TIMELINE 2010 – New York Times: Branson’s ‘Carbon War Room’ Puts Industry on Front Line of U.S. Climate Debate (TLR Note: John Doerr, Craig Cogut, Pegasus Capital Advisors)

Richard Branson, the British-born billionaire, equates global warming with the kind of threat posed by a world war. In a capitalist America, he argues, that means deploying private equity and ingenuity to beat a common enemy — in this case, carbon emissions.

A serial entrepreneur, Branson has become as famous for the success of Virgin Records, Virgin Atlantic Airways and a flock of spinoff companies as for his stabs at addressing vexing environmental and public health issues. His ventures, including trips to outer space, have made him among the world’s most famous capitalists, alongside Bill Gates and Warren Buffett.

His latest venture, the “Carbon War Room,” is a nonprofit organization based less than a mile from the White House. It has been around for five months, but has kept a low profile as it sells to venture capitalists, private equity investors and U.S. industrial giants the idea that cutting greenhouse gas emissions can drive long- and short-term profits and is good for the U.S. economy.

If businesses and governments fail to address global warming, Branson said in an interview yesterday, the problems could outstrip the damage done during World Wars I and II. “I thought, if that’s the case, where is the war room, where is the center that’s coordinating the attack on carbon?”

Cargo shipping, airlines, cities and housing are some of the low-hanging fruit, said Branson and Carbon War Room staff as they described partnerships with companies including Maersk, the global tanker operator, to cut some of the noxious pollutants and carbon dioxide emissions that come with shipping goods across the ocean.

A critical point in the debate

Branson has entered the fray at a critical point in the U.S. climate debate. The debate in the United States has grown more strident since the House passed its hotly contested cap-and-trade bill and as climate change skeptics have won traction on Capitol Hill and in the public eye.

Democratic leaders in the Senate and the Obama administration are gearing up to push financial regulatory reform toward a quick vote, getting off their plate the only big-ticket issue, aside from filling Justice John Paul Stevens’ seat on the Supreme Court, standing in the way of a debate about energy and climate policy. On Monday, Sens. John Kerry (D-Mass.), Lindsey Graham (R-S.C.) and Joseph Lieberman (I-Conn.) are planning to unveil a long-anticipated legislative proposal designed to attract support across the political spectrum and pass in the Senate.

The three senators have met repeatedly behind closed doors with business leaders in recent months, and have made it clear that the political coalition needed for passage includes the amorphous business community. The White House has kept close ties with influential electric utility executives inclined to support a carefully crafted cap on emissions; General Electric Co., the major U.S. maker of gas turbines, windmills and appliances; and venture capitalists who see “green” business opportunities as every bit the driver of U.S. innovation and big financial deals as the Internet during the 1990s.

“The government can’t make things happen on its own,” said Rebecca Blank, undersecretary for economic affairs at the Department of Commerce. “If the private sector doesn’t believe in this, public-sector efforts won’t be effective.”

In a pair of reports issued yesterday, the Commerce Department tried to bang home the idea that the U.S. government, from this point on, is measuring the output of industrial greenhouse gas emissions. The roughly $500 billion green economy “is poised for growth,” the department concluded. Between 1.8 million and 2.4 million green jobs counted by Commerce are primarily in the areas of energy conservation, resource conservation and pollution control. Manufacturing accounted for about 200,000 jobs.

Commerce also said that manufacturers have become more carbon dioxide-efficient, and households account for 30 percent of energy-related emissions.

U.S. competitiveness is at stake?

Ardent clean-energy venture capitalists pressing the U.S. government to adopt mandatory carbon controls, with the idea that doing so opens the door to a lucrative technology boom, have been making their case quietly. Last summer, ahead of the House climate debate, groups for and against legislation spent millions of dollars on the newspaper and television advertising.

Daylong events yesterday and today sponsored by the Carbon War Room, including speeches by Branson, were closed to all but a few reporters. Branson was scheduled to meet with Commerce Secretary Gary Locke and U.S. EPA chief Lisa Jackson last evening. Today, there could be a trip to the White House, Branson and others said.

Top executives at Intel, Microsoft and Oracle signed a letter along with John Doerr, the venture capitalist, and the chief executives of Tesla Motors and Solazyme to urge members of Congress to continue to support Department of Energy funding for high-risk clean energy projects. Nothing less than U.S. national security and global competitiveness are at stake, they assert.

For the people involved in Branson’s Carbon War Room, the bigger the company or city they can reach, the greater the impact.

Branson’s bigger-than-life personality so far has attracted at least one significant private-equity investor, the founder of Pegasus Capital Advisors, Craig Cogut, who co-founded of the Carbon War Room after Branson pitched the idea about a year ago.

Cogut points to Waste Management and Wal-Mart as examples of companies that came around to seeing sustainable development as a profit-making enterprise. “Wal-Mart is the single biggest force for change in this area,” he said. “Does the Carbon War Room have to wake them up? No, but there are many others we can help wake up.”

Looking for energy efficiency partnerships

Branson also attracted Jigar Shah, who in 2003 created SunEdison, which he has since sold and remains among the largest U.S.-based solar power developers and financiers.

Shah said the group started out asking what has been done already. “We realized that over 50 percent of carbon emissions globally have profitable technologies that exist today that can offset the offending technology,” he said. “So the question is, what the hell are people waiting for?”

Too much of that technology remains inaccessible. “Market failures are in the way,” he said. “We are certainly a pro-capitalist organization, but capitalism doesn’t work efficiently in every single sector.”

Later this month or early next month, Shah and his staff will announce energy efficiency partnerships with a handful of cities around the world. In shipping, the organization first approached the most willing big tanker companies, particularly Maersk, to coordinate on an effort to measure shippers’ emissions and potential reductions. The selling point is to their customers, who want lower shipping and fuel costs. “These shippers expect to get a competitive advantage if they have a more efficient ship and people know about it,” said Shah.

On November 15, 2012 Amid conflicting reports and unanswered questions, a journalistic inquiry was launched by TLR into events surrounding San Diego-based Scripps Institution of Oceanography (“SIO”), and directors Tony Haymet, Donna Lucas, and Marty Africa.

According to the East Bay Express, “On September 3, legendary Bay Area DJ Matthew Africa was tragically killed in a car accident while returning from Yosemite with his wife. The death sent shockwaves through the Bay Area DJ community, where Africa had been a mainstay for decades, and reverberated through the blogosphere. Local and national outlets covered his passing. Clearly, Africa was a man who touched a lot of people on a lot of different levels.”

Accoding to Patterson Irrigator “Africa was heading northbound in his 2001 Volkswagen Beetle on Highway 33 just north of West Stanislaus Road at about 2:45 p.m. Sunday when he veered off the road for unknown reasons, according to a CHP report. His Beetle hit shoulder gravel, steered back onto the highway and spun in a clockwise direction and into the southbound lane before striking a 2000 Peterbilt driven by Hector Alvarez, 23, of Newman, according to the CHP. Africa was pronounced dead at the scene from injuries while his passenger, Ha Le Cow, 38, of Berkeley was taken by air ambulance to Doctors Medical Center for treatment of what was described as major injuries.”

Consequently, TLR has suspened the above mentioned inquiry, which will resume in January of 2013.

Bonnie Reiss is the Chief Executive Officer of BMR Consulting, specializing in strategic advice in the areas of education, the environment and issues impacting women. She served as the California Secretary of Education from 2006-07. She was a member of the California State Board of Education from 2003-06.

She served as senior advisor to Governor Arnold Schwarzenegger from 2003 to 2007, where she advised the Governor on all major policy initiatives, including education, the environment and children’s issues. From 1994 to 2003, Secretary Reiss served as founding president of the Inner-City Games Foundation, later renamed After School All-Stars. In 1988, she founded the Earth Communications Office where she led the effort to use media for public awareness campaigns of environmental issues until 1993. Her experience includes careers as an entertainment lawyer, accountant, producer and writer from 1981 to 1988.

Ms. Reiss serves on the board of directors for After School All-Stars and Maria Shriver’s Women’s Nation FOundaton. In 2007, Ms. Reiss received the William S. White Lifetime Achievement Award from the U.S. Department of Education for her advocacy in the area of public education and, in 2006; she received the Advocate of the Year Award from the University of California Student Association. 

Ms. Reiss was appointed as a Regent in March 2008 by Governor Schwarzenegger to a term ending in 2020.

The Leslie Brodie Report Launched Journalistic Inquiry Into Events Surrounding Scripps Institution of Oceanography, Tony Haymet, CleanTECH, Donna Lucas, Marty Africa

Amid conflicting reports and unanswered questions, The Leslie Brodie Report has launched a journalistic inquiry into events surrounding San Diego-based Scripps Institution of Oceanography (“SIO”), and directors Tony Haymet, Donna Lucas, and Marty Africa.

Haymet, 56, is “the tenth director of Scripps Institution of Oceanography at the University of California, San Diego. Haymet also serves as UC San Diego’s vice chancellor for marine sciences and dean of the Graduate School of Marine Sciences, and is a professor of oceanography at Scripps. According to incomplete and misleading infomation issued by the University of California “Scripps Director Tony Haymet is taking a sabbatical and will continue his research program, accept an excellence award as Visiting Professor of the Petersen Foundation in Kiel, Germany, (http://www.geomar.de/en/) and chair the World Economic Forum’s Ocean Council (http://www.weforum.org/content/global-agenda-council-oceans-2012-0). The World Economic Forum, headquartered in Geneva, Switzerland, is an independent international organization committed to improving the state of the world by engaging business, political, academic and other leaders of society to shape global, regional and industry agendas.”

The Leslie Brodie Report has managed to confirm that Hayment is taking a sabbatical from October 1, 2012 to June 30, 2013. 

The Leslie Brodie Report also managed to confirm that Haymet is presently employed at Los Angeles-based Phillips & Associates — a financial planning and fundraising counsel for not-for-profit institutions and organizations.

According to Phillips & Associates, “Tony’ principal responsibilities focus on our firm’s assignment in the development of a new non-profit organization at the Port of Los Angeles.”

The Leslie Brodie Report also managed to confirm that Hayment is also employed at Pegasus Capital Advisors — a private equity fund manager that has been providing creative capital and strategic solutions to companies across a variety of industries.

It was not immidietly clear what, if any, are Haymet’s plans as far as CleanTECH —  a private, non-profit member organization he launched in 2007.

Alliance of California Judges Directors Propose “Inoculation” Behind Leaked Document to Los Angeles Daily Journal (TLR Note: TLR Postulates Los Angeles Daily Journal Part of Scheme as Owned by Berkshire Hathaway’s Charlie Munger)

Dear Members and Others,

On August 16th, Alliance director Judge David Lampe requested Executive and Planning Committee chairman Justice Douglas Miller to make public the audit report of the AOC Office of Court Construction and Management prepared by Pegasus Global Holdings. A copy of that letter appears below.

Justice Miller declined to make that report public, indicating that it would be released in September, so we were surprised to learn yesterday that the summary of that report was somehow “leaked” to Daily Journal reporter Paul Jones. We include today’s Daily Journal story on that  “leaked” document.

We were not surprised, of course, by the summarized findings of the audit because we fully expected to see the same dysfunction, incompetence and lack of oversight in the multi-billion dollar court construction and maintenance program that we saw on display in the failed CCMS project.

As to who leaked this document, we will not speculate. As to why the document was leaked, we offer the following possible explanation: it is common to attempt to blunt negative press attention by leaking portions of an embarrassing report to a single reporter. Once that story runs the agency which is the subject of the report can claim that it’s now “old news” and that the recommendations in the report have been complied with. This tactic is often referred to as an “inoculation.” Whether or not this occurred in this instance, the Alliance will not be dissuaded from publicly disseminating the entire report once the Council sees fit to release it. Nor do we expect that the rather strange “leak” to a single reporter will dissuade other reporters in both the print and television media from reporting on yet another instance of Judicial Council and AOC mismanagement.

The common themes of this latest report, the State Auditor’s report on CCMS, the SEC report on the AOC, and the concerns raised by  hundreds of judges during the most recent public comment period all underscore the desperate need for the democratization of the Judicial Council. The 15 year experiment of centralized governance by unelected bureaucrats and the abdication of oversight by handpicked functionaries has significantly damaged the image of the judiciary. The lack of Council oversight of the AOC has become habitual and blatant, as yet another report has found. At some point we need to say enough is enough. Let’s hope that doesn’t occur after additional millions or billions of public funds are wasted.

Most of us know that OCCM can’t do any job that costs a hundred grand without spending three times that amount in getting it done. We know that the jobs are no-bid, cost plus contracts being steered to preferred vendors. We know that the director, Lee Willoughby is also the chair of western construction contracting consumers and was elevated to that position because he has the most money to spread around. Most other contractors look at WCCC.org as “pay to play” yet no one but us has cried foul.  Enclosed is a letter to the Judicial Council as well as the SEC and E&P committees. In light of the unprecedented court closures and revelations that OCCM is trying to sell off public assets while spending billions building new ones, the Pegasus Holdings report is essential in deciding the direction of OCCM programs.

Everyone knows this and that is probably why the report has not seen the light of day.

Dear Justice Miller:

I am writing on behalf of the Alliance of California Judges to request that the Judicial Council immediately make a public release of the Pegasus Global Holdings, Inc., report on the operations of the Office of Court Construction and Management. I make this request to you in your role as Chair of the Executive and Planning Committee based upon that committee’s authority under Rule 10.11(a) to act on behalf of the Judicial Council between meetings. It is our understanding that this report has issued internally. Even if the current version of the report is preliminary and not final, it is imperative that the preliminary findings of this consultant group be made public. Please do not treat this as a Rule 10.500 request. We are constitutional judicial officers, and we need this information in order to perform our duties for the reasons outlined below. Even draft versions of this report, once released to the AOC, need to be made available to the public and to judges. If the report is preliminary, it may be denominated as such.

The immediate release of this report is critical because the Court Facilities Working Group has invited public comment on the decision-making process and criteria to be used in re-evaluating 31 SB 1407 projects moving forward with limited funds. Comments are due on August 24, 2012 with public meetings scheduled on September 5- 7, 2012 with planned final recommendations by the end of September 2012. The committee expects to make its final recommendations to the Judicial Council by October 26, 2012.

The information in the Pegasus report is critical both to any public comment that would be made on the 1407 projects, and it is also fundamental to any decision to be made upon the recommendations of the Strategic Evaluation Committee. The SEC Report references the Pegasus study at Page 156, after noting substantial deficiencies in the performance of the OCCM.

Prioritizing the 1407 projects from an operational needs standpoint cannot be accomplished in a vacuum without full appreciation of the likely available cash flow from 1407 funds.  There are a number of fundamental deficiencies in the OCCM’s performance relative to likely available capital outlay and cash flow. First, the OCCM has not adequately considered the lack of available funds to maintain new courthouses once constructed, in light of the fact that the size of new courthouses will result in substantially increased costs of maintenance, identified to be at least $32 million more annually, which may have to be taken from 1407 funds. This problem compounds the fact that available funds for existing maintenance are already inadequate. Secondly, the OCCM may not have adequately taken into account available cash flow for the projects under consideration, particularly since there is likely to be an ongoing need to divert some 1407 funds to operations for the foreseeable future.

These discrepancies in the performance of the OCCM need to be addressed before any further decision can be made on prioritizing court construction projects. We are concerned that the court construction program may be headed in the same direction as the CCMS fiasco–a complete failure after a wholesale waste of public funds.  This would be disastrous to the branch on a number of levels.  We think that the Pegasus report must be released to judges, the public, to the Executive, and to the Legislature, in order for there to be a determination whether a public audit of OCCM is warranted, just as it was with CCMS. 

Rumors abound that the Pegasus report has been issued internally and that it excoriates the performance of the OCCM, and that the report is being withheld for that reason, or perhaps even being modified.  All interested parties need to be assured that this is not the case by an immediate public release of the report. It is unhealthy for this report to be withheld in light of the judiciary’s newfound commitment to transparency and open decision-making.

On Aug. 6, the Chevron refinery fire in Richmond billowed clouds of black smoke that could be seen across the bay. The next day, Richmond attorney Nick Haney arrived at his storefront office at 8 a.m. to discover a long line of prospective clients waiting. After giving some thought to whether he wanted to get involved, Haney decided he’d take on some clients if they had what he considered provable harm. He added some staff and put two handwritten signs in his storefront window saying “Chevron Fire Claims Here.”…..

Later that day, the State Bar showed up…..The investigators refused to speak with the press to explain their presence. So when they then physically entered Haney’s office, it appeared at least on one news report that evening, KTVU, that the State Bar had “raided” Haney. Haney told me later that at least a couple of clients asked him for their papers back, thinking that he was being investigated by the bar…..

OTC has long sent out investigators to disaster scenes, according to State Bar deputy executive director Robert Hawley. Hawley asserts that there are no specific protocols, guidelines or limitations on the investigators’ responsibilities beyond “educating the public,” and notes that the investigators most often learn of disasters from media coverage.

Hawley says investigators “always ask for permission” when entering a hospital or “community center.” But when asked whether they needed permission to hand out fliers to Haney’s potential clients or even to enter his office, he said “no.” When asked whether Haney’s storefront qualified as an accident “scene,” he argued that the term should be interpreted broadly, and that investigators should report to any “sites where solicitation was taking place.” But while there were indications of “runners” for other lawyers handing out fliers across the street, the crowd in front of Haney’s office was soliciting his services, not the other way around. When asked why the investigators failed to understand this, Hawley, who had touted their experience, noted that they are not lawyers.

How would the Office of Trial Counsel have responded? I don’t know. I attempted first to communicate with chief trial counsel Jayne Kim or her special adviser, former San Mateo County district attorney James Fox, but got a call back from Hawley that he would be my “contact person.”
