Leslie Brodie: Frank Wu — Chancellor and Dean of UC Hastings — Interference with TLR Protected Activities Concerning Rory Little and James Wagstaffe Subject of Grave Concern

Leslie Brodie – who is on assignment and could only reached by telephone – expressed grave concern over Dean Frank Wu and Hastings College of the Law intentional interference with legally protected activities regularly taken by TLR in furtherance of its mission.

Specifically, Brodie maintained that The Leslie Brodie Report (“TLR”) as a news-media outlet for a faith-based group has managed to expose and report many scandals, and that recent unlawful actions taken by Hastings College of the Law and Dean Wu are also unpopular with many students, as well as faculty and staff.

While remaining intentionally vague, Brodie’s insinuation of improprieties on the part of Hastings College of the Law and Dean Wu came in the aftermath of revelations by TLR concerning Hastings College of the Law’s Rory Little and James Wagstaffe.

Oracle v. Google — Copy of Writ of Mandamus Filed by Keker & Van Nest and Greenberg Taurig RE Lindholm Email

Google’s lawyers at Keker & Van Nest have fought like hell to keep the damning Lindholm email out of evidence, but U.S. District Judge William Alsup of San Francisco federal court has nevertheless ruled three times that the draft — whose recipients included a Google in-house lawyer — is not privileged and should stay in the public record. In November, Google took the drastic step of filing a petition for a writ of mandamus at the U.S. Court of Appeals for the Federal Circuit to reverse Alsup’s rulings.

You won’t find either side’s briefs in the scant public docket at the appeals court. But I’ve gotten hold of the mandamus petition and Oracle’s response to it. The documents suggest that the already infamous Lindholm email could end up generating important Federal Circuit precedent on the bounds of attorney-client privilege.

Google’s central argument is that Alsup and San Francisco federal magistrate Donna Ryu didn’t pay enough heed to the U.S. Supreme Court’s 1981 opinion in Upjohn v. United States, which held that privilege applies to communications about legal strategy between a corporation’s in-house lawyers and its employees. The Lindholm draft email was generated in anticipation of Oracle’s infringement suit, Google asserted, and its recipients included a Google lawyer. Google’s mandamus petition said that only by “adopting and expanding upon” a D.C. Circuit opinion called In re Sealed Case, which requires a “clear showing” that communications involve legal questions, could Alsup conclude that the email isn’t protected.

“Going far beyond the D.C. Circuit’s holding, the district court extended this ‘clear showing’ standard to all in-house lawyers because they are presumed to do more non-legal work than outside counsel,” wrote Google’s lawyers. “The district judge’s written opinion justified this approach by citing his long-held personal skepticism about privilege claims involving in-house counsel.” (Google’s brief is by Keker & Van Nest, King & Spalding, and Greenberg Traurig.)

NFL: Concussion claims don’t belong in courts

MIAMI—Former NFL players should not be permitted to sue for damages over concussions they suffered because player safety issues have long been governed by the league’s collective bargaining agreements, an NFL attorney said Thursday.

“You don’t get to come to court,” league lawyer Beth Wilkinson said. “They should go through the process that’s laid out in the agreement.”

Wilkinson spoke following a hearing before the U.S. Judicial Panel on Multidistrict Litigation, which is considering whether to consolidate 21 player lawsuits filed in six states before a single judge for pretrial matters. At least 300 former football players, plus an equal number of wives and other family members, are plaintiffs in the cases

The curious case involving a pair of San Luis Obispo County men accused of filing false documents against a Santa Barbara County judge continues to drag on, trying the patience of prosecutors and judges.

For more than six months, San Luis Obispo marketing executive Jeff Lind and co-defendant Tom Murphy of Los Osos, have been battling a legal system they say is corrupt and in violation of their constitutional rights. The two men are facing multiple felony charges, and have yet to hire attorneys or represent themselves.

Fed up with what she saw as repeated attempts to delay the judicial process, Santa Barbara County Superior Court Judge Jean Dandona appointed public defenders for Lind and Murphy in November and scheduled an arraignment hearing for Jan. 19 in Santa Barbara.

After questions about whether or not the co-defendants would actually appear for the hearing after a death in Murphy’s family, the men did eventually show up, along with their court-appointed public defenders Jeff Chambliss and Robert Landheer.

NY court: Judge can’t block $18B Ecuador judgment against Chevron

Keker & Van Nest Joins ACLU & EFF to Appeal Secrecy Ruling in Twitter/WikiLeaks Case | Electronic Frontier Foundation

Richmond, VA – Fighting to make public government efforts to obtain Internet users’ private information without a warrant, today the American Civil Liberties Union (ACLU) and the Electronic Frontier Foundation (EFF) plan to file an appeal in the legal battle over the records of several Twitter users in connection with the government’s WikiLeaks investigation.

The ACLU and EFF represent Icelandic parliament member Birgitta Jonsdottir. The appeal, filed jointly with other Twitter users Jacob Appelbaum and Rop Gonggrijp, challenges U.S. District Judge Liam O’Grady’s November decision refusing to unseal or publicly list all orders that may have been sent to companies other than Twitter and any related motions and court orders.

“These people want to try to protect their privacy and their First Amendment rights, and the government should not be able to prevent that by hiding court records. Our courts are public. Secret court orders and secret court dockets should not be permitted, except in extraordinary circumstances,” said Aden Fine, staff attorney with the ACLU Speech, Privacy and Technology Project. “This case is just one example of the unfortunate recent trend to make our court processes less open and transparent.”

In light of the district court’s denial of a stay, Jonsdottir and the other Twitter users involved in the case did not appeal the judge’s decision requiring Twitter to turn over their records.

Attorneys for Jonsdottir are Fine of the ACLU, Rebecca Glenberg of the ACLU of Virginia and Cindy Cohn, Lee Tien and Marcia Hofmann of EFF. The motions were joined by attorneys from the law firm Keker & Van Nest LLP and the Law Office of John D. Cline on behalf of Jacob Appelbaum and Rop Gonggrijp, respectively, as well as local counsel in Virginia.

More Lawsuits Filed Against LA Fitness, Bally

In the midst of more lawsuits filed against both LA Fitness and Bally Total Fitness, LA Fitness has updated access provisions to its clubs for former Bally members.

The latest class-action lawsuits were filed last week in Pennsylvania and New Jersey on behalf of former Bally members who claim LA Fitness violated their contracts after the Irvine, CA-based company acquired 171 Bally clubs last November. The New Jersey suit was filed Jan. 18 in Superior Court in Camden, NJ.

The plaintiffs’ attorney, Mark Guralnick, said in media reports last week that he has received inquiries from members in California, Texas, Minnesota and Illinois in addition to members in the Philadelphia and New Jersey areas. On a Facebook page, Guralnick said last week that more than 100 plaintiffs are involved in the lawsuits.

Lara Logan Malingering ? — Part 2 — Female Journalist Temoris Grecko Doubts Credibility of Events Told by Lara Logan

Temoris Grecko, a Mexico City-based journalist who says he was at the site of Logan’s attack but could not see it directly because of the crowd, wrote blog posts questioning the details of CBS and Logan’s stories, calling the accounts “misleading.”

“My witnesses saw no women getting involved,” wrote Grecko, who also suggested CBS may not have protected Logan adequately in Egypt or she may not have a kept a low enough profile in a dangerous situation. “I personally find it hard to believe that in such a frenzy, the wild male beasts she describes would have stopped just because a few of ‘their women,’ as she puts it, ‘closed ranks’ around the almost naked sexy blond woman who was in their raping hands.”

Grecko also wrote about resisting stereotypes about Egyptians and Muslims in sexual attacks against women, expressing concern that Logan’s story fed into bigoted views. But in pushing back against concerns about Muslim stereotyping, Wolfe noted, Grecko suggested stereotypes about sexual assault victims.

Logan and her CBS crew were arrested and detained for one night by the Egyptian Army on 3 February 2011, while covering the Egyptian Revolution. She said the crew was blindfolded and handcuffed at gunpoint, and their driver beaten. They were advised to leave the country, but were later released.[15]

On 15 February 2011, CBS News released a statement that Logan had been beaten and sexually assaulted on 11 February, while covering the celebrations in Tahrir Square following Hosni Mubarak‘s resignation.[16] CBS 60 Minutes broadcast an interview with her about it on 1 May 2011; she said she was speaking out because of the prevalence of sexual assault in Egypt, and to break the silence about the sexual violence women reporters are reluctant to report in case it prevents them from doing their jobs.[17]

She said the incident involved 200–300 men and lasted around 25 minutes. She had been reporting the celebrations for an hour without incident when her camera battery failed. One of the Egyptian CBS crew suggested they leave, telling her later he heard the crowd make inappropriate sexual comments about her. She felt hands touching her, and can be heard shouting “stop”, just as the camera died. One of the crowd shouted that she was an Israeli, a Jew, a claim that CBS said, though false, was a “match to gasoline”. She went on to say that they tore off her clothes and, in her words, raped her with their hands, while taking photographs with their cellphones. They began pulling her body in different directions, pulling her hair so hard she said it seemed they were trying to tear off chunks of her scalp. Believing she was dying, she was dragged along the square to where the crowd was stopped by a fence, alongside which a group of women were camping. One woman wearing a chador put her arms around Logan, and the others closed ranks around her, while some men who were with the women threw water at the crowd. A group of soldiers appeared, beat back the crowd with batons, and one of them threw Logan over his shoulder. She was flown back to the U.S. the next day, where she spent four days in hospital.[17] She was contacted by President Obama when she arrived home.[18] CBS said it remained unclear who the attackers were, and unlikely that any will be prosecuted.[17]

More than a year and a half after the state sued the Monterey County AIDS Project for allegedly misusing millions of dollars, a settlement has been reached with the now-defunct nonprofit and its insurance company.

Amid recent revelations, as well as mounting concerns surrounding non-profit entity CaliforniaALL,  The Leslie Brodie Report hereby asks Mr Pierce O’Donnell to disclose all non-confidential information he may be privy to, if any, surrounding transactions involving CaliforniaALL.

O’Donnell, a former co-counsel in the El Paso Natural Gas/Sempra litigation, is under extreme scrutiny in matters relating to sham charity CaliforniaALL, The Leslie Brodie Report has previously reported.

CaliforniaALL, a 501(c)(3) charitable entity, was the brainchild of Ruthe Ashley (a Diversity Officer at CalPERS and Vice-President of the State Bar of California) and Peter Arth Jr., Chief of Staff to CPUC President Michael Peevey.

In its brief existence from 2008 to 2010, CaliforniaALL collected close to $2 million from utility companies (AT&T, PG&E, Verizon, Sempra), including a sub-rosa contribution of $769,247.00 from the State Bar of California Foundation (DBA California Bar Foundation.)

CaliforniaALL was abruptly dissolved in June of 2010.

El Paso Sempra Litigation

Sources with knowledge of the examination, speaking on condition of anonymity, maintain a red flag has been raised over O’Donnell due to the overall circumstances surrounding California Bar Foundation, CaliforniaALL, CPUC, utility companies,  and specifically due to O’Donnell’s involvement in the El Paso/Sempra Litigation alongside James Brosnahan and Thomas Girardi.

Once Ashley assumed the position of CaliforniaALL’s CEO, the Foundation of the State Bar of California (which is under the complete control of the BOG) made a quiet and unlawful transfer of approximately $780,000 from Cal Bar Foundation to CaliforniaALL. At the time of the transfer, the individuals controlling the Foundation were Holly Fujie, Girardi & Keese’s Howard Miller, Howard Rice’s Douglas Winthrop, Geoffrey Brown, Morrison & Foerster’s Annette Carnegie, and a few others.

CaliforniaALL never acknowledged receipt of the approximate $780,000 from the Cal Bar Foundation in any of its publications, although it did acknowledge the transfer on its IRS tax returns. Likewise, California Bar Foundation never acknowledged the largest grant it ever bestowed in its newsroom, the California Bar Journal, or similar publications; it did, however, recognize the transfer on its IRS returns, and in a 2 by 2 inch blurb in its annual report.

During its brief existence, CaliforniaALL obtained additional funding of close to $1.5 million from utility companies such as Verizon Wireless, Sempra, PG&E, and others.

As the purpose of CaliforniaALL was to transfer those funds forward, it did so by awarding approximately $300,000 in grants to the UCI Foundation, where Joe Dunn serves as trustee and chair of the Audit Committee.

In September 2009, Ruthe Ashley abruptly exited CaliforniaALL. In the same month and year, Joe Dunn publicly launched his online publication, “The Voice of OC.” Public sources have stated that the Voice of OC was financed by various foundations, unions, and the like.

The fact that some individuals and entities involved in the creation of CaliforniaALL and the subsequent unlawful transfer of $780,000 from the Cal Bar Foundation to CaliforniaALL were also involved in assisting Joe Dunn with the creation of “Voice of OC” has caused complainant to entertain the thought that “Voice of OC” may have been a recipient, at least in part, of the $780,000 misappropriated from the State Bar of California.

This belief is heightened given various events’ proximity in time — as noted above, Ruthe Ashley left CaliforniaALL in the same month Dunn launched “Voice of OC” (as though her mission had been completed). Moreover, the recent abrupt departure of Thomas Girardi and James Brosnahan from ‘Voice of OC” ( as though they were fleeing the scene with guilty consciences), the refusal of SAL-UCI to disclose the amount it receive from CaliforniaALL, the simulated RFP, and CaliforniaALL’s pre-selection of the UCI Foundation as a recipient of funds only reinforce this belief. This is heightened by Mr. Thomas Girardi’s lack of credibility (pursuant to findings made by a panel of federal judges), and the friendship Dunn shares with him.

“It’s very improper and it is unethical,” Peter Keane, an ethicist and professor of law at Golden Gate University, tells the NBC Bay Area Investigative Unit.

“The supervisors getting this type of gift and not paying for it, that has an enormous appearance of impropriety and it shouldn’t be done,” Keane says, “What it says to me is that the supervisors are getting some extra pay that’s coming to them from a very strong economic entity in the city and county in San Francisco: the 49ers.”

The State of California has ethics rules which prevent elected leaders and public employees from accepting gifts exceeding $420 in any year from a single group, but San Francisco has created a loophole in the law.

SAN FRANCISCO (AP) – The husband of a San Francisco prosecutor who was arrested on suspicion of domestic violence also was taken into custody over the weekend.

Authorities tell the San Francisco Chronicle that assistant district attorney 34-year-old Sanaz Nikaein and her husband, 38-year-old Faysal Nuri, were booked into jail on Saturday on suspicion of misdemeanor domestic battery.

Both are free after posting bail.

San Francisco Police Department spokesman Albie Esparza says he cannot discuss the case due to confidentiality requirements.

District attorney’s spokeswoman Stephanie Ong Stillman says the case was referred to the office of state Attorney General Kamala to avoid a potential conflict of interest. Harris’ spokeswoman Lynda Gledhill says the office has yet to decide whether to take the case.

Nikaein, a prosecutor since 2004, is on administrative leave.

LOS ANGELES — A US sheriff’s deputy who endured an anti-Semitic rant from Mel Gibson for arresting the star won the right to a trial Thursday, over his treatment by bosses after the notorious incident.

A judge ruled that James Mee could take his lawsuit to trial on the grounds of religious discrimination and hostile work environment, which he claims were behind repeated disciplinary action he has suffered since the 2006 arrest.

Gibson has struggled to resurrect his career ever since the incident, in which he launched a foul-mouthed anti-Jewish tirade at Mee after being stopped for drunk driving in Malibu, north of Los Angeles.

TEL AVIV (JTA) — With eyes closed, it would have been difficult to guess that the female voice with the amazing range singing a Hebrew classic was a shy-looking, 11-year-old Filipina.

But there was Kathleen Eligado performing Miri Aloni’s “Ballad of Hedva and Shlomik” before a prime-time television audience of a million Israelis. Eligado, born in Israel to Filipino migrant worker parents, is one of the stars of the popular Israeli show “Music School,” a kind of “American Idol” for kids, finishing the season in second place.

Her performance gave new meaning to the quintessentially Israeli song. Lyrics written to describe the culture shock of leaving the kibbutz for the city — “I’m alone in a strange city, as if I have no choice” — seemed in Eligado’s rendition to be the blues of a Third World immigrant who ends up in Tel Aviv.

Yet for Eligado and thousands of other children of foreign workers from the Philippines and elsewhere, Israel is now home — for many, the only home they have ever known. Some came to Israel as children; others were born in the country. Tel Aviv alone is home to an estimated 3,600 children of foreign workers and asylum seekers, according to the city’s municipality data.

As they integrate into Israeli society, the children of foreign workers are crafting identities that are similar yet distinct from those of the country’s Jewish majority.

Of all the nationalities represented among migrant workers, Filipinos are the quickest to integrate, said Tamar Schwartz, a social worker at Mesila Aid and Information Center for the Foreign Community in Tel Aviv.

“Compared to other migrants, Filipinos usually speak articulate English, often are well-educated and have a strong family ethic that emphasizes discipline and respect for elders,” Schwartz said. “And incidents of child abuse are low. As a result, there is less of a gap between them and Israeli society, which makes it easier for them to integrate.”

The U. S. Supreme Court recently heard arguments in the case Filarsky v. Delia (appealed from 9th Cir. 9/9/10) involving a private employment attorney, Steve Filarsky, retained by the City of Rialto to conduct an internal affairs investigation. Filarsky caused the City to order respondent firefighter Delia to consent to a warrantless search of his home. Delia subsequently brought a civil rights claim against both the City and Filarsky alleging, among other things, a violation of the Fourth Amendment. The district court granted Filarsky’s and the City’s motion to dismiss based on qualified immunity, but the Ninth Circuit Court of Appeals reversed in part, ruling that Filarsky, a private attorney, could not enjoy such immunity. Other circuit courts have granted qualified immunity to private lawyers retained by the government, and the Supreme Court must now resolve the circuit courts’ split.

La Verne Law Symposium Addresses Civil Rights Issues Under the Law (TLR Note: Most Sought-After Dean Erwin Chemerinsky Part of Symposium)

ONTARIO, Calif., Jan 23, 2012 (BUSINESS WIRE) — Southern California’s leading law enforcement officials, attorneys and judges discussed and debated the changing face of civil rights issues and litigation in a two-day symposium hosted Jan. 20 and 21 by the University of La Verne College of Law.

The event, “2012 University of La Verne College of Law Section 1983 Civil Rights Symposium,” drew more than 150 attendees with panel discussions and presentations on issues ranging from recent Supreme Court rulings to the challenges of modern policing. Section 1983 (42 U.S.C. d1983) is the federal statute that allows individuals to bring charges against government agencies for alleged discrimination, abuse, property seizure, abridgement of free speech and more.

Speakers included U.S. Attorney Andre Birotte, Jr., Constitutional law expert Erwin Chemerinsky, LAPD Assistant Chief Michel Moore, Riverside County Sheriff Stanley Sniff, and 20 other prominent judges, attorneys and other legal experts in the field.

The symposium, worth 14.5 MCLE credits, addressed issues of case law, legislation, less lethal munitions, training, legal strategies and plaintiff’s challenges as they relate to law enforcement and the rights of those they are hired to protect and serve.

Changes in the law and advances in technology have dramatically transformed the way law enforcement does its job, said Riverside Police Chief Sergio Diaz. Still, attorneys representing the plaintiffs in cases against law enforcement cited problems in obtaining information from the agencies they challenge. In most cases, juries side with the officers, and district attorneys rarely file criminal charges against officers who use excessive force, they said.

Throughout the event, attorneys and judges provided insight on recent case law, and strategies for prosecuting and defending clients in trial.

“We are extremely proud to have brought together such high caliber speakers, each one presenting his or her unique perspective and experience in the field,” said La Verne Law Interim Dean Philip A. On February 10, 2012, the North Carolina Central University School of Law will proudly host the 2012 Rule of Law conference from 10 a.m. to 2:45 p.m.  This year’s conference will focus on the importance of the rule of law and its influential impact on society.

Some First Amendment experts are crying foul.

“I have never heard of an entire civil trial being conducted secretly,” said Lucy Dalglish, executive director of Reporters Committee for Freedom of the Press, an Arlington, Va.-based nonprofit that provides legal assistance to journalists. “It’s absolutely outrageous.”
