Former Chief Diversity Officer for CalPERS Mired in Controversy Amid Allegations of Racketeering

The president of an organization committed to diversity and leadership pipelines in the legal profession has been accused of racketeering.

A civil RICO action filed with the United States District Court for the District of Columbia alleges that Ruthe Catolico Ashley, president of Rocklin-based Diversity Matters, engaged in predicate acts of racketeering through and by means of money laundering, mail and bank fraud, as well as conversion of funds.

The suit, advanced by Marina Del Rey-based community activist Daniel Dydzak, seeks monetary and equitable remedies.

Ashley is the former Chief Diversity Officer for CalPERS and former Assistant Dean for Career and Professional Development at the University of the Pacific, McGeorge School of Law. Prior positions include past president of Legal Services of Northern California, past chair of the Sacramento Asian Pacific Chamber of Commerce , past president of the Asian Bar Association of Sacramento, and past president of The National Asian Pacific American Bar Association (NAPABA).

LORNA SCHOFIELD SUGGESTED FOR SEAT ON THE
SOUTHERN DISTRICT OF NEW YORK

WASHINGTON – Today, the National Asian Pacific American Bar Association (NAPABA) and the Asian American Justice Center (AAJC) welcomed the news that Senator Charles Schumer of New York has sent the name of Lorna Schofield to the White House to serve as a federal district court judge for the Southern District of New York.

“Lorna Schofield is exceptionally well-qualified to serve as a federal district court judge,” said Tina Matsuoka, executive director of NAPABA. “If nominated by President Obama and confirmed by the Senate, Ms. Schofield would be the first Filipino American in the history of the United States to serve as a federal judge. NAPABA applauds Senator Schumer for putting forward her name and once again confirming his strong commitment to advocating for the greater representation of well-qualified, diverse nominees to the federal judiciary.”

Asian Pacific Americans are significantly underrepresented in the federal judiciary. In the New York City area, approximately ten percent of the population is Asian Pacific American yet of the over 90 active and senior Article III judges currently serving the Southern and Eastern Districts of New York, none is Asian Pacific American in the Southern District and only one is Asian Pacific American in the Eastern District.

“We commend Senator Schumer for recognizing both Ms. Schofield’s qualifications and the importance of diversity to the judiciary,” said Karen K. Narasaki, president and executive director of AAJC. “Ms. Schofield has the experience to be an excellent district judge in the Southern District of New York, and we hope that she has the opportunity to do so.”

For almost 20 years, Ms. Schofield has been a litigation partner at the firm of Debevoise & Plimpton LLP, where she has focused on white collar criminal defense and general civil litigation. She became the firm’s first minority partner in 1991 and since January 2012 has served as Of Counsel. Prior to joining Debevoise, she was an Assistant United States Attorney for the Southern District of New York (Criminal Division) for four years. In 2008, Ms. Schofield was named one of the nation’s 50 most influential minority lawyers by the National Law Journal. She was the first Asian Pacific American to chair the Litigation Section of the ABA, which is the ABA’s largest section with over 60,000 members, and has also served as a member of the ABA’s Standing Committee on the Federal Judiciary.

Ms. Schofield is a second-generation Filipino American whose life story is a testament to the American story of hard work and perseverance that beats the odds. She was the only child of a Filipina mother who came to the United States during the post-World War II reconstruction of the Philippines. Mother and daughter remained in the Midwest after Ms. Schofield’s father left the family when she was only three years old. She grew up in a blue collar community and received a full tuition scholarship to attend Indiana University, where she graduated Phi Beta Kappa and magna cum laude in three years. She went on to attend New York University Law School, where she was an editor of the Law Review and a Pomeroy Scholar.

Dolly Maizie Gee is a federal judge for the United States District Court for the Central District of California. She was nominated to the court by President Obama.[1]

Early life and education

Gee was born in Hawthorne, California, the daughter of Chinese immigrants from rural China.[1][2] Gee’s father was a World War II veteran who later worked as an aerospace engineer on projects like the space shuttle and the Apollo missions, while her mother was a garment worker.[1] Gee earned a B.A. from the University of California, Los Angeles in 1981 and a law degree from University of California, Los Angeles School of Law in 1984.[3] From 1984 until 1986, Gee served as a law clerk for Judge Milton Schwartz of the United States District Court for the Eastern District of California.[3]

Professional career

Gee has worked as a managing partner of the Los Angeles law firm Schwartz, Steinsapir, Dohrmann & Sommers LLP since 1986. Her specialty is labor and employment law.[2] She was appointed to the Federal Service Impasses Panel (FSIP) in 1994, where she served a 5 year term. She has also served multiple years as a investigating election protests for the International Brotherhood of Teamsters Delegate and Officer Elections. Since 2000, she has served as an arbitrator for the Kaiser Permanente Independent Arbitration System. She has argued cases in the Central District Court as a lawyer. She is a former president of the Southern California Chinese Lawyers Association, former trustee of the Los Angeles County Bar Association, and a founder of the Asian Pacific American Bar Association of Los Angeles County.[1]

NAPABA Hosts 23rd Annual Convention in Atlanta, Georgia

WASHINGTON DC – On November 17-20, members of the Asian Pacific American (APA) legal community from around the country will gather in Atlanta, GA. for Sustainability: Renewal and Growth for Today and Tomorrow, the 23rd Annual National Asian Pacific American Bar Association (NAPABA) Convention.

This year’s convention moves beyond buzzwords to explore the future “sustainability” of the APA legal community. “As NAPABA celebrates 23 years of professional development, advocacy, and community service, we need to build on our successes now and in the future. We want NAPABA members to have experiences that are viable and meaningful. As a bar association, we strive to ensure professional development and advancement for all our members,” said NAPABA President Paul Hirose.

A special panel focusing on state Supreme Court justices will feature California Supreme Court Associate Justice Ming Chin, Massachusetts’ first female APA Supreme Court Justice Fernande Duffly, and Hawaii Supreme Court Associate Justice Sabrina McKenna, the Court’s first openly gay female APA member.  Newly-appointed California Supreme Court Associate Justice Goodwin Liu will offer opening remarks.

The Gospel of APA Part 3: Goodwin Liu Should Filibuster His Own Nomination to California Supreme Court

In part 1 of “The Gospel of APA”,  we discussed the hypocrisy of many within the Asian-American community in general, and that of NAPABA in particular in their constant and ugly push for the selection of Asian-American as judges — either state or federal — to the detriment of more qualified individuals who are otherwise not Asian-American.

The rationale behind the ugly push is diversity, and as we demonstrated — is a one way street.

Goodwin Liu
Mr. Goodwin Liu, was nominated by President Obama to the Ninth Circuit Court of Appeal.  Liu’s liberal support of  same-sex marriage and affirmative action promted Republicans to filibuster his nomination.

Today, California Governor Jerry Brown announced that he is nominating Goodwin Liu, a University of California, Berkeley law professor, to the California Supreme Court.

Assuming Goodwin Liu is confirmed, and along with Chief Justice Cantil-Sakauye, Associate Justice Ming Chin and Associate Justice Joyce Kennard, APA will have a 57.14 % representation on the California Supreme Court, while APA are only 12.5% of California’s population.

Should Goodwin, for the sake of intellectual honesty and a diverse California Supreme Court, decries, reject, and otherwise filibuster his own nomination to the California Supreme Court?

Dear President Hebert, Senator Dunn, Members BOG, Foundation BOD, and to
whom it may concern :

This will serve to supplant, supplement, and otherwise provide an update
on matters relating to irregularities involving the State Bar of
California, California Bar Foundation, and CaliforniaALL.

1. Consistent with Internal Revenue Service rules and policies, on
February 17, 2011 I submitted a request to the California Bar
Foundation (specifically, to Executive Director Leslie Hatamiya) to
produce (or make available for inspection and copying) financial
documents and reports.

The request specifically cited “IRS Policies” as one basis supporting
the right to review the documents and sought, among other items, the
following documents:

*The “Conflict of Interest Policy” signed by you (Ms. Hatamiya) and each
member of the California Bar Foundation Board of Directors from 2007 to
the present.

*Cal Bar Foundation’s IRS Form 990s from 2006 to the present.

*Any additional documentation submitted to the IRS in connection with
Cal Bar Foundation’s duty to disclose interested directors other than
those mentioned in the Form 990s.

*California Bar Foundation records, including Board meeting minutes,
that relate to the decision to transfer almost $800,000 to
CaliforniaALL.

Shockingly, on March 3, 2011 Ms. Hatamiya wrote back ipso facto denying
the request.

This refusal to comply with the request for documents constitutes very
serious misconduct on the part of Ms. Hatamiya, as well as officers of
the Foundation to wit, Douglas Winthrop, Holly Fujie, Joan Kupersmith,
and David Grove.

California Bar Foundation represented to the Internal Revenue Service
that anyone would be able to inspect documents “upon request.”
Furthermore, IRS regulations provide for the same. In fact, technically
speaking, any member of the community may simply walk in unannounced and
ask to immediately inspect the books. This is a course of action I of
course do not intend to pursue as I find it to be unreasonable and
intrusive; nevertheless, I cite to it to demonstrate the level of
openness that the IRS and the State of California impose on charitable
organizations.

As such, I ask that this latest act of misconduct will also be included
as part and parcel of the prior request to the Board of Governors for a
formal investigation of events relating to CaliforniaALL.

2. In that the State Bar of California entered into a “partnership”
with CaliforniaALL, and is otherwise vicariously liable for all
actions and omissions by CaliforniaALL, you should know that
CaliforniaALL has not been properly dissolved with the Office of the
Attorney General, nor with the California Secretary of State, where
it is still listed as “active.”

As you recall, the Chairman of the Board, Mr. Victor Miramontes,
announced in June 2010 that CaliforniaALL had been dissolved. See

3. Representations I made in the last communication stating that the
amount contributed to the U.C. Irvine Foundation was $100,000 is
inaccurate. It now appears that the sum is close to $300,000.
Please note that despite the change in these dollar figures, I still
stand behind the claims of improprieties. The two areas about
which I am most concerned as they are supported by strong direct and
circumstantial evidence are as follows:

a) A conspiracy by Holly Fujie, Leslie Hatamiya, Patricia Lee, and
Ruthe Ashley to cause the “Hush-Hush” transfer of close to $800,000
from the Foundation to CaliforniaALL, while defrauding (actively or
by omission) the Board of Governors, members of the State Bar, and
the public.

b) Improper and unaccounted-for spending by CaliforniaALL. Here, Mr.
James Hsu, who is very active with NAPABA, along with Fujie,
Hatamiya, Lee, and Ashley may have played a role. Even before
CaliforniaALL came into existence, Mr. Hsu participated in a meeting
at CPUC and knew that utility companies were pressured to contribute
money for diversity-related events.

Upon the creation of CaliforniaALL, the Board of Governors ratified the
decision to have Mr. Hsu sit on the board of CaliforniaALL on behalf of
the State Bar of California.

Even with the new figure of $300,000, answers must be given addressing
what exactly CaliforniaALL did with $1.8 Million dollars, and whether or
not those expenditures were justified.

Almost all of CaliforniaALL’s expenditures that I have examined appear
highly suspect, including close to $100,000 on travel, $10,000 for
“parking,” and $30,000 for “occupancy” (even though CaliforniaALL
claimed DLA Piper provided pro bono office services). The only expense
I do not currently believe is suspect is the approximate $140,000 salary
paid to Ruthe Ashley.

On Tuesday California residents will decide if California Supreme Court
Justices Carlos Moreno and Ming Chin will remain on the court for an
additional period of 12 years.

Additionally, the voters will decide if Third District Court of Appeal
Justice and the current Chief Justice nominee, Ms. Tani Cantil-Sakauye, is worthy of the title Chief Justice of the California Supreme Court.

Assuming Justice Cantil-Sakauye and Justice Ming Chin are both elected,
and along with Justice Joyce Kennard, APA will have a 42% representation
on the California Supreme Court, while APA are only 12.5% of
California’s population.


Justice Cantil-Sakauye, if elected would replace Chief Justice Ronald M.
George who will be retiring in January. Should the voters decide not to
elect her, it will be up to California’s new governor to directly

Lobbying for the appointment of an APA as a justice on the United States
Supreme Court, attorney John C. Yang, immediate past president of NAPABA
(National Asian Pacific American Bar Association) and chair of the
group’s Judiciary Committee stated to The Pacific Citizen: “It is essential that the (United States Supreme Court) court reflect
the diversity of viewpoints and experiences of the country’s residents.
Throughout history, Asian Americans often have been perceived as
perpetual foreigners, even by judges. Having an Asian American on the
Supreme Court may help to combat such stereotypes and prevent those
miscarriages of justice.”

“Having an Asian American on the United States Supreme Court means winning equal justice for Asian Americans,” Mr. S.B. Woo–president of 80-20, a non-partisan political action committee that has actively been promoting AA candidates for the U.S. Supreme Court.

Should NAPABA,for the sake of intellectual honesty and a diverse
California Supreme Court, decries and otherwise urge voters to NOT vote
for two jurists with an APA background?

Re: 2010 NAPABA CONVENTION AT THE RITZ CARLTON

Dear Messrs. Hirose and Centeno:

This year, NAPABA’s (The National Asian Pacific American Bar
Association) annual convention will be held at the Ritz-Carlton hotel
in downtown Los Angeles. The primary sponsor of the convention is
Walmart, and the theme of the convention will be INSPIRE.

Upon learning the details of the convention, we were, unfortunately,
uninspired.

Specifically, we were uninspired by NAPABA’s irresponsible decision to
hold the convention at the Ritz-Carlton courtesy of Walmart’s shoppers.

Tomorrow, the Social Security Administration will celebrate its 75th
anniversary at a time when it is being overburdened by the poverty which
is affecting this country. In case you are not familiar with market
trends, Walmart shoppers, on the average, tend to be members of a class
which is currently hurting economically and financially.

As such, we believe for NAPABA and its members to spend money given by
Walmart on items of luxury is disrespectful. Under the circumstances,
we believe you have a moral obligation to relocate the convention to a
more modest location.

— On Monday, August 2 2010 TLR will launch a public relation campaign
agaisnt NAPABA planned convention at the “Ritz-Carlton”. Leslie Brodie
stated to TLR that “the spending of Wal-Mart money by Asian lawyers at
the Ritz-Carlton is not only irresponsible, but outrageous at the
extreme. Especially at times when most Wal-Mart shoppers face
difficulties making mortgage or rent payments,” Brodie concluded.

— Former Judge Stephen Larson’s decision in Mattel/Bratz/MGA case is
reversed by Ninth Circuit. Chief Judge Alex Kozinski found that Judge
Larson committed many errors and abuses of discretion.

— Starr Babcock was named as State Bar of California new General
Counsel.

— TLR has learned from court records “Respondent Sam” had sued Golden
Gate University and Peter Keane for an injunction seeking to halt a new
scholarship designed by Keane solely for the benefits of Muslims law
students. Events following September 11 had led Keane to establish the
scholarship. “Respondent Sam” claimed scholarships were discriminatory,
and at least should include the decedents of the victims, in addition to
Muslims. Court records indicate that Respondent Sam was successful in
stopping Golden Gate University Mt. Peter G. Keane from awarding
scholarship exclusively to Muslims law students.

— Previously TLR reported of donation made by “The Bycicle Casino” to
Jerry Brown’s election campaign. “The Bicycle Casino” is partially
owned by Walter Lack. Two days ago, the Second District Court of
Appeal affirmed a decision of a lower court in a suit against the State
of California. Prosecuting the suit against the State on behalf of
plaintiffs were Walter Lack of Engstrom, Lipscomb & Lack; Richard
Kinnan and Edward Wolfe of Girardi & Keese; and Jay Devitt of Devitt & Chelberg. Defending the suit on behalf of the state were Edmund G. Brown Jr.,
Attorney General, David Chaney, Chief Assistant Attorney General, James
M. Schiavenza, Assistant Attorney General, Marsha S. Miller, Elizabeth
S. Angres and Paul C. Epstein. Case is PRISCILLA AVEDON v.STATE OF
CALIFORNIA

If this song ever made it to this blog, I would have thought it would be
in connection with some of the people mentioned in the earlier posts. I did not, however, expect that it will be in connection with NAPABA–
the National Asian Pacific American Bar Association. C’est la vie.

On November 17-21, 2010 the NAPABA Annual Convention will be held at the

Meet Holly Fujie– the Former President of the State Bar of California

In conducting some of the investigation and the subsequent reporting of the circumstances surrounding the Howard Miller Scandal (HMS), I had no choice but to inquire about the role of his predecessor–Ms. Holly Fujie. Surprisingly, the process of looking into Ms. Fujie’s background was quite refreshing, positive and educational. The part about the Tanforan Race Track and the uncertainty concerning the whereabouts of her grandfather shocked me.

It was a nice break after weeks of having to fully understand the extent of the deception and to get familiarized with people and events that percolate negative energies. Some of the examples include a lawyer who owns casinos and a carcass of a real lion is hanging in his office; trying to figure out what exactly Mr. Miller is trying to convey when he stated “that contention seemed to me to be the center of gravity on the briefs, any attempt to say there were other arguments given the importance of that center of gravity would not make a difference in the outcome of the appeal” and having to wonder if it is possible that the law of gravity has no influence on Girardi and Miller, and if the answer is no, why weren’t they gravitating towards “that” center of gravity a bit earlier.

As you recall, ( if you read this blog) I also had to familiarize myself with some of the social scenes of San Francisco. Spent too much time there, which was my fault. I was wondering if there is a picture out there of the Chief Justice toghether with the not to be named model/lawyer, who also frequents events and galas. Could not find any. Only lots and lots of pictures of the ever smiling Courtney Bocci. Also spent too much time on pondering the origin of the name BVLGARI. Is the owner Bulgarian? Nope, he is Greek. So why did he choose to spell it with Roman letters and not Greek Alphabet? And why on the stock-exchange the company is listed as “BUL” and not “BVL”.

Admittedly, when Inquiring about Ms. Fujie’s background I was hoping to find dirt (which may or may not exist) However, what I found was an exceptional human being; and the more I learned about her, the more I grew to appreciate her as a person.

Ms. Fujie was born in Oakland, CA where she spent her formative years. The school she attended had mostly Black students, whom she easily befriended. At times she was subjected to some taunting because of her race. They called me “ching ching chinaman”, Holly recalled. While growing up she worked as either a baby-sitter, tutor, or in an ice-cream parlor.

During WWII both her parents’ families were interned. First being sent to the Tanforan Race Track in San Bruno, California where they lived in the stables. Later, they were trasnsfered to the Topaz Camp located in the State of Utah. Her grandfather was taken away by the FBI, and the family didn’t know where he was for a year.

After graduating from high-school, she attended U.C. Berkeley majoring in political-science and economics. At 22, she received her law degree from Boalt Hall.

Ms. Fujie has been married to Lee Cotugno, a Beverly Hills lawyer, for the last 30 years. She met him while at Boalt. He was her moot court adviser. They married the day after she graduated from Boalt and have two children.

She is currently a shareholder with the Los Angeles based law firm of Buchalter Nemer. Her practice focuses on complex litigation with a niche specialty in fraud related activities.

Ms. Fujie is involved in organizations which are devoted to diversity issues in the legal profession. She is also a frequent speaker at meetings of APAWLA, NAPABA, APABA, APALSA and WLALA.

In mentoring Asian law students, she urges them to “fight the stereotype of the quiet Asian woman”.

On September 27, 2008, Ms. Holly Fujie was sworn in as the 84th President of the State Bar of California by Chief Justice Ronald George. She was the third woman chosen to head the organization since it was established by the legislature in 1927.
