Barbara Sommer is a retired Lecturer in Psychology from UC Davis. Her love of mushrooms goes back to a first sighting in the mid-1970s. She had spent the first thirty years of her life never seeing a mushroom in the wild, and now, suddenly, they were everywhere! She is the Secretary/Treasurer of Sacramento Area Mushroomers (SAM), a member of the San Francisco Mycological Society (MSSF), and the North American Mycological Association (NAMA).

Hobbyist mushroomer for almost 40 years, Bob Sommer is the author of the column “Easy Edibles” for Mushroom, the Journal of Wild Mushrooming, plus mushroom articles in other local and national periodicals. He’s also the co-author of Field Guide to Mushrooms of Western North America (UC Press, 2012). Bob is Distinguished Professor of Psychology Emeritus, University of California, Davis where he taught the class Environmental Awareness. He chaired four departments (Psychology, Environmental Design, Rhetoric & Communication, and Art), although not all at the same time.

Yolo deputy charged with sexual battery Woodland A Yolo County deputy sheriff was arrested Friday on charges of sexual battery, false imprisonment and battery.

Davis police arrested Anthony Crisp, 28, when he arrived at work Friday. He was booked on suspicion of assaulting three women at a bar in Davis early Saturday.

Officer Marcia Sinclair said one 21-year-old woman had told police that Crisp came up to her after making several remarks and wanted to dance with her, then held her wrists until she broke away and fled to a nearby restroom.

Sinclair said two other women in the bar, both 22, then reported that Crisp had also grabbed them by the wrists and the buttocks.

Yolo County sheriff’s Lt. Jim Peeples said Crisp had been placed on paid administrative leave pending an internal investigation.

Purposes and Scope

The Davis Community Network, a non-profit regional organization established in 1994, creates public-benefit partnerships with government, education, business and the community in order to:

Ensure that people in the region benefit from opportunities the information age brings.
Promote access to electronic information and communication resources for all, protecting individual privacy and supporting free expression.
Develop and maintain public information resources that build a sense of community and reinforce democratic ideals.

Principles

Shared knowledge is a foundation of democratic society.
Information technology can enhance civic discourse and thus support democratic values and practice.
Universal and affordable access to information resources and tools is essential to meaningful, equal, public participation.
Privacy should be protected, and freedom of expression supported, in applications of information technology.
Information technology should be applied to the ideals of both the individual and society.

Alliance of California Judges on Auditing AOC; Copy of YR communication to Jeff Reisig Re Plan to Contact Dave Rosenberg, Lea Rosenberg, Yolo County Grand Jury President Barbara Sommer of Progress Ranch

Dear Members and Others,

We attach an editorial penned by Bill Girdner of the Courthouse News. Suffice it to say, our branch leaders have gotten the attention of those in the media who report on court cases and who believe in open government. The author voices a concern that we share — some of the reporting on the “$10 pay for view” proposal has appeared to cast blame on the Governor or his Department of Finance for this assault on the First Amendment and open government. That could not be further from the truth.

A Report to the Judicial Council dated December 14, 2012, lays out the council’s legislative priorities for 2013. On page 12 you will find language drafted by AOC staff amending the Government Code to charge the public $10 to view a “name, file, or other information for which a search is requested.” Our branch leaders standing by silently while the Governor and his Department of Finance are unfairly criticized for this gaffe hearkens back to the last time the AOC was caught attempting to gut Government Code sections concerning the management of the local trial courts. Then AOC staff affirmatively blamed the Department of Finance. Now, they seem content to allow a misleading impression to be made regarding the authorship of this misguided proposal.

We encourage you to read this report in its entirety, as it sheds additional light on what our handpicked leaders believe is essential in this year’s legislative session. We will point out only one additional item. On pages 7 and 8, the AOC proposes to defer audits for compliance with the Public Contracting Code unless specific funding is provided to the judicial branch to offset the cost for these audits.

As you know, the State Auditor recently released her audit findings of the first six local courts that were chosen to be audited. We learned from this audit that the AOC was up to its old tricks by providing incorrect data and excluding information required by the auditors. The six local courts were found to be substantially in compliance with the code. Ending the audits now would stop the State Auditor from auditing the “AOC and other judicial branch entities” as is required by December 15 of this year. It appears that the six local courts had the funds to pay for audits last year, but this year the central office appears to be broke and unable to afford an audit unless the General Fund provides the resources to do so. How convenient.
The Alliance believes that auditing the AOC is not a luxury that should only occur if extra funding is secured. Rather we believe it is of utmost importance that respected State Auditor Elaine Howle undertake this audit immediately. For those on the Judicial Council who champion and repeatedly claim that a new regime has embraced “greater transparency,” this proposal to kill off an audit speaks to their definition of transparency when it comes to their own operations.

In that suspicious transactions involving Judge David Rosenberg, Lea Rosenberg (“Rosenbergs”), Treasurer Victor Bucher, Cache Creek Casino and Barbara Sommer (President of Yolo County Grand Jury ; Progress Ranch) were recently unearthed, this will serve to place your office on notice of my plans to directly contact those individuals in furtherance of the inquiry.

The above will be contacted in their capacity as officers of various non-profit entities ( Davis Odd Fellows, Soroptimist International of Davis, Davis Rebekah Lodge, Progress Ranch) for the purpose of obtaining documents, dates, amounts, as well as other relevant information.

Specifically, a noticeable surge has been detected in the level of enthusiasm (i.e. fundraising, donations)  on the part of  Cache Creek Casino and Rosenbergs to benefit “foster youth” and/or “emancipated foster youth” in Yolo County.”

For example, Rosenbergs (at times, with the assistance of Judge Dave Reed, Treasurer Victor Bucher) raised funds to support foster youth by mobilizing Davis Odd Fellows (“Breakfast with Santa”), Soroptimist International of Davis (“Texas Hold ‘Em” ) and Davis Rebekah Lodge (“Crab Feed” ).

Subsequently, those funds were forwarded directly to Progress Ranch and/or  Yolo County Department of Employment and Social Services – The Homeless and Foster Youth Services of Yolo County,  which in turns forward sums to Progress Ranch pursuant to contractual agreement with Yolo County totaling around $800,000 per annum.

Likewise, Cache Creek Casino’s sudden interest in foster youth manifested itself with a  $48,500 donation.

Please observe that the inquiry is in its infancy, and stem from the fact that Progress Ranch President Barbara Sommer is also the President of Yolo County Grand Jury, as well as  the role of Victor Bucher as treasurer in various judicial elections.

Community Fund Supports Yolo Foster Kids

The Woodland Community College’s Foster & Kinship Care Education Foundation received a $48,500 donation from the Yocha Dehe Community Fund to serve Yolo County youth in foster care.

Kris Stanfill, YDCF Director stated, “The Committee is excited to be a part of supporting Yolo County Foster Care and the efforts to recruit and retain local families for local children.”

Historically, young people have had heartbreaking outcomes when exiting the foster care system; including high rates of homelessness, incarceration, early and unplanned pregnancies and unemployment, according to Stanfill.

“Tragically most foster youth suffer academically, have poor self-sufficiency, and few successful endings,” Stanfill stated.

With this support, the WCC Foster and Kinship Care Education program, “will enhance efforts to build a stronger network of local families willing to open their hearts to youth in need of safe and stable homes.”

“Ultimately, we hope to build a broader, more diverse pool of caregivers so that children placed into out-of-home care can continue to live in local families that are ready and able to meet their needs in homes that allow them to maintain their friends, schools and neighborhoods,” Schroeder stated.

Of the 250 dependents in Yolo County foster care, 65 are 16 to 20 years old, according to Schroeder.

Local foster families serve to support one another and connect regularly at ball games, barbecues, and holiday events.

Yolo County relieves foster youth’s transition to independence

Most teenagers anxiously await the day they turn 18, but not every young adult shares this same excitement. For foster youth, becoming a legal adult carries new responsibilities to lead an independent life.

In an effort to aid in the transition from out-of-home residencies to independent living, the Transitional Housing Placement Plus (THP-Plus) program helps emancipated foster children in 52 counties. The THP-Plus program offers affordable housing, furniture, assistance with enrollment in school and help finding a job to former foster children ages 18 to 24.

“It is the only program in the state that works to address homelessness in former foster youth,” said Amy Lemley, policy director for the John Burton Foundation. “I think it’s very scary for these teens. You can imagine the kind of panic and frustration that this creates for them. We need to fulfill our commitment to these young people the way a parent would support their child in this transition.”

The California Department of Social Services, John Burton Foundation and the Corporation for Supportive Housing established the statewide project in 2001. Yolo County implemented the THP-Plus program in 2008, providing affordable housing for foster youth in a subsidized, communal home in the city of Davis.

Youth in the 24-month program are given housing, furniture, food allotment, counseling, assistance with earning their GED if needed, a $50 monthly stipend and a trust account to help them save money for life after the program.

“Approximately 15 youth emancipate out of foster care in Yolo County each year,” said Nancy O’Hara, assistant director of Yolo County Department of Employment and Social Services in an e-mail interview. “Most have no where to live and no means of support at the time they are emancipated. The youth seem receptive and appreciative [of the THP-Plus].”

On July 1, however, the benefits of the program may be in danger if the state decreases its $172,000 allocation for Yolo County’s THP-Plus due to the California budget crisis.

“What little security they have had has been undermined by the recession,” Lemley said. “When we need it [the THP-Plus] most we see a proposal to eliminate it. As counties are more seriously affected by the recession, we see a kind of trickle down effect where counties have to decide what they do or do not want to do. It’s a tough decision for everyone.”

According to a 2002 study by the California Department of Social Services, every year in California over 4,200 young adults are dismissed from foster care, and two out of three end up homeless. Since its formation, the THP-Plus has been relatively successful – 85 percent of its participants retain housing and employment for at least one year after completing the program.

To help Yolo County’s local foster care, Soroptimist International of Davis held its annual poker tournament on March 6 at the Veterans’ Memorial Center.

“This type of issue isn’t on everyone’s radar,” said Lea Roseberg, president of Soroptimist International of Davis. “We wanted to bring it forth a little bit. I hope that these young adults know that there is a group out there that is supportive of their futures and that we care. Most of us have a mom or dad to help us get through college and pay for rent, but hopefully we can come in and help that Yolo County agency.”

About 80 percent of the profits collected were donated to the local housing program, the group’s primary project for the next couple years. Soroptimist will distribute the rest of the proceeds amongst other community projects.

“Each year, thousands of 18-year-olds find themselves totally on their own because they have aged out of the foster care system,” says Lea Rosenberg, a member of Soroptimist International of Davis.

“Suddenly, they must figure out how to live on their own, work out transportation issues, and find a job or enter college without the help of a trusted adult adviser. So, our club wants to make sure that the youth who age out of the foster care system in Yolo County know that there are adults who care about them and want to help them become self-sufficient.”

Soroptimists invite the public to help out by attending their annual “Spirit of the West” fundraiser on Saturday, Feb. 25, beginning at 5:30 p.m. at the Veterans’ Memorial Center, 203 E. 14th St. All proceeds raised through this annual event are used to support and assist young adults who age out of foster care.

The Davis Rebekah Lodge invites the public to its Second Rebekah Lodge Crab Feed to be held on Saturday, Feb. 2, starting at 5:30 p.m. at the Odd Fellows Lodge Hall, 415 Second St., Davis. The crab feed is a charitable fundraiser, open to the general public.

Only 160 tickets were printed for the crab feed, and less than 30 tickets remain. Tickets are only sold at the Avid Reader Active bookstore on Second Street. It is not anticipated that any tickets will remain to be sold at the door.

Tickets are $40 per person and participants will get lots of fresh cracked crab, pasta, salad, bread and drawn butter. The Rebekah Crab Feed also features a silent auction and a full no-host bar.

A raffle will also be conducted featuring a 24-bottle wine locker, including 24 bottles of fine wine.

All proceeds from the Rebekah Lodge Crab Feed will be used for the benefit of at-risk and foster youth in the Yolo County community.

Want to whisper your Christmas wishes in Santa’s ear early this holiday season? Then be sure to buy tickets for Breakfast with Santa, which go on sale Monday.

This year’s event, which features three seatings, will take place Saturday, Dec. 10, at the Odd Fellows Hall, 415 Second St. in downtown Davis.

Tickets are $8 per person and must be purchased in advance, at The Avid Reader, 617 Second St. in downtown Davis, and Common Grounds, 2171 Cowell Blvd. in South Davis. Seatings are at 8, 9:30 and 11 a.m.

“Only 120 tickets are available for each seating and they go really fast,” said event co-chair Barbara Geisler. In 2010, tickets sold out in 10 days.

Breakfast with Santa includes pancakes, sausage, orange slices and cinna-bread, a goodie bag for each child and an opportunity to take a photo with Santa.

Parents are encouraged to bring their own cameras to record their child’s moment with Santa and his elves.

The event is presented by the Davis Odd Fellows Lodge and Davis Rebekah Lodge, with food donations from the Davis Food Co-op, Woodstock’s Pizza, Kona Coast Food Products and Puroast Low Acid Coffee.

“The 175 members of the Davis Odd Fellows Lodge look forward to Breakfast with Santa every year because it brings so much joy and pleasure to the children and families who participate,” said Dave Reed, Noble Grand of the lodge.

Proceeds from the event will support emancipated foster youths as they transition to adulthood and Progress Ranch, a group home for foster boys in Davis.

Cache Creek Casino: Traffic, crime, but oh the money

Cache Creek Casino has brought some prosperity to the region, but the grand jury noted the negatives in its report. By ERIN TRACY / Daily Democrat 07/09/2010

The Cache Creek Casino Resort attracted patrons who fueled the economy, which led to improved emergency services, but ultimately traffic congestion, noise, and crime beyond remediation, according to a 2009-10 Yolo County grand jury report.

The grand jury, which released its report last week, found better communication between Yolo County and the Yocha Dehe Wintun Nation, as well as stronger oversight of tribal mitigation dollars, would likely improve the situation.
It’s hard to deny the economic impact of the 414,110 square-foot facility, which is the county’s largest employer. The tribe annually awards $200 million in vendor contracts, $40 million in payments to the county and state, and $3 million in donations to local civic organizations, the report stated.
The casino’s annual earnings, which go to YDWN members, are kept confidential by the sovereign nation but the grand jury estimated the reservation is home to fewer than 25 members and their children.
“These individuals are the direct and highly-compensated beneficiaries of the profits from the casino,” the report states.
Representatives of the Tribe declined to be interviewed or answer written questions submitted by the grand jury, citing sovereignty rights. Representatives also did not respond to inquires about the report before deadline.

Increased road use

Perhaps the biggest complaint among residents in the Capay Valley is the increase in traffic along Highway 16. Saturdays are the busiest day for travel, with more than 13,000 travelers heading to the casino, the report stated, which is a 69 percent increase between 2002 and 2006.
All casino feeder roads meet capacity limits established by the state and county and studies conducted for the 2030 General Plan and by the citizens group, Capay Valley Vision, expect traffic on the roads will exceed capacity by 2013.
In a 2002 Memorandum of Understanding between the tribe and county, YDWN promised to implement a shuttle service to mitigate traffic issues. The tribe agreed to pay the county to construct a park and rides facility for patrons and employees, and make the use of its service mandatory for workers. Neither the service nor the policy has been implemented and only 18 percent of employees currently use public transportation, according to the report.
The influx of casino visitors yielded a doubling of Sheriff’s deputies in the area, but the majority of casino related crimes continue to increase. According to the report, between 2002 and 2006 DUI arrests increased 1,050 percent, assaults and weapons arrests increased 2,900 percent and Felony Burglary increased 900 percent.
How the cash is divided

The sheriff’s department has received the lion’s share of mitigation funding to county department, with $3.46 million since 2002. Despite this majority funding, the county estimates its law enforcement related workload — comprised of efforts from the Sheriff’s Department, District Attorney and Public Defender’s office — is under-funded by about $600,000.
In total, the tribe has paid $32.9 million to the county: $10.6 million has gone to specific departments, $15.5 million to the general fund, $6.4 million to community residents and specified projects along the Highway 16 corridor, and $.4 million to reserves. The department allocations also include $1.2 million for negotiations and arbitration over the tribes proposed 2008 expansion, which was abandoned in October 2009.

The distribution and oversight of those funds for community projects were called into question by the Yolo County grand jury.
The Advisory Committee on Tribal Matters was established by the Board of Supervisors to recommend applications for tribal mitigation. The grand jury found questionable spending and conflicts of interest among its nine members.
At least two of the board members voted on proposals either because they, or their spouse, “held a leadership role in a recipient organization.”
The Board of Supervisors also took recommendations that limited funding to residents between Interstate 505 and the casino, precluding mitigation for many other towns along the Highway 16 corridor, including Woodland. The majority, 38 percent, of the funds went to Esparto and the were increasingly used for economic and community development rather than mitigation like road repair.
According to the report, the committee’s board minutes reflect that its members, “inaccurately believe ACTM funds are theirs to control … ignoring other county priorities or other casino-related mitigation needs outside the valley.”
County Tribe Coordinator Christopher Lee said, “The county is taking the findings of the grand jury seriously and will respond the them in full and we will have more information at that time.”

In an almost unprecedented turn of events and somewhat ironically, a local official in the State of California who represents the government in the prosecution of criminal offenses is now accused of criminal conduct.

Court documents filed with the United States District Court for the District of Columbia reveal that the highly controversial District Attorney of Yolo County Jeff Reisig is accused of violating the Racketeering Influenced and Corrupt Organizations Act.

RICO is a federal law that authorizes a civil cause of action for acts performed as part of an ongoing criminal organization. RICO focuses specifically on racketeering, and it allows for the leaders of a syndicate to be held civilly liable for the crimes that they ordered others to commit or which they assisted in committing.

The lawsuit, filed as a civil-racketeering action by Marina Del Rey-based legal scholar Daniel Dydzak, alleges that Jeff Reisig and his deputies/investigators engaged in an “unlawful search and seizure” and that Mr. Reisig and State Bar of California employee Tom Layton (who according to sources is part of an ongoing “ambulance chasing” scheme the Girardi Syndicate operates in San Bernardino County vis-a-vis a satellite office located in San Bernardino and managed by Thomas Girardi’s son-in-law, David Lira) shared with third parties materials obtained during the search.

The suit further alleges that Reisig conspired to participate in a RICO enterprise, as well as participated in the commission of two or more racketeering activities acting as “accomplice.”

A big red flag has been reluctantly raised over Yolo County District Attorney Chief Investigator, Bruce David Naliboff.

The rapidly expanding multi-prong civil inquiry, conducted by Yolo County’s YR, views Naliboff  —  an Ex-Lieutenant  of  UC Davis Police Department — as someone who may potentially have a played a greater role than had been perceived up to now.

YR maintains that one aspect of the inquiry into CaliforniaALL /  University of California  involves 4 subparts:

1) Circumstances surrounding events relating to UC Davis / UC Davis Foundation operatives Cruz Reynoso, Mark Friedman , Gilles Attia.

2) Circumstances surrounding events relating to UC Irvine / UC Irvine Foundation operatives Joe Dunn of Cal Bar/ Voice of OC, Judicial Council’s Mark Robinson, Erwin Chemerinsky of Voice of OC, Michael Drake, and Karina Hamilton.

3) Circumstances surrounding events relating UC Berkeley / UC Berkeley Foundation operatives Freada Kapor Klein and Gibor Basri.

4) Circumstances surrounding prima-facie evidence of criminal conduct by Bruce Naliboff, Michael Cabral, and Jeff Reisig.

In connection with Sub-Part  #4, special attention is being paid to the examination of fraud on the court, obstruction of justice, aiding and abetting in the obstruction of justice, and related irregularities.

Per YR, Sub-Part #4 is being carefully reviewed because it involves “Public Corruption,” which poses a fundamental threat to our way of life. Such wrongdoing impacts everything from how well our community is protected to verdicts handed down in courts, as well as the quality of governmental services. This, YR maintains, can take a significant toll on the American way of life.

Yolo County officials troubled by Cache Creek Casino’s tribe land-trust plan

The plans envision new homes, a school and a water treatment plant for a growing population, new buildings to house its government and sites to honor its history and culture.

But the Yoche Dehe Wintun Nation’s application to take more than 850 acres near its signature Cache Creek Casino Resort into federal trust has troubled its Capay Valley neighbors and Yolo County leaders. They are demanding a closer look at the tribe’s request.

The tribe owns the land’s 15 parcels, scattered orchards and grasslands along Highway 16 but would relinquish the property to the federal government if the trust application is approved.

In a federal trust, the government holds legal title to the property, but the tribe is the beneficiary. Such an arrangement would give the tribe more freedom to determine land use.

But Yolo leaders say the acreage is far too large – they want the tribe to agree to 100 acres. They have questions about what might be built on the land and suggest its effects on the Capay Valley could be too great.

Yolo supervisors challenge federal jurisdiction over the property. They say it would take away the county’s ability to plan for how the land will be used in the future, limit their ability to protect its agricultural designation and strip neighbors’ ability to plan for any future impacts of tribal development.

“We can’t identify a reasonable purpose for that transfer. … We think there’s a legitimate purpose in transferring the property, just not all of it,” said county Supervisor Don Saylor. “We have to wonder what future use might be anticipated.”

The Yocha Dehe insist their plans for the land extend to housing and community buildings and agriculture.

Yocha Dehe leaders were not available for comment, but in a statement, spokesman Greg Larsen told The Bee that the tribe had hoped for the county’s support.

“Yocha Dehe had nearly two years of good-faith discussions on these issues with county staff and believed we were close to a successful agreement on the key terms,” Larsen said. He said supervisors backed away from an agreement.

Both sides agree that the Yocha Dehe have had a long, collaborative and lucrative relationship with Yolo County. The tribe is the county’s largest private sector employer; its economic and philanthropic impact on Yolo County is in the tens of millions of dollars. It has also launched forays into olive oil production and winemaking.

Thaddeaus Barsotti, an owner of Capay Organic in Brooks, said the Yocha Dehe have been able to keep a focus on agricultural ventures and maintain the rural character of the community. “The casino’s not going anywhere, but I think they’ve done a good job of mitigating that where possible,” Barsotti said.

But two years of talks over the land proposal threaten to fray that bond between county and tribe. Yolo County leaders are skeptical and – after a Bureau of Indian Affairs finding in October that the tribal land plan would have no significant environmental impact on the area – angry.

Saylor was quick to laud the Yocha Dehe’s “amazing contributions” to Yolo County and the tribe’s collaboration with the county over the years, but said the land request “is a blow to that collaboration.”

The Board of Supervisors aired its concerns in a strongly worded letter Jan. 25 to the Bureau of Indian Affairs. “The county’s concern about the Tribe changing its plans in the future is not speculative,” the county’s letter read, adding that agricultural land that is part of the proposal could also be converted to other uses.

“Given the other paths available to the tribe … the county is deeply concerned that in the future these existing agricultural parcels may be converted to some other use.”

Bureau of Indian Affairs officials say the environmental assessment is just a preliminary step.

 Lauren Redfern, a former female Basalt High School gym teacher who had been charged with sexual assault on a student, was sentenced, but faces no prison time.

Lauren Redfern, 26, was sentenced Tuesday.

Redfern, 26, was arrested after she was caught by the school’s athletic director having sex with a student in the teacher’s restroom. At the time Redfern was charged with two felony counts of sexual assault on a child by a person in a position of trust with a pattern of sexual abuse, a class 3 felony.

“They were caught in a room they shouldn’t have been in together and that’s what started this investigation. And they admitted what was going on,” Eagle County Undersheriff Mike McWilliams told CBS4 shortly after Redfern’s arrest. Please continue @: http://tinyurl.com/ctcqgr9

Howard Dickstein / Jeannine English

Sacramento-based lobbyist Jeannine English — who served as a “public member” of the State Bar of California Board of Governors since 2006 — is no longer part of the board, TLR has learned.

English is married to Howard Dickstein –  a widely-known but controversial figure within California’s Tribal Gambling industry.

Recently, both Dickstein and English were named as defendants in two separate RICO suits —  advanced by  Spire Law Group and Dan Dydzak.

Dickstein , who is no stranger to litigation, has been previously named a defendant in a suit advanced by his client, members of the Yocha Dehe Wintun Nations (formerly known as the Ramsey Band of Wintun Indians), which owns and operates the Cache Creek Casino in Brooks, California, an unincorporated community in Yolo County.

In that action, the plaintiffs — who were represented by Sonnenschein Nath & Rosenthal, Cotchett, Pitre & McCarthy and legal ethics expert Michael Boli — alleged that Dickstein engaged in myriad fraudulent conduct, concealment, conversion (i.e. a non-criminal term referring to the act of theft), breaches of fiduciary duties, misrepresentations, and unjustly enriching himself with tribal money by defrauding the tribe of millions of dollars over more than a decade.

In statements to the media, Howard Dickstein referred to the allegations as a “pack of lies,” while disparaging his client. Dickstein also stated that he plans to fight the suit and “fight hard.” Appearing on behalf of defendant Dickstein was Elliot Peters of Keker & Van Nest.

TIMELINE 2009: Yolo County’s Cache Creek Casino bets on expansion as revenue drops (TLR Note: Notice name of Bill Schreiber — one and same Bill Schreiber of Porter Novelli?)

The glitz, the stuffed buffet tables and even the thrilling clang of jackpots can’t disguise one thing: Local casinos are taking a hit.

Because of the recession and a general malaise in consumer confidence, gambling revenue at local tribal casinos is down, said Jason Dickerson, gambling policy analyst for the state.

“After a decade or more of strong growth in the industry, customers have pulled back on gambling,” said Dickerson, who works for the state Legislative Analyst’s Office. Dickerson said the local cutbacks are following a trend of “sharp retrenchment” statewide, nationally and even globally. “We’re finding that gambling is ultimately an entertainment product, and there’s been a broad pullback in consumer discretionary spending.”

The four tribal casinos in the Sacramento region — Jackson Rancheria Casino & Hotel, Cache Creek Casino Resort, Thunder Valley Casino and the recently opened Red Hawk Casino — won’t say if revenue has fallen, but said no layoffs are scheduled. But some casino officials admit at least a flattening in demand.

Financial records at tribal casinos are confidential, but Dickerson doesn’t doubt the slowdown in Indian gaming revenue. Even the governor’s budget reflects smaller contributions from tribes with casinos. With demand and revenue shrinking, tribal casinos are likewise halting or scaling back lavish expansion plans and beefing up marketing efforts to ride out the tough times.

In Southern California, employees are being laid off because of reduced revenue and traffic. He hopes it proves that Californians shouldn’t rely on tribal payments to state coffers.

“Some have thought that tribal payments would be a panacea, a great source of growth for many years, and we’re seeing that that’s flawed, that casinos are susceptible to economic conditions and are not going to grow infinitely,” he said. “Casinos will never solve our budget problems, it’s a miniscule component of our budget.”

Expansion on hold

One of the most visible examples of the downturn in gambling is at Thunder Valley in Lincoln, where construction on a planned ambitious expansion stopped in November. Thunder Valley spokesman Doug Elmets said the tribe, the United Auburn Indian Community, originally planned to add a 23-story hotel, nine-story parking garage, performance venue, childcare room and video game arcade.

“They put the expansion on hold three to six months to reassess the scope, given the uncertain market demands,” Elmets said. “They’re looking at whether they need as many square feet, number of suites and parking spaces as was originally planned.”

Elmets said the reassessment of the expansion is not a result of competition from the newly opened Red Hawk Casino on Highway 50 in Shingle Springs. In fact, he said, the hoopla surrounding Red Hawk’s Dec. 17 grand opening and advertising for the new casino has strengthened the regional gaming market overall. Still, he said the flagging economy has impacted Thunder Valley’s bottom line.

“The economy is affecting casinos,” Elmets said. “Casinos are not immune to what is happening in the general economy. We find the same number of customers are coming to Thunder Valley, but spending less than last year.”

Strong regional market

Elmets pointed out that even though visitors might be more frugal, the Sacramento gambling market is “ripe for maturity,” since 5 million people live within a 100-mile radius of Thunder Valley and Red Hawk, and 60 percent of the residents in the market area are adults over 21.

“All the reports we’re hearing is that the gaming market in Sacramento has been one of strongest investments in the U.S. for decades, because Sacramento has historically been one of the biggest feeder markets to casinos in northern Nevada,” Elmets said.

Rich Hoffman, chief executive officer of Jackson Rancheria in Amador County, said Red Hawk’s opening caused a brief bump in business at the older foothills casino, thanks to overall awareness being raised by the extra advertising. Hoffman said 2008 gross revenue at Jackson Rancheria was up about 4.5 percent over 2007, but when the cost of living and increased expenses were factored in, “it’s pretty much a push.” The casino historically has seen steady growth, so he characterized 2008 as a “slowdown for us.”

“I feel good about that when I think about where some our colleagues in the state are,” Hoffman said. “Many casinos are seeing double-digit drops in revenue, so I feel very fortunate. Especially in more mature markets in Southern California, they’re taking a beating.”

Building a destination

Cache Creek Casino Resort in Yolo County is also feeling the pinch of consumers spending less.

“The slowdown in the economy has had some impact on our business, as it has on every other business in the country,” Cache Creek general manager Randy Takemoto said in a prepared statement. “We have found we have slightly fewer customers than in prior years, though there has been a noticeable drop in spending.”

That pinch, however, hasn’t dampened Cache Creek’s plans to expand. Takemoto said the tribe re-evaluated plans for its “destination resort project” and found it still made sense. The expansion will include a spa, golf course, additional restaurants and entertainment venues.

Yolo County supervisors are challenging the project because of environmental concerns, including increased traffic on Highway 16. The tribe and the county recently went to arbitration over the disputed expansion project.

Takemoto said the Cache Creek expansion would create 1,000 new jobs at the casino, to add to the 2,500 current positions, “as well as hundreds of construction jobs in the heavily impacted building industry.” Cache Creek spokesman Bill Schreiber said Yolo County’s unemployment rate is more than 9 percent, and the proposed expansion could infuse $95 million into the local economy.

There is an organization called the California Protocol Foundation – it is a 501(c)3 that is housed in the exact same address and suite as the California Chamber of Commerce.

The California Protocol Foundation appears to have been used as a conduit for Arnold Schwarzenegger’s travel expenses while he was governor.

Where does Dan Maguire come in? Dan Maguire is an inexperienced civil law attorney that Arnold appointed to the bench in Yolo County. Dan Maguire was one of Arnold’s closest attorneys in the days of his administration.

Dan Maguire is running for re-election as Judge and was appointed apparently as a payoff by Arnold for his years of loyal service as Maguire apparently never prosecuted or investigated a felony case in his legal career. (With one big exception – to be discussed later)

Archived articles obtained by this blogger show that Dan Maguire was up to his neck in a scandal (one of many that beset Arnold’s administration) related to using the CA Protocol Foundation as a conduit for paying for Arnold’s Private Jet. The totals are staggering – as much as $1.7 million a year to fly all around the world.

Schwarzenegger’s abuse of Non-Profit rules led to ethics reform that Dan Maguire fought against.

Beginning in coming weeks, contributions to nonprofits that are directed to a specific public official will be limited to $420, making it illegal to solicit large donations to pay for chartered jets to China, Europe and the Middle East, as Schwarzenegger has done in the past.

Although the new rules might not affect Schwarzenegger’s travel plans, his lawyer (Dan Maguire) says he will have to be mindful of the regulation as he raises money for a climate summit he has scheduled for late September in Los Angeles.

Donors to the Protocol Foundation contributed more than $1 million for a similar conference last fall, state records show, including $250,000 from the Aga Khan Development Network, a charity run by the spiritual leader of Shiite Muslims. That was the largest single gift to the foundation on Schwarzenegger’s behalf in 2009, according to the records.

Under the new regulations, the Aga Khan could still pay for general production costs at the conference, but “he couldn’t pay for someone’s travel” or anything else that could be construed as a gift to an individual, said Schwarzenegger lawyer Dan Maguire.

hmmm…  Dan Maguire was Arnold’s travel agent. It appears that he used to arrange travel for the former Governor to all parts of the world while the rest of us dealing with the financial train wreck the Governor created in California.

Corrupt California Governor Jerry Brown Appointes Fred Hiestand — Attorney for Jessica Tavares of Thunder Valley Casino — to Alcoholic Beverage Control Board

According to MetNews Staff Writer, Gov. Jerry Brown yesterday named prominent Sacramento lawyer Fred Hiestand to the Alcoholic Beverage Control Appeals Board.

Hiestand, 69, has been president of Fred J. Hiestand APC since 1978. He is also the general counsel and top appellate lawyer for the Civil Justice Association of California, a tort reform group, which he frequently represents before the state Supreme Court.

He was an attorney at Coppelman and Hiestand from 1974 to 1977, at Public Advocates from 1972 to 1974 and at California Rural Legal Assistance from 1968 to 1972. He advised Brown on medical liability issues during Brown’s first tenure as governor.

Hiestand earned a law degree from UC Berkeley.

This position requires Senate confirmation and the compensation is $25,500. Hiestand is a Democrat.

Since 2006, Jeannine English has served as a “public member” of the State Bar of California Board of Governors, an otherwise governmental entity primarily responsible to disciplining errant lawyers.  Despite allegations that Dickstein has committed countless acts of grave misconduct and ethical breaches, Dickstein has never been disciplined by the State Bar of California.  English’s appointment as a public member was courtesy of her California Democratic Party confederates who control California’s legislative branch.

Unfortunately, the two U.S. Senators from California refuse to become involved in these issues despite the fact that  tribal matters fall primarily within federal oversight. Dickstein, in his role as counsel for the tribes, has overseen the tribes’ contributions of millions of dollars to the coffers of the Democratic Party.

Fortunately, Republican Arizona Senator John McCain recently stepped in and called for an investigation of Howard Dickstein.  Similarly, a few months prior to Senator McCain’s announcement, a Yolo County-based rabbi asked the State Bar of California Board of Governors to investigate English and Dickstein.

The J Street Gang of Greed

In approximately 2004, as part of an effort to revitalize its downtown area, the city of Sacramento poured three million dollars into subsidies for the renovation of the “Elliott Building” located at 1530 J Street in Sacramento.  The project was initiated by Mark Friedman of Sacramento-based Fulcrum Property Group and a few of his business partners.

Friedman, a man of despicable character, may be a stranger to readers, but he is no stranger to The Leslie Brodie Report given that he was one of the  named defendants in the case of Rumsey vs. Dickstein, which deals primarily with allegations of years of fraud and deceit by Dickstein against his client, the Yocha Dehe Wintun Nation.

One example of such a scheme allegedly perpetrated by Dickstein and Friedman against the tribe deals with a parcel of land situated in West-Sacramento  known as “The Triangle,” an otherwise prime location facing the Sacramento River.

The tribe was urged by defendants Dickstein and its financial advisor Arlen Opper to enter into yet another business relationship with Friedman, through which a parcel of land in “The Triangle” was purchased.  The tribe would own 50% and Friedman and his extended would own 50% of the property.

At one point, Mark Friedman asked the tribe for a favor (or as he put it, an “accommodation”), by which the tribe would sell and Friedman would purchase the tribe’s 50% share in “The Triangle.”

Friedman’s excuse  for seeking the “accommodation” was very simple — he wanted to reduce the amount of money he would  owe the Internal Revenue Service.  Friedman had just sold a different piece of real estate, and  needed to quickly invest the money in real estate (or as he referred to it, to “park” the money ) in a separate property for a period of several years as is allowed by IRS rules; at the period, the tribe would be allowed to buy the property back for the same price for which it was sold to Friedman per a “buy back option.”

Dickstein and Opper recommended that the tribe “accommodate” Friedman, and Friedman consequently purchased the property from the tribe.

Per their written agreement, the tribe was given the option to buy back the property within one year.  However, the tribe did not buy back the property within one as  a result of a failure by Arlen Opper and Howard Dickstein — the attorney for the tribe who was in possession of the written agreement — to inform the tribe when the time period expired so that the tribe could buy back the property.  Notably, the property had increased in value “exponentially” during this period.

Later,  after the “buy back option” had expired, the tribe realized that it had missed the deadline to buy back its 50% share of the property, and sought to do so at that time.  However, Mark Friedman refused to sell it back, claiming that the tribe had missed its deadline.

Members of Pala Band of Mission Indians Unite to Oppose Howard Dickstein

Howard Dickstein, a widely-known but controversial figure within California’s Tribal Gambling industry, is against at the center of controversy stemming from recent events involving San Diego-based Pala Band of Mission Indians.

Specifically, the recent arrest of Pala Vice Chairman Leroy Miranda — a proxy and yes man of the Dickstein machinery — prompted members to complain again about the lack of independent, quality leadership.

Miranda, no stranger to the penal system, was convicted in 2010 for soliciting sex while at a book store in Moreno Valley.

Tensions ran high also during the October nomination of Executive Committee candidates when members complain of the abuse, greed, divisive tactics, and financial atrocities Howard Dickstein has been inflicting on the tribe.

The Pala is governed by an Executive Committee composed of six members elected by the General Council. Elections are held every 2 years during the month of November.

Lending significant support to calls for an examination of corruption by Howard Dickstein of Dickstein & Zerbi,  a sharply-worded complaint was filed recently with the National Indian Gaming Commission.

In that complaint, members of the United Auburn Indian Community minced no words in accusing Dickstein of abuse and financial atrocities.   United Auburn Indian Community operates the Thunder Valley Casino, situated between the cities of Roseville and Lincoln, in Placer County, California.

The lawsuit alleges that Dickstein and English executed a scheme that caused injury to the Plaintiff, a Southern California resident who claims his privacy and constitutional rights were “egregiously violated.”

Specifically, the suit alleges that in order to camouflage a scheme and make it appear as though it is purely a mundane action by a governmental agency and was not designed to conceal Dickstein’s and English’s own acts of malfeasance, greed, and betrayal, defendants resorted to abusing their considerable “political and legal clout.”

This clout was presumably obtained as a result of the funneling of hundreds of millions of dollars from myriad Tribal Casinos to various state and local governmental agencies/officials, as well as from English’s position as a member of the State Bar of California Board of Governors, and the fact that the president of the State Bar of California, Jon Streeter, and his firm of Keker & Van Nest, represent Howard Dickstein. This , the plaintiff alleges, shows “malice and oppression” on the part of defendants sufficient to justify an award of punitive damages.

Dickstein , who is no stranger to litigation, has been previously named a defendant in a suit advanced by his client, members of the Yocha Dehe Wintun Nations (formerly known as the Ramsey Band of Wintun Indians), which owns and operates the Cache Creek Casino in Brooks, California, an unincorporated community in Yolo County.

In that action, the plaintiffs — who were represented by Sonnenschein Nath & Rosenthal, Cotchett, Pitre & McCarthy and legal ethics expert Michael Boli — alleged that Dickstein engaged in myriad fraudulent conduct, concealment, conversion (i.e. a non-criminal term referring to the act of theft), breaches of fiduciary duties, misrepresentations, and unjustly enriching himself with tribal money by defrauding the tribe of millions of dollars over more than a decade.

While the suit was pending, further allegations of grave misconduct were leveled against Dickstein and his attorneys of San Francisco-based Keker & Van Nest including claims that evidence was “manufactured.” Later, Dickstein and his lawyers of Keker & Van Nest (presumably, John Keker, Elliot Peters, and Jon Streeter) falsely advertised and misled the public into believing that the Yocha Dehe tribe had only sued Dickstein for conduct which was “negligent” in nature. Dickstein and his legal team neglected to reference the allegations of defrauding the tribe of millions of dollars over more than a decade through fraudulent conduct, concealment, conversion, breaches of fiduciary duties, and misrepresentations which the tribe had leveled against their own attorney.

Judicial Council Watcher on Diversity as Tool to Sabotage SEC Report ; Is Yolo County DA Jeff Reisig Assisting Keker & Van Nest and Client Dickstein to Sabotage Inquiry of Yolo County-Based Rabbi Into CaliforniaALL; Tony West Asked to Admit

You see, the AOC didn’t employ many african americans or latinos to begin with. So when the layoffs came down recently, african americans were disproportionately let go by huge percentage points. This was confirmed by one special AOC employee that submitted a comment about diversity with respect to the SEC report and unintentionally undermined all of the hard work of the Ministry of Truthiness, duly earning himself a position in Judicial Council Watcher’s Hall of Fame by accident no less.

Well as you were made aware in the last communique from the Alliance of California judges and the 10 news report, the Ministry of Truthiness is too busy with the budget cuts to talk to any television reporters but Leanne Kozak has the time to respond to the news report with a crock of B.S about telecommuting “facts” that would and should never apply to anyone like Todd Torr.

What is it that has the AOC’s Ministry of Truthiness so busy?

It would be untoward for judges and justices that sit on the judicial council and chair its various committees to come out and directly torpedo the SEC report to protect their own self-interests. The best alternative any media consultancy will tell you is to torpedo the SEC report by proxy so that your hands appear clean.  This is what currently has the Ministry of Truthiness and a few committee chairs and co-chairs on the judicial council so busy. They only have seventeen days left to torpedo this report so they’re pulling out all of the stops.

The Judicial Council and the AOC’s media arm has a considerable reach because they, much like us, have worked in media and communications. So the best thing they can do is get media coverage for outside opposition to the SEC report and get it airtime and web time. Get people all freaked out that implementing the SEC’s recommendations will cut off your access to the courts and lawyers, result in unfairness and give us a bunch of WASP judges.

Right now, they’re trying to sell this story in advance to their loyal media outlets. Meanwhile, the committee chairs, co-chairs and liaisons are enlisting the state bar members to torpedo the SEC report and create the very news that the AOC is trying to sell.

At the time my property was seized in February 2012, your
investigators told me that your office would be making a copy of the
hard drive and then promptly return the items. That has not occurred
Also, by my estimate, the 140 day period from the execution of the
search warrant runs this week. Do you by any chance know when I will
get my property back?

The property is needed because months before you were contacted by Jon
Streeter, I had notified various authorities about myriad suspected
financial schemes and ethical breaches (i.e. matters involving In Re
Thomas Girardi, CCPF, Voice of OC, Howard Dickstein, Jeannine English,
Fogel vs. Farmers, CaliforniaALL, etc.).

The Federal Bureau of Investigation has already contacted me twice
within the past few weeks seeking information, and I had no choice but
to inform them to expect delays. (mainly because of recent new
discoveries, and because your office is still in possession of
important evidence I had gathered which may criminally implicate Tony
West, Jeffrey Bleich, Kamala Harris, Geoffrey Brown, Joe Dunn, Jim
Brosnahan, Ruthe Catolico Ashley — a close personal friend of Chief
Justice Tani Cantil, Jon Streeter, and Jon Streeter’s associate from
Keker & Van Nest, Chris Young)

Also, please note that if and when the materials are returned , I ask
that special arrangement will be made. Simply put, the fact that Jon
Streeter asked your office to file criminal charges against me and
went to such lengths to ensure that a search warrant is executed, and
my suspicion that at least one of the investigators who were at my
home was from a separate agency (most likely Tom Layton), serves as
further proof that I have stumbled upon something important.

As such, after the execution of the search warrant I continued with
the inquiry only to unearth the suspected involvement of Tony West and
Jeffrey Bleich, and later Kamala Harris and Chris Young. As such,
since the stakes are high, I want to take all necessary precautions
and not use any computers which your office seized, and would like to
arrange for the materials to be returned to a computer shop at which I
will only copy various files, and will arrange for destruction of all
those computers that may have been infected with viruses, spywares,
etc.

Additionally, in the event that third parties came into possession of
any of the seized property or information (i.e. agents of California
Attorney General Kamala Harris or the State Bar of California, such
as Tom Layton), or any copies of the materials, please let me know.

Moreover, please note that due to the totality of the circumstances,
I am working under the assumption that the substantial monetary
payments clients of Howard Dickstein (Cache Creek Casino, Yocha Dehe
Tribe) contribute to your office interfered with your judgement.

Finally, this email is sent with a full reservation of all rights to
object in the future to the use of any of the materials and evidence
seized, including but not limited to objections as to various
privileges.

The abuse and financial atrocities by attorney Howard Dickstein (on behalf of himself, as well as others) against his clients — Native Americans who are members of various Indian tribes operating casinos in the State of California — are well documented.

Hard hit were the Yocha Dehe Wintun Nation which operates the Cache Creek Casino in Yolo County, the Pala Band of Mission Indians which operates the Pala Casino Resort & Spa in San Diego County, and the United Auburn Indian Community which operates the Thunder Valley Casino in Placer County.

One such incident resulted in the emotionally distressing injustice inflicted on the bona fide founder of Thunder Valley Casino, the ex-chair of the tribe, Jessica Tavares.

Jessica is a proud visionary who was the force behind the economic and cultural revival of the tribe — as well as the revival of surrounding communities.  Sadly, Jessica was ultimately betrayed by a fellow member of the tribe and placed on the proverbial iceberg because she chose honor, integrity, and dignity for herself and for the tribe over the greed and divisiveness promoted by Howard Dickstein in his quest to obtained millions for himself and by extension for his wife,  Jeannine English.

Since 2006, Jeannine English has served as a “public member” of the State Bar of California Board of Governors, an otherwise governmental entity primarily responsible to disciplining errant lawyers.  Despite allegations that Dickstein has committed countless acts of grave misconduct and ethical breaches, Dickstein has never been disciplined by the State Bar of California.  English’s appointment as a public member was courtesy of her California Democratic Party confederates who control California’s legislative branch.

Unfortunately, the two U.S. Senators from California refuse to become involved in these issues despite the fact that  tribal matters fall primarily within federal oversight. Dickstein, in his role as counsel for the tribes, has overseen the tribes’ contributions of millions of dollars to the coffers of the Democratic Party.

Fortunately, Republican Arizona Senator John McCain recently stepped in and called for an investigation of Howard Dickstein.  Similarly, a few months prior to Senator McCain’s announcement, a Yolo County-based rabbi asked the State Bar of California Board of Governors to investigate English and Dickstein.

The J Street Gang of Greed

In approximately 2004, as part of an effort to revitalize its downtown area, the city of Sacramento poured three million dollars into subsidies for the renovation of the “Elliott Building” located at 1530 J Street in Sacramento.  The project was initiated by Mark Friedman of Sacramento-based Fulcrum Property Group and a few of his business partners.

Friedman, a man of despicable character, may be a stranger to readers, but he is no stranger to The Leslie Brodie Report given that he was one of the  named defendants in the case of Rumsey vs. Dickstein, which deals primarily with allegations of years of fraud and deceit by Dickstein against his client, the Yocha Dehe Wintun Nation.

One example of such a scheme allegedly perpetrated by Dickstein and Friedman against the tribe deals with a parcel of land situated in West-Sacramento  known as “The Triangle,” an otherwise prime location facing the Sacramento River.

The tribe was urged by defendants Dickstein and its financial advisor Arlen Opper to enter into yet another business relationship with Friedman, through which a parcel of land in “The Triangle” was purchased.  The tribe would own 50% and Friedman and his extended would own 50% of the property.

At one point, Mark Friedman asked the tribe for a favor (or as he put it, an “accommodation”), by which the tribe would sell and Friedman would purchase the tribe’s 50% share in “The Triangle.”

Friedman’s excuse  for seeking the “accommodation” was very simple — he wanted to reduce the amount of money he would  owe the Internal Revenue Service.  Friedman had just sold a different piece of real estate, and  needed to quickly invest the money in real estate (or as he referred to it, to “park” the money ) in a separate property for a period of several years as is allowed by IRS rules; at the period, the tribe would be allowed to buy the property back for the same price for which it was sold to Friedman per a “buy back option.”

Dickstein and Opper recommended that the tribe “accommodate” Friedman, and Friedman consequently purchased the property from the tribe.

Per their written agreement, the tribe was given the option to buy back the property within one year.  However, the tribe did not buy back the property within one as  a result of a failure by Arlen Opper and Howard Dickstein — the attorney for the tribe who was in possession of the written agreement — to inform the tribe when the time period expired so that the tribe could buy back the property.  Notably, the property had increased in value “exponentially” during this period.

Later,  after the “buy back option” had expired, the tribe realized that it had missed the deadline to buy back its 50% share of the property, and sought to do so at that time.  However, Mark Friedman refused to sell it back, claiming that the tribe had missed its deadline.

Separately, and as was reported earlier, Howard Dickstein, a widely-known but controversial figure within California’s Tribal Gambling industry, has been named a defendant in a suit seeking unspecified monetary damages. Also named as defendant is Dickstein’s wife, Sacramento-based lobbyist Jeannine English.

The lawsuit alleges that Dickstein and English executed a scheme that caused injury to the Plaintiff, a Southern California resident who claims his privacy and constitutional rights were “egregiously violated.”

In nearby Placer County, situated between the cities of Roseville and Lincoln, 50 miles east of Yolo County, where the United Auburn Indian Community operates the Thunder Valley Casino, allegations of greed and betrayal were also leveled against Howard Dickstein by the former chairwoman of the United Auburn Indian Community, the Honorable Jessica Tavares and long-time tribal council member Dolly Suehead.

According to media reports, Tribal Administrator Greg Baker — a Dickstein confederate — disallowed a tribe-funded mailing of a campaign mailer that claims the United Auburn Indian Community has been “bamboozled by an attorney [Howard Dickstein] more interested in filling his garage with Ferraris than serving the interest of our tribe, and the greed of a tribal council that rubber stamps his decision and no longer looks after our best interests.”

Baker, who as it turned out was involved in a separate and unrelated financial scheme, was recently suspended following on the heels of an IRS investigation into allegations of fraud and money-laundering. In affidavits filed by an IRS investigator, it was alleged that Baker was part of a scheme to over-bill the casino/tribe by more than $18 million, which would later be “kicked-back.”

Labor Party presidential candidate Colette Avital revealed in an interview with Channel 2 on Thursday that one of her bosses when she worked in the Foreign Ministry tried to attack her sexually.

“It happened many years ago and I defended myself,” Avital said. “We women are not defenseless if you know how to object and push people away.”

Avital considered (Shimon) Peres her mentor, but in the Channel 2 interview she denied rumors of an affair with Peres when she was Israel’s consul-general in New York. “There never was an affair, just like Peres never had an Arab mother,” Avital said, dismissing another well-known rumor about the vice premier.

Fortunately, Republican Arizona Senator John McCain recently stepped in and called for an investigation of Howard Dickstein.  Similarly, a few months prior to Senator McCain’s announcement, a Yolo County-based rabbi asked the State Bar of California Board of Governors to investigate English and Dickstein.

Friedman, a man of despicable character, may be a stranger to readers, but he is no stranger to The Leslie Brodie Report given that he was one of the  named defendants in the case of Rumsey vs. Dickstein, which deals primarily with allegations of years of fraud and deceit by Dickstein against his client, the Yocha Dehe Wintun Nation.

One example of such a scheme allegedly perpetrated by Dickstein and Friedman against the tribe deals with a parcel of land situated in West-Sacramento  known as “The Triangle,” an otherwise prime location facing the Sacramento River.

The tribe was urged by defendants Dickstein and its financial advisor Arlen Opper to enter into yet another business relationship with Friedman, through which a parcel of land in “The Triangle” was purchased.  The tribe would own 50% and Friedman and his extended would own 50% of the property.

At one point, Mark Friedman asked the tribe for a favor (or as he put it, an “accommodation”), by which the tribe would sell and Friedman would purchase the tribe’s 50% share in “The Triangle.”

Friedman’s excuse  for seeking the “accommodation” was very simple — he wanted to reduce the amount of money he would  owe the Internal Revenue Service.  Friedman had just sold a different piece of real estate, and  needed to quickly invest the money in real estate (or as he referred to it, to “park” the money ) in a separate property for a period of several years as is allowed by IRS rules; at the period, the tribe would be allowed to buy the property back for the same price for which it was sold to Friedman per a “buy back option.”

Dickstein and Opper recommended that the tribe “accommodate” Friedman, and Friedman consequently purchased the property from the tribe.

Per their written agreement, the tribe was given the option to buy back the property within one year.  However, the tribe did not buy back the property within one as  a result of a failure by Arlen Opper and Howard Dickstein — the attorney for the tribe who was in possession of the written agreement — to inform the tribe when the time period expired so that the tribe could buy back the property.  Notably, the property had increased in value “exponentially” during this period.

Later,  after the “buy back option” had expired, the tribe realized that it had missed the deadline to buy back its 50% share of the property, and sought to do so at that time.  However, Mark Friedman refused to sell it back, claiming that the tribe had missed its deadline.

Orly Taitz Assails Dianne Feinstein / J. Street PAC — Entity Associated with Jeremy Ben-Ami and Controversial Gambling Attorney Howard Dickstein of Sacramento, California

Prominent California attorney, Rancho Santa Margarita-based Dr. Orly Taitz has declared in no uncertain terms her opposition to left-wing Israel advocacy group J Street.  The announcement came on the heels of Dianne Feinstein’s acceptance of an  endorsement from the highly controversial J Street — an entity headed by Jeremy Ben-Ami. 

In reply to Feinstein’s endorsement, embattled gambling attorney Howard Dickstein of Sacramento-based Dickstein & Zerbi J stated to the media: “Her (Feinstein) views were very close, if not identical, to J Street’s,” said Howard , a board member of J Street’s political action committee .

Taitz, who is running against Feinstein adamantly opposes the J-Street/Feinstein position, stated:

“J-street is a far Left organization which advocates cutting up Jerusalem and giving a big part of Jerusalem to Palestinians, dismantling all of the Jewish settlements and towns in Judea and Samaria. They are more radical than many Palestinians. The fact that Feinstein accepted their endorsement speaks volumes. Feinstein is the chair of the Senate Intelligence committee. Endorsing such radical views will not promote peace and doesn’t mesh with her position as chair of the Senate Intelligence Committee.”

 This year, 23 neophytes have paid $3,480 each for the opportunity to challenge incumbent Sen. Dianne Feinstein, the doyenne of Congress’ Jewish contingent, who has held the seat since 1992. Under new rules, the top two vote-getters in today’s primary will proceed to the general election in November—regardless of party registration. With the opposition candidates all polling below 5 percent, that opens up a window of opportunity for long-shot gadflies to make it to the general election ballot.

The list includes Orly Taitz, the Soviet Jewish émigré who styles herself the queen of the birther movement, and Nachum Shifren, formerly known as Norm, a native Malibu surf rat and Hasidic rabbi who, according to London’s Jewish Chronicle, once worked as a driver for the extremist leader Meir Kahane and more recently traveled to Britain to rally with the English Defence League, a nationalist, anti-Islam group. “Many of the other candidates,” said Jack Pitney, a political-science professor at Claremont McKenna College, “are an organic mix of nuts and vegetables.”

The likelihood that Feinstein will actually be unseated is accordingly negligible. She is one of the most popular politicians in the state, and despite being the victim of a $4.5 million campaign-funds embezzlement scam, she holds a cash advantage of $2.5 million over the official candidate of the state Republican Party, an autism activist named Elizabeth Emken. All of which explains why the announcement late last week that Feinstein had accepted the endorsement of the left-wing Israel advocacy group J Street was met not with the vitriol many pro-Israel groups heaped on Democrat Joe Sestak, J Street’s candidate in Pennsylvania’s 2010 Senate race, but with silence.

 

J Street, which launched in 2008 with ambitions to act as a progressive counterweight to the behemoth American Israel Public Affairs Committee, has struggled to find entree with Congress’ senior players. Feinstein lends them much-needed gravitas. “J Street is establishing itself as an element of the mainstream Jewish community,” said J Street’s head, Jeremy Ben-Ami.

J Street made its approach in April, after Feinstein wrote an op-ed for the San Francisco Chronicle defending Obama’s diplomatic approach toward Iran. “Her views were very close, if not identical, to J Street’s,” said Howard Dickstein, a board member of J Street’s political action committee and Sacramento lawyer who made his fortune representing Indian tribal gambling interests. “I don’t think she has to be fearful of any kind of retaliation or pushback.” Dickstein was joined in making the ask by J Street advisory board member Carol Winograd, a retired Stanford University professor of medicine and biology whose husband, Terry, served as a Ph.D. adviser to Google co-founder Larry Page. (Together, the Winograds have given more than $600,000 to Democratic causes in the past three cycles.)

The abuse and financial atrocities by attorney Howard Dickstein (on behalf of himself, as well as others) against his clients — Native Americans who are members of various Indian tribes operating casinos in the State of California — is well documented.

Hit hard were the Yocha Dehe Wintun Nation which operates the Cache Creek Casino in Yolo County, the Pala Band of Mission Indians which operates the Pala Casino Resort & Spa in San Diego County, and the United Auburn Indian Community which operates the Thunder Valley Casino in Placer County.

One such incident resulted in the emotionally distressing injustice inflicted on the bona fide founder of Thunder Valley Casino, the ex-chair of the tribe, Jessica Tavares.

Jessica is a proud visionary who was the force behind the economic and cultural revival of the tribe — as well as the revival of surrounding communities.  Sadly, Jessica was ultimately betrayed by a fellow member of the tribe and placed on the proverbial iceberg because she chose honor, integrity, and dignity for herself and for the tribe over the greed and divisiveness promoted by Howard Dickstein in his quest to obtained millions for himself and by extension for his wife,  Jeannine English.

Since 2006, Jeannine English has served as a “public member” of the State Bar of California Board of Governors, an otherwise governmental entity primarily responsible to disciplining errant lawyers.  Despite allegations that Dickstein has committed countless acts of grave misconduct and ethical breaches, Dickstein has never been disciplined by the State Bar of California.  English’s appointment as a public member was courtesy of her California Democratic Party confederates who control California’s legislative branch.

Unfortunately, the two U.S. Senators from California refuse to become involved in these issues despite the fact that  tribal matters fall primarily within federal oversight. Dickstein, in his role as counsel for the tribes, has overseen the tribes’ contributions of millions of dollars to the coffers of the Democratic Party.

Fortunately, Republican Arizona Senator John McCain recently stepped in and called for an investigation of Howard Dickstein.  Similarly, a few months prior to Senator McCain’s announcement, a Yolo County-based rabbi asked the State Bar of California Board of Governors to investigate English and Dickstein.

The J Street Gang of Greed

In approximately 2004, as part of an effort to revitalize its downtown area, the city of Sacramento poured three million dollars into subsidies for the renovation of the “Elliott Building” located at 1530 J Street in Sacramento.  The project was initiated by Mark Friedman of Sacramento-based Fulcrum Property Group and a few of his business partners.

Friedman, a man of despicable character, may be a stranger to readers, but he is no stranger to The Leslie Brodie Report given that he was one of the  named defendants in the case of Rumsey vs. Dickstein, which deals primarily with allegations of years of fraud and deceit by Dickstein against his client, the Yocha Dehe Wintun Nation.

The tribe was urged by defendants Dickstein and its financial advisor Arlen Opper to enter into yet another business relationship with Friedman, through which a parcel of land in “The Triangle” was purchased.  The tribe would own 50% and Friedman and his extended would own 50% of the property.

Chairman Marshall McKay leads the elected Tribal Council of the Yocha Dehe Wintun Nation. He began his career in tribal government in 1984 and in January 2012 was re-elected to his third term as Chairman.

Born in Colusa, California, the Chairman grew up in Brooks near his present-day home in the Yocha Dehe tribal community. A cornerstone of his leadership is his commitment to cultural renewal and preservation, a focus he extends into education programs and sustainable land-use practices.

Chairman McKay oversees the day-to-day operations of the tribal government, the Tribe’s Cache Creek Casino Resort and its other business endeavors. He also serves as chair of the Community Fund Committee and Cache Creek Casino Resort Board, and is a member of the Fire Commission, Cultural Resources Committee, Property, Farm and Ranch Committee, Maintenance and Operations Committee, the Health and Wellness Committee, and Yocha Dehe Wintun Academy Board. Prior to being elected Chairman, he served as Tribal Treasurer and Tribal Secretary.

Chairman McKay is a board member of the UC Davis Foundation, the Smithsonian’s National Museum of the American Indian, and the Native American Rights Fund. He is also chairman of the board of the Autry National Center in Los Angeles.

Washington, DC-based investigative journalist Susan Bradford’s article about Howard Dickstein / Thunder Valley Casino contains false and inaccurate Information

Susan Bradford is a Washington, DC-based investigative journalist, author, and columnist. During her four-year investigation of the Abramoff scandal, Bradford interviewed over 400 sources who participated or were otherwise privy to the key events at hand, including lobbyists, attorneys, tribal leaders and dissidents, agency and elected officials, reporters, Committee members, activists, corporate executives, among many others.

She also acquired substantial corroborating paperwork from Indian tribes and other former clients and associates of superlobbyist Jack Abramoff. At the invitation of tribal members, Bradford lived on Indian reservations and attended tribal gatherings. In 2007, Bradford became the first journalist to uncover that the Abramoff scandal had been manufactured by tribal dissidents and their lobbyist allies, including Scott Reed. She has been breaking new ground on the Abramoff investigation ever since.

Unfortunately, in a recent article about a complaint filed by John McCain with the National Indian Gaming Commission against controversial gambling attorney Howard Dickstein, Susan Bradford falsely reported (false information underlined) :

“Reminiscent of a pattern established during the Abramoff investigation, McCain’s letter to the NIGC followed a scuffle within the Tribal Council in which disgruntled dissidents running for office were accused of leaking false information to the public in order to challenge their rivals and lay the foundation for a corruption probe.

The Auburn dissidents distributed a mailer alleging that the tribe was “bamboozled by an attorney more interested in filing his garage with Ferraris than serving the interest of our tribe, and the greed of a Tribal Council that rubber stamps his decision and no longer looks after our best interests.”

The Tribal Council reportedly countered that the mailer incorporated false information which “makes it appear the tribe is legitimizing this type of gutter politics and giving the allegations credibility.”

The mailer accused the Tribal Council of closing the tribe’s privately funded middle and high school classrooms while paying a lawyer $25 million.

Despite having made these claims, the Auburn dissidents reportedly served on Tribal Council when Dickstein’s percentage fee was established and revoked. If the fees were improper, why didn’t they blow the whistle then?

Dickstein has since been fired, and the California Tribal Business Alliance, whose leadership consists of representatives from the Paskenta Band of Nomlaki Indians of California, the Pala Band of Luiseno Indians, and the Lytton Rancheria of California Indians (represented by Rodgers), also reportedly severed ties with him.”

The lawsuit alleges that Dickstein and English executed a scheme that caused injury to the Plaintiff, a Southern California resident who claims his privacy and constitutional rights were “egregiously violated.”

Specifically, the suit alleges that in order to camouflage a scheme and make it appear as though it is purely a mundane action by a governmental agency and was not designed to conceal Dickstein’s and English’s own acts of malfeasance, greed, and betrayal, defendants resorted to abusing their considerable “political and legal clout.”

This clout was presumably obtained as a result of the funneling of hundreds of millions of dollars from myriad Tribal Casinos to various state and local governmental agencies/officials, as well as from English’s position as a member of the State Bar of California Board of Governors, and the fact that the president of the State Bar of California, Jon Streeter, and his firm of Keker & Van Nest, represent Howard Dickstein. This , the plaintiff alleges, shows “malice and oppression” on the part of defendants sufficient to justify an award of punitive damages.

Dickstein , who is no stranger to litigation, has been previously named a defendant in a suit advanced by his client, members of the Yocha Dehe Wintun Nations (formerly known as the Ramsey Band of Wintun Indians), which owns and operates the Cache Creek Casino in Brooks, California, an unincorporated community in Yolo County.

According to media reports, Tribal Administrator Greg Baker — a Dickstein confederate — disallowed a tribe-funded mailing of a campaign mailer that claims the United Auburn Indian Community has been “bamboozled by an attorney [Howard Dickstein] more interested in filling his garage with Ferraris than serving the interest of our tribe, and the greed of a tribal council that rubber stamps his decision and no longer looks after our best interests.”

Baker, who as it turned out was involved in a separate and unrelated financial scheme, was recently suspended following on the heels of an IRS investigation into allegations of fraud and money-laundering. In affidavits filed by an IRS investigator, it was alleged that Baker was part of a scheme to over-bill the casino/tribe by more than $18 million, which would later be “kicked-back.”

Bonnie King Avers Controversial Gambling Attorney Howard Dickstein and Mouthpiece Doug Elmets Engage in “Heinous Action” and “Tribal Terrorism” Against Native Americans

In a desperate plea for help, activist Bonnie King is asking members of Congress to bring an end to “tribal terrorism” Howard Dickstein and Doug Elmets inflict on members of various Indian tribes located in California.

According to King, unscrupulous tribal leaders engage in a scheme to “kick out enrolled members without just cause to increase their own wealth and power.” 

King further alleges that the scheme is supported by Howard Dickstein and political consultant Doug Elmets who “are encouraging tribal committees to execute this heinous action. While they drive their nice sports cars, live in huge mansions, and fly in private jets the executive committees are sending disenrolled members into bankruptcy and a loss of sacred heritage. They use false excuses for reasoning, but the disenrollments have only taken place post Indian Gaming. Federal and state governments will not intervene, calling it intertribal issues, so the disenrolled members have no say or recourse”, King stated.

“Something desparately needs to be done about this corruption,” King concluded.

Members of Pala Band of Mission Indians Ask President Barack Obama for Help in Struggle Against Controversial Gambling Attorney Howard Dickstein

Members of San Diego-based Pala Band of Mission Indians are asking U.S. President Barack Obama for help in their struggle against controversial gambling attorney Howard Dickstein.  

In an article recently published by a former member of the tribe, an eerie comparison was made between “Blood Diamonds” to “Blood Indian Gaming Money.”  According to the article “Gov. Jerry Brown was given $200,000 in “Blood Indian Gaming Money.” 

Moreover, the author alleges that Howard Dickstein controls “the Tribal  Business Alliance, Robert Smith and Doug Elmets. Elmet’s office is in the same building where Gov. Brown has his penthouse pad. So the disenrolled blood $$ don’t have to drip that far to get them all dirty.”

In nearby Placer County, situated between the cities of Roseville and Lincoln, 50 miles east of Yolo County, where the United Auburn Indian Community operates the Thunder Valley Casino, allegations of greed and betrayal were also leveled against Howard Dickstein by the former chairwoman of the United Auburn Indian Community, the Honorable Jessica Tavares and long-time tribal council member Dolly Suehead.

According to media reports, Tribal Administrator Greg Baker — a Dickstein confederate — disallowed a tribe-funded mailing of a campaign mailer that claims the United Auburn Indian Community has been “bamboozled by an attorney [Howard Dickstein] more interested in filling his garage with Ferraris than serving the interest of our tribe, and the greed of a tribal council that rubber stamps his decision and no longer looks after our best interests.”

Baker, who as it turned out was involved in a separate and unrelated financial scheme, was recently suspended following on the heels of an IRS investigation into allegations of fraud and money-laundering. In affidavits filed by an IRS investigator, it was alleged that Baker was part of a scheme to over-bill the casino/tribe by more than $18 million, which would later be “kicked-back.”

Roman Porter — a long time ally and confederate of California Democratic Party operative Joseph Dunn of embattled online publication Voice of OC who now serves as the executive director of the State Bar of California — was recently hired as Thunder Valley Casino’s new tribal administrator.

The article concludes by urging the readers to sign a petition: ” The unjustified killing of the souls of tribal members at Pala is not the actions of a sovereign but the actions of a cruel dictatorship that any ruthless dictator in the world would admire. Speak out and sign the petition to the White House    Now!.”

 

SacBee 2004: Governor, five tribes set to sign compacts

Gov. Arnold Schwarzenegger is set to sign deals today or Thursday that will authorize at least five new Indian casinos in California and firmly establish his approach to future expansion of tribal gambling.

Among the “sure thing” tribes is the Lytton Band of Pomo Indians, a tribe with Sonoma County roots that wants to build a mega-casino just off Interstate 80 in San Pablo. As envisioned, the casino would become the largest in California and one of the largest in the world, with up to 5,000 slot machines and covering up to 600,000 square feet.

The casino would be operated for the tribe by a partnership that includes the Maloof family, owners of the Sacramento Kings and the Palms Hotel & Casino in Las Vegas; the Rumsey Band of Wintun Indians, a Yolo County tribe that owns the Cache Creek Casino Resort; the Pala Band of Mission Indians in San Diego County; Arlen Opper, a Cache Creek executive; and Jerry Turk, the managing partner of the Pala casino.

In an interview Tuesday, George Maloof said his family had been friends with Opper for a long time and also had close relations with the Rumsey tribe.

Controversial Gambling Attorney Howard Dickstein — Ally of Yolo County Superior Court Judge Dave Rosenberg /Client of Keker & Van Nest — Named Defendant in Civil Suit As Scrutiny of Jon Streeter – PG & E Intensifies

Howard Dickstein, a widely-known but controversial figure within California’s Tribal Gambling industry, has been named a defendant in a suit seeking unspecified monetary damages. Also named as defendant is Dickstein’s wife, Sacramento-based lobbyist Jeannine English.

The lawsuit alleges that Dickstein and English executed a scheme that caused injury to the Plaintiff, a Southern California resident who claims his privacy and constitutional rights were “egregiously violated.”

Specifically, the suit alleges that in order to camouflage a scheme and make it appear as though it is purely a mundane action by a governmental agency and was not designed to conceal Dickstein’s and English’s own acts of malfeasance, greed, and betrayal, defendants resorted to abusing their considerable “political and legal clout.”

This clout was presumably obtained as a result of the funneling of hundreds of millions of dollars from myriad Tribal Casinos to various state and local governmental agencies/officials, as well as from English’s position as a member of the State Bar of California Board of Governors, and the fact that the president of the State Bar of California, Jon Streeter, and his firm of Keker & Van Nest, represent Howard Dickstein. This , the plaintiff alleges, shows “malice and oppression” on the part of defendants sufficient to justify an award of punitive damages.

Dickstein , who is no stranger to litigation, has been previously named a defendant in a suit advanced by his client, members of the Yocha Dehe Wintun Nations (formerly known as the Ramsey Band of Wintun Indians), which owns and operates the Cache Creek Casino in Brooks, California, an unincorporated community in Yolo County.

David Rosenberg served as a Senior Advisor to two California Governors: Jerry Brown and Gray Davis. For Jerry Brown he served as Deputy Appointments Secretary, helping the Governor appoint an unprecedented number of women and minorities to state government positions. He also served Jerry Brown as Deputy Executive Secretary and Chief of Staff. For Gray Davis he served as Director of Community and Intergovernmental Relations and as Director of Operations for the Governor’s Office. In these roles he negotiated with Indian Tribes, was the liaison with city and county governments throughout California, headed up the Governor’s community relations effort and supervised the Governor’s field offices, and made sure the Governor’s staff coordinated with each other. He has served as Chairman of the California State Lottery Commission, Chairman of the California Law Revision Commission, and as Chairman of the California Victim Compensation and Government Claims Board (the former “Board of Control.”). Additionally, Rosenberg served as the Ethics Officer for the Governor’s Office.

In 2003, he was appointed a Judge of the Yolo Superior Court, where he currently serves as a trial judge with a full felony criminal assignment, including felony jury trials. By early 2010, Judge Rosenberg has presided over 80 felony jury trials in the Yolo Superior Court. Judge Rosenberg has handled civil, family, and juvenile matters for the Court as well. In addition, Judge Rosenberg serves on the Appellate Division of the Superior Court. He also has taught other Judges at the California Judges College. A noted expert on parliamentary procedure, Judge Rosenberg has taught Mayors, Council members, County Supervisors and Clerks parliamentary procedure and has published “Rosenberg’s Rules of Order” which has been adopted by a number of California jurisdictions to govern the conduct of their meetings.

In 2007 Judge Rosenberg was elected Presiding Judge of the Yolo Superior Court by the other Judges of the Court for a two-year term in 2008-09, and then in 2009 was re-elected by the Judges to serve a second term as Presiding Judge of the Court for 2010-11. He was also elected (by other Presiding Judges throughout California) as a member of the Executive Committee of the Trial Court Presiding Judges Advisory Committee, representing medium-size Courts. He is leading the effort to build a new Courthouse for Yolo County, and such a new Courthouse is planned to be constructed by 2012-13.

Breaking ….. Cache Creek Casino — Under the Tight Control of Howard Dickstein — Funnels Millions to Yolo County District Attorney (TLR Note: See Below)

During the investigation, tribal representatives refused to participate in the process or respond to the grand jury’s findings, citing their status as “a sovereign governmental entity that is immune to the jurisdiction and process of state and local authorities.”

Representatives from the Yocha Dehe tribe also refused to provide up-to-date membership figures when requested for this story, but the grand jury report estimated adult membership at fewer than 25 people.

While tribal casinos present challenges to rural counties, some believe their value as an economic engine can’t be denied.

Steve Smith, the human resources director for the Dry Creek Rancheria Band of Pomo Indians — the Sonoma tribe operating River Rock —said that the casino employs roughly 600 people, making it one of the top 20 employers in the county.

Cache Creek employs more than 2,300 people, said Mike Traum, the casino’s communications manager. The figure makes the casino the second largest employer in Yolo County, behind only the University of California, Davis.

Noting the effects that such large-scale gaming operations can have on rural areas, the tribes operating  Cache Creek and River Rock have entered into intergovernmental agreements with Yolo and Sonoma counties, respectively.
Both agreements resulted in multimillion-dollar windfalls of mitigation payments for the two counties.

In Yolo County, the Yocha Dehe tribe has shelled out more than $32 million in mitigation between 2002 and 2010, with healthy portions going toward the sheriff’s department and the district attorney’s office.

Howard Dickstein — a Sacramento-based Indian gambling attorney is highly corrupted, greedy at the extreme, and has been compared by many to Jack Abramoff. 

Dickstein two main clients are Cache Creek Casino / Yocha Dehe Wintun Nation located in Yolo County, and Thunder Valley Casino/ United Auburn Indian Community located in Placer County.

Only recently, Arizona Senator John McCain has called for an investigation concerting Dickstein ‘s alleged unlawful business practices.  Similarly, Madame Jessica Tavares — former chair of  United Auburn Indian Community which owns Thunder Valley Casino — accused Dickstein of duping the tribe into paying his firm $26 million in fees over six years.

While the above mentioned suit was being litigated,  not surprisingly, wholly separate allegations of grave misconduct were leveled against Howard Dickstein, as well as against the firm which represented him — Keker & Van Nest.

Shockingly, Sonnenschein Nath & Rosenthal, Cotchett Pitre & McCarthy,  and ethics expert Michael Boli  did not allege that Howard Dickstein and/or Keker & Van Nest engaged in extortion/attempted extortion or otherwise violated ethics rules which prohibit — even indirectly —  the threat of criminal prosecution for the purpose of gaining an advantage over an adversary in a civil dispute,  in reply to false allegations advanced to the court by Howard Dickstein and/or Keker & Van Nest that the plaintiffs (the clients of Sonnenschein Nath & Rosenthal, Cotchett Pitre & McCarthy and ethics expert Michael Boli ) had “clearly committed a felony.”

Dickstein is married to one Jeannine English — a lobbyist from Sacramento who serves as “Public Member” of the State Bar of California Board of Governors/Trustees.  Jeannine English, not surprisingly, is as greedy and corrupt as Dickstein, and then some. 

She is a former member of the California’s  “Little Hoover Commission” (as is State Bar of California “Public Member” Gwen Moore of Shrimpscam. )  

Interestingly, while Jeannine English was part of the Little Hoover Commission, Howard Dickstein was appointed to purvey legal services to the commission.  Conversely, Dickstein  had arranged that his client — the Rumsey Band of Wintun Indians — would hire his wife Jeannine English to act as “Lobbyist” for the tribe.

Jeannine English was positioned as BOG “Public Member” to primarily ensure that her husband Howard Dickstein will not be disciplined by the State Bar of California, despite the well documented trail of fraudulent and egregious misconduct he had perpetrated against several  of his clients.  This had the net benefit of unjustly enriching  both  herself and her husband at the expense of Dickstein ‘s client, the People of the State of California, and the fair administration of justice. 

Further seeking to escape justice and in order to apiece other law enforcement agencies, Dickstein also arranges for huge sums of money to be donated to Jerry Brown, California attorney general Kamala Harris,  and other California Democratic Operatives from the coffers of his clients.  See example @    http://tinyurl.com/cftq5ye

Incidentally, Gwen Moore of Shrimpscam (as is  “Public Member” Dennis Mangers – also a California Democratic Party operative)  primary goal as BOG public members is also  to ensure that certain law firms such Girardi & Keese, Engstrom Lispcmomb & Lack, Cotche Pitre & McCarthy, Kreindler & Kreindler, Morrison & Foerster, Skadden Arps, Kerr & Wagstaffe, Howard Dickstein of Dickstein & Zerbi, and many others known as “State Bar Royalty” are not disciplined by the State Bar.  For example, Gwen Moore, Jeannine English, Alec Chang, Jon Streeter , Starr Babcock, Robert Hawley, Joe Dunn, and others are part of an ongoing highly unlawful conspiracy to obstruct justice in the matter of In Re Girardi.

 In consideration of allowing to operate with impunity by the state Bar of California , those  law firms contribute handsomely to members of the California Democratic Party vis-vis political donations and /or class-actions Cy Pres award and/or diversity money — either directly or indirectly. 

Moore is also involved in various other adventures which mainly consist of  “leaning” on the CPUC/Utility companies for the purpose of extracting money under the guise of Diversity pursuant to General Order 156.  According to sources close to YR,  General Order 156 is nullity given the passage of Proposition 209.  Consequently, those sources maintain,  a declaratory judgement action will soon be filed in the Sacramento Superior Court seeking to declare General Order 156 null and void.

In furtherance of the above mentioned unlawful activities, and in order to compensate for the lack of discipline imposed on State Bar Royalty; sources familiar with the situation maintain a policy was put in place by Judy Johnson, Jeannine English, Thomas Girardi, Robert Hawley, Howard Dickstein, Alec Chang, Starr Babcock, Howard Miller, Holly Fujie and others — on their behalf and on behalf of others — to frame innocent lawyers and/or impose unusually harsh discipline even for minor violations. 

For example, on one hand, Walter Lack and Pierce O’Donnell — who despite a well documented trail of repeated acts of misconduct — have no or  very little displined imposed by the State Bar of California, respectively.   On the other hand , Phil Kay , Ron Gottschalk, Dan Dydzak , and many other were treated unjustly, and in accordance with said policy.
