file, once in office, Feinstein and other corporate ruling class supported politicians payoff their partners with policies favorable to their interests, including government contracts. Again Blum and Feinstein are prime examples of how this corrupt system really works. Senator Feinstein, who was already in October of 1994 called “… the most prolific fund-raiser among all federal candidates” by the Los Angeles Times (October 28, 1994: A1), has received large campaign donations (in the thousands from each one) from a truly amazing list of top California and national level corporations.

The daughter of a wealthy doctor, educated at elite private schools, including Stanford University, Feinstein spent her way to political power, breaking records for campaign fundraising and spending beginning with her early campaigns for the San Francisco Board of Supervisors. Serving the wealthy, first and foremost herself and her husband, has marked her career. As the Los Angeles Times (October 28, 1994: A24) expressed it after observing only her actions for only a short time in office:

“A review of the senator’s first two years in office found that Feinstein supported several positions that benefited Blum, his wealthy clients and their investments. She was a vocal proponent of increased trade with China while Blum’s firm was planning a major investment there. She also voted for appropriations bills that provided more than $100 million a year in federal funds to three companies in which her husband is a substantial investor.”

In 2007 investigative reporter Peter Byrne published a series of reports that showed that her actions in the early 1990s was only the beginning of Feinstein’s aiding her husband’s firms. As chairperson of the Senate’s Military Construction Appropriations subcommittee from 2001-2007, Feinstein supervised and supported the appropriation of over $1.5 billion for two military contractors, URS Corporation and Perini Corporation, both companies that Blum had a controlling interest in. Blum later sold URS for a reported personal profit of $57 million. When Feinstein’s actions were exposed in early 2007, she abruptly quit her post on this subcommittee.

Blum returns the favor, raising more money for his politician wife than any other individual. He arranges contributions and loans to her campaigns in the millions. At least sometimes this got the power couple into trouble, even with the weak campaign finance laws that exist. In Feinstein’s failed 1990 Governor campaign for example, the Feinstein campaign failed to disclose a series of bank loans arranged by Blum that amounted to at least $2.9 million. Her campaign was fined a total of $190,000 by California’s state watchdog agency, the largest such cash settlement in state history, for an “outrageous case of gross negligence” (Los Angeles Times December 22, 1992: A1, A29).

A more recent example of gross negligence and incompetence in the area of campaign finance on the part of Feinstein and her staff was exposed when the FBI arrested her campaign treasurer, Kinde Durkee for stealing funds from a number of campaign accounts that she managed, including Feinstein’s (S.F. Chronicle September 14, 2011:A9).

As is the case on every other key question involving our collective future, Feinstein has been and is against the people’s interest in having a just and free society. In a 2011 editorial, the San Francisco Chronicle (May 26, 2011:A15) called her “one of the biggest cheerleaders for renewing…” Bush’s Patriot Act, which allows roving wiretaps, snooping into personal records and permits the unwarranted surveillance of people without having to show probable cause. The Chronicle said that Feinstein and other supporters of renewal were going “too far” and were “erasing bedrock guarantees” of the Constitution. This action is part of a pattern of spying favored by Feinstein. In 2007 she voted for immunity for telecommunications companies who illegally spied on their customers. Some of these, such as ATT, were also heavy donors to her political campaigns. As Chairperson of the Senate Intelligence Committee she also recently criticized the CIA for not spying enough on the Egyptian people, stating that “the CIA should have monitored Facebook more closely.”

The Ecological Crisis

The ongoing and accelerating global ecological crisis is deeply rooted in the anti-ecological imperatives of capitalist production and exchange for profit and accumulation. Corporate capitalism is a system requiring constant “expand or die” growth, a system whose main measure of success is how much capital is accumulated. This results not only in human alienation, it also results in the alienation from and destruction of entire natural ecosystems, such as forests, rivers, and grasslands.

Blum and Feinstein routinely undercut ecological needs in favor of the accumulation of wealth and power. One example is Feinstein’s relationship to wealthy corporate farmer Stewart Resnick, the owner of over one hundred thousand acres of prime farmland in the San Joaquin Valley. He has written big check after big check to her political campaigns, as well as hosted her at least two of his mansions. Over the past few decades he has also given several million dollars to the Democratic and Republican Parties and their candidates. Then, when Resnick called Feinstein in 2009 to weigh in on the side of corporate agribusiness in a drought fueled ecological dispute over water to big landowners or water for the Sacramento-San Joaquin River Delta’s ecological needs, Feinstein jumped in, pushing the agribusiness viewpoint onto two Cabinet level secretaries and calling for a sweeping review of the science to allow more water to go to Resnick and other big operators. Due largely to excessive water diversions, the Delta’s ecology is in serious trouble, with fish populations in catastrophic decline.

Blum and Feinstein also favor and work for “wilderness,” she in the Senate sponsoring legislation to set aside public lands as preserves, and he as a member of the Governing Council of the Wilderness Society. The nature and politics of Blum’s Wilderness Society can be seen by looking at its Governing Council and one of its “corporate partners.” The Governing Council is filled with the super rich like Blum and includes a member of the Getty oil family, a member of the Roosevelt family, a Rockefeller family in-law, a Texas Pacific Group private equity billionaire, an adviser to Clinton-Gore White House and a past chairman of Recreational Equipment Company, which sells products for outdoor activities. Its leading corporate partner is Bank of America, which, for years financed mountain top removal to mine coal by Massey Energy and International Coal Group. Under the pressure of direct action against it, the Bank of America cut back on but did not end such financing. The Blum-Feinstein-Wilderness Society approach of creating a few islands of non-development in a sea of life destroying capitalist ecocide is clearly inadequate as a strategy of ecological and human survival.

Conclusion: Blum-Feinstein and the Corporate State

The five interrelated waves of our age, and Blum-Feinstein’s role, illustrate that the Democratic Party and its leaders are every bit against the people’s interest as the Republican Party. Both favor the corporate state and capitalist austerity, imperialism, war and capitalist ecocide. Blum-Feinstein stand solidly for the financialization of accumulation and the private use of this wealth to benefit a small group of wealthy owners (the 1%); they stand for neoliberal ideology; for imperialism, militarism and war; for undemocratic corporate political rule; and for weak and inadequate measures to confront the ecological crisis.

2) Circumstances surrounding Barbara O’Connor and Sunne McPeak in connection with non-profit entity known as California Emerging Technology Fund (“CETF”)

In connection with Sub-Part #3, special attention is being paid to the examination of an expense totaling  $167,145.00 in year 2009.

Specifically, LINK AMERICAS and Directors Dave Leveille, Elva Lima Of Verizon Communication, Richard Methia, Cheryl  Meils, David Saedi, Barbara O’Connor, Dan Throgmorton, and Brenda Kempster represented to the IRS that an expense of  $167,145.00 was utilized for “Venue Fee and Gala Expense” and that  “The 2009 Link Technology Serving Humanity Global Literacy Gala was held in Washington, DC to promote the advancement of Information and communication technology literacy in the areas of Life, Information, Nature, and Knowledge (Link) throughout The Americas.”

LINK AMERICAS and Directors Dave Leveille, Elva Lima Of Verizon Communication, Richard Methia, Cheryl  Meils, David Saedi, Barbara O’Connor, Dan Throgmorton, and Brenda Kempster also represented to the IRS that an expense of  $2350 was utilized “in conjunction with groups of volunteers from Costa Rica, Europe, and the US- to help build schools, develop literacy programs, and provide reading glasses to children and adults in communities in Central America.”

In a conference call with fund-raisers and donors to his campaign, Mr. Romney said Wednesday afternoon that the president had followed the “old playbook” of using targeted initiatives to woo specific interest groups — “especially the African-American community, the Hispanic community and young people.”

“In each case, they were very generous in what they gave to those groups,” Mr. Romney said, contrasting Mr. Obama’s strategy to his own of “talking about big issues for the whole country: military strategy, foreign policy, a strong economy, creating jobs and so forth.”

Mr. Romney’s comments in the 20-minute conference call came after his running mate, Representative Paul D. Ryan of Wisconsin, told WISC-TV in Madison on Monday that their loss was a result of Mr. Obama’s strength in “urban areas,” an analysis that did not account for Mr. Obama’s victories in more rural states like Iowa and New Hampshire or the decrease in the number of votes for the president relative to 2008 in critical urban counties in Ohio.

“With regards to the young people, for instance, a forgiveness of college loan interest was a big gift,” Mr. Romney said. “Free contraceptives were very big with young, college-aged women. And then, finally, Obamacare also made a difference for them, because as you know, anybody now 26 years of age and younger was now going to be part of their parents’ plan, and that was a big gift to young people. They turned out in large numbers, a larger share in this election even than in 2008.”
 
The president’s health care plan, he said, was also a useful tool in mobilizing black and Hispanic voters. Though Mr. Romney won the white vote with 59 percent, according to exit polls, minorities coalesced around the president in overwhelming numbers: 93 percent of blacks and 71 percent of Hispanics.

“You can imagine for somebody making $25,000 or $30,000 or $35,000 a year, being told you’re now going to get free health care, particularly if you don’t have it, getting free health care worth, what, $10,000 per family, in perpetuity — I mean, this is huge,” Mr. Romney said. “Likewise with Hispanic voters, free health care was a big plus. Robert Ross President and CEO, The California Endowment: Now We Can Finally Fix Health Care!

After the win by President Obama last Tuesday, I saw the health reform law — also known as Obamacare — in the same way that I viewed justice warriors like Nelson Mandela, Martin Luther King Jr., and Cesar Chavez after they were jailed for their beliefs. Obamacare is now a freed political prisoner.

Now that the presidential campaign is over, let us remind ourselves of the benefits of Obamacare:

  • More than 30 million Americans without health insurance will be able to secure health coverage — some through the expanded Medicaid program (Medi-Cal) and for others the state exchanges will provide access to affordable plans;
  • No longer will people with pre-existing health conditions-like diabetes, high blood pressure or cancer, be refused or dropped by health insurance companies;
  • Many preventive health services, like mammograms and some cancer screenings, are now included in health insurance plans without a co-payment;
  • Communities are receiving funds to institute wellness practices and programs;
  • States have the ability to innovate to reduce the costs of health care; and,
  • States have the ability to create new health care jobs that focus on primary care and prevention.

Political experts observed that Latino voters played a powerful role in the elections, and the issues of immigration and immigration reform are obviously important. But having served and interacted with Latino communities as a physician and public health official over the years, I also know how critically important the issue of affordable health care is to Latino families. My professional experience has taught me, and polls and surveys have confirmed, that Latinos are more likely than other demographic group to strongly view health care as a right, rather than a privilege.

TIMELINE 2009: Yolo County’s Cache Creek Casino bets on expansion as revenue drops (TLR Note: Notice name of Bill Schreiber — one and same Bill Schreiber of Porter Novelli?)

The glitz, the stuffed buffet tables and even the thrilling clang of jackpots can’t disguise one thing: Local casinos are taking a hit.

Because of the recession and a general malaise in consumer confidence, gambling revenue at local tribal casinos is down, said Jason Dickerson, gambling policy analyst for the state.

“After a decade or more of strong growth in the industry, customers have pulled back on gambling,” said Dickerson, who works for the state Legislative Analyst’s Office. Dickerson said the local cutbacks are following a trend of “sharp retrenchment” statewide, nationally and even globally. “We’re finding that gambling is ultimately an entertainment product, and there’s been a broad pullback in consumer discretionary spending.”

The four tribal casinos in the Sacramento region — Jackson Rancheria Casino & Hotel, Cache Creek Casino Resort, Thunder Valley Casino and the recently opened Red Hawk Casino — won’t say if revenue has fallen, but said no layoffs are scheduled. But some casino officials admit at least a flattening in demand.

Financial records at tribal casinos are confidential, but Dickerson doesn’t doubt the slowdown in Indian gaming revenue. Even the governor’s budget reflects smaller contributions from tribes with casinos. With demand and revenue shrinking, tribal casinos are likewise halting or scaling back lavish expansion plans and beefing up marketing efforts to ride out the tough times.

In Southern California, employees are being laid off because of reduced revenue and traffic. He hopes it proves that Californians shouldn’t rely on tribal payments to state coffers.

“Some have thought that tribal payments would be a panacea, a great source of growth for many years, and we’re seeing that that’s flawed, that casinos are susceptible to economic conditions and are not going to grow infinitely,” he said. “Casinos will never solve our budget problems, it’s a miniscule component of our budget.”

Expansion on hold

One of the most visible examples of the downturn in gambling is at Thunder Valley in Lincoln, where construction on a planned ambitious expansion stopped in November. Thunder Valley spokesman Doug Elmets said the tribe, the United Auburn Indian Community, originally planned to add a 23-story hotel, nine-story parking garage, performance venue, childcare room and video game arcade.

“They put the expansion on hold three to six months to reassess the scope, given the uncertain market demands,” Elmets said. “They’re looking at whether they need as many square feet, number of suites and parking spaces as was originally planned.”

Elmets said the reassessment of the expansion is not a result of competition from the newly opened Red Hawk Casino on Highway 50 in Shingle Springs. In fact, he said, the hoopla surrounding Red Hawk’s Dec. 17 grand opening and advertising for the new casino has strengthened the regional gaming market overall. Still, he said the flagging economy has impacted Thunder Valley’s bottom line.

“The economy is affecting casinos,” Elmets said. “Casinos are not immune to what is happening in the general economy. We find the same number of customers are coming to Thunder Valley, but spending less than last year.”

Strong regional market

Elmets pointed out that even though visitors might be more frugal, the Sacramento gambling market is “ripe for maturity,” since 5 million people live within a 100-mile radius of Thunder Valley and Red Hawk, and 60 percent of the residents in the market area are adults over 21.

“All the reports we’re hearing is that the gaming market in Sacramento has been one of strongest investments in the U.S. for decades, because Sacramento has historically been one of the biggest feeder markets to casinos in northern Nevada,” Elmets said.

Rich Hoffman, chief executive officer of Jackson Rancheria in Amador County, said Red Hawk’s opening caused a brief bump in business at the older foothills casino, thanks to overall awareness being raised by the extra advertising. Hoffman said 2008 gross revenue at Jackson Rancheria was up about 4.5 percent over 2007, but when the cost of living and increased expenses were factored in, “it’s pretty much a push.” The casino historically has seen steady growth, so he characterized 2008 as a “slowdown for us.”

“I feel good about that when I think about where some our colleagues in the state are,” Hoffman said. “Many casinos are seeing double-digit drops in revenue, so I feel very fortunate. Especially in more mature markets in Southern California, they’re taking a beating.”

Building a destination

Cache Creek Casino Resort in Yolo County is also feeling the pinch of consumers spending less.

“The slowdown in the economy has had some impact on our business, as it has on every other business in the country,” Cache Creek general manager Randy Takemoto said in a prepared statement. “We have found we have slightly fewer customers than in prior years, though there has been a noticeable drop in spending.”

That pinch, however, hasn’t dampened Cache Creek’s plans to expand. Takemoto said the tribe re-evaluated plans for its “destination resort project” and found it still made sense. The expansion will include a spa, golf course, additional restaurants and entertainment venues.

Yolo County supervisors are challenging the project because of environmental concerns, including increased traffic on Highway 16. The tribe and the county recently went to arbitration over the disputed expansion project.

Takemoto said the Cache Creek expansion would create 1,000 new jobs at the casino, to add to the 2,500 current positions, “as well as hundreds of construction jobs in the heavily impacted building industry.” Cache Creek spokesman Bill Schreiber said Yolo County’s unemployment rate is more than 9 percent, and the proposed expansion could infuse $95 million into the local economy.

The Leslie Brodie Report has managed to confirm that Hayment is taking a sabbatical from October 1, 2012 to June 30, 2013. 

The Leslie Brodie Report also managed to confirm that Haymet is presently employed at Los Angeles-based Phillips & Associates — a financial planning and fundraising counsel for not-for-profit institutions and organizations.

According to Phillips & Associates, “Tony’ principal responsibilities focus on our firm’s assignment in the development of a new non-profit organization at the Port of Los Angeles.”

The Leslie Brodie Report also managed to confirm that Hayment is also employed at Pegasus Capital Advisors — a private equity fund manager that has been providing creative capital and strategic solutions to companies across a variety of industries.

It was not immidietly clear what, if any, are Haymet’s plans as far as CleanTECH —  a private, non-profit member organization he launched in 2007.

This alliance focuses on working strategically and when appropriate joining forces on grant opportunities and advocacy campaigns.

CleanTECH San Diego is also part of a bold, ground breaking, multi-year collaboration with the General Electric, SDG&E, UCSD and City of San Diego,. Launched in January 2011, the Smart City San Diego collaboration brings together five core partners to maximize project synergies and shared initiatives to move San Diego beyond today’s boundaries of sustainability.
